In reviewing your file, it appears that all the conditions of approval have been met with one exception. Condition #7 stated that "a well sharing agreement shall be provided prior to the approval of the plat and shall be recorded in conjunction with each deed conveying well ownership." Upon submittal of an acceptable document, the plat and a Resolution of Approval can be signed by the Board of County Commissioners. Sale of the second lot can then occur. There is an existing we1l, Permit No: 160303, (copy enclosed) on the properry. Of special note, the well permit restricts irrigation to one total acre to be divided amongst the three single-family dwellings. ln order to assure that a perrnanent water supply will be available on an equitable basis to any lot, we recommend the following: 1. The well should be located on the outlet owned in common by all properry owners using the well. Access to the well and the right to establish and maintain a pipeline should be provided by easements where necessary. The well should be jointly owned by the lot owners. Covenants and/or other mechanisms should establish a lot owners association with the authority to make decisions concerning management and operation of the well. The applicants are proposing to divide a 49 acre parcel into three (3) tracts and one outlot. It is my assumption that the outlot would be a well parcel. Also enclosed is a copy of a well permit application. that Mr. Amaya intends to service the three parcels domestic well. The issuance of the permit does not assure the applicant that no injury will occur to another vested wateriight or preclude another owner of a vested water right from seeking relief in a civil court action. 2) Approved pursuant to cRS 37-92-602(3)(b)0D(A) as the only well on a rract of land of 49.3 acres described as thatportion of the NW 1/4 of Sec. 19, Twp. 6 South, Rng. 92 West of the 6th p.M., Garfield County, being more particularly described as Lot 1, Amaya Exemption, on the attached exhibit .A,. The use of ground water from this well is limited to ordinary household purposes inside three (3) single family dwellings, fire protection, the watering of poultry, domestic animals, and livestock on a farm or rancn, and the irrigation of not over one (1) acre of home gardens and lawns. The return flow from the use of the well must be through an individual waste water disposal system of the non-evaporative type where the water is returned to the same stream system in which the well is loiated. The maximum pumping rate shall not exceed 1S GpM.
