RE: Amaya Subdivision
Dear Mr. Amaya:
I am in receipt of an approved Exemption plat signed by the County Surveyor. In reviewing
your file, it appears that all the conditions of approval have been met with one exception.
Condition #7 stated that "a well sharing agreement shall be provided prior to the approval of
the plat and shall be recorded in conjunction with each deed conveying well ownership." Upon
submittal of an acceptable document, the plat and a Resolution of Approval can be signed by
the Board of County Commissioners. Sale of the second lot can then occur.
If you have any questions, please feel free to call.
Sincerely,
Andrew C. McGregor

RE: Amaya Exemption
Section 19, T65, R92W, 6TH PM
Division 5, District 45
Dear Andrew,
We have reviewed the above referenced proposal to divide a49 acre parcel into three
(3) tracts and one outlot. There is an existing we1l, Permit No: 160303, (copy enclosed)
on the properry. Of special note, the well permit restricts irrigation to one total acre to be
divided amongst the three single-family dwellings.
ln order to assure that a perrnanent water supply will be available on an equitable
basis to any lot, we recommend the following:
1. The well should be located on the outlet owned in common by all properry
owners using the well. Access to the well and the right to establish and
maintain a pipeline should be provided by easements where necessary.
The well should be jointly owned by the lot owners.
Covenants and/or other mechanisms should establish a lot owners association
with the authority to make decisions concerning management and operation of
the well. A joint maintenance agreement is a required part of such an
association
