Dear Board Members:
ADD Investments has asked me to prepare and file well permit applications for the lots
they wish to create in the subdivision exemption process. Because the four new lots to be
created will not qualify for an exempt well, it will be necessary for ADD to apply for water
from the West Divide Water Conservancy District in order to obtain approval of such well
permits.
Please be advised that well permit applications and applications for water from the West
Divide Water Conservancy District have been filed. We anticipate that the permits will be
issued in conjunction with the issuance of a West Divide Water Conservancy District, as there
appears to be no impediment to their issuance. ADD does meet the requirements as were agreed
to by the State Engineer's Office and West Divide Water Conservancy District.
We anticipate receiving approval of the well permits and contracts within the next few
weeks and will provide you with copies of such well permits when they are issued. We are
requesting that the subdivision exemption application be approved contingent upon receipt of
such well permit.

Dear Mr. Harris
Your application for a Subdivision Exemption has been scheduled for a public meeting before
the Board of County Commissioners on May 8th, 1995 at I l:00 a.m. in the Commissioners'
Meeting Room, Suite 301, Garl-reld County Courthouse, 109 8th Street, Glenwood Springs, CO
81601. It is suggested that you be present at the time of the meeting.
Copies of the enclosed exemption public notice form need to be mailed by certified return-
receipt to all property owners adjacent to or within 200 ft. of your property at least 15 days, but
not more than 30 days, prior to the meeting. In addition, the notice needs to be mailed by
certihed return-receipt to owners of mineral rights, or lessees of mineral owners of record of the
land proposed for exemption, at least 15 days, but not more than 30 days, prior to the meeting.
The certiflrcates of mailing and return-receipts lrom these mailings need to be presented at the
time of the meeting or submitted to the Planning Department prior to the meeting. The
exemption site must also be posted with the enclosed Notice poster, visible from a County
Road, at least l5 days, but not more than 30 days, prior to the meeting.

TAKE NOTICE that ADD INVESTMENTS LLC has applied to the Board of County
Commissioners, Garfield County, State of Colorado, to grant a Subdivision Exemption in
connection with the following described property situated in the County of Garheld, State of
Colorado; to-wit:
Legal Description: See Exhibit A
Practical Description: Located approximately two (2) miles west of New Castle, on the north
and south side of County Road 214.
Said subdivision exemption is to allow the petitioner to divide an 27 acre tract into five (5)
tracts of approximately 3.5, 6.0, 2.5,7 .5 and 7.5 acres in size on the above described property.
The hfth parcel is being requested due to the natural division of the County Road and an
unnamed drainage north of CR 214.
All persons affected by the proposed subdivision exemption are invited to appear and state
their views, protests or objections. If you cannot appear personally at such meeting, then you
are urged to state your views by letter, particularly if you have objections to such subdivision
exemption request, as the Board of County Commissioners will give consideration to the
comments of surrounding property owners and others affected in deciding whether to grant or
deny the request forthe subdivision exemption. This subdivision exemption application may
be reviewed at the offrce of the Planning Department located at 109 8th Street, Suite 303,

Dear Mr. Michaelson:
Enclosed is an amended letter. The previous letter inadvertently refereed you to Mr. Ken
Knox of Montrose office. This is regarding your referral for exemption to subdivide one 27 acfe
parcel located west of the Town of New Castle, Colorado, into five parcels of approximately..3-S,
b.O, 2.5, 7.S and 7.5 acres in size. The proposed water supply source on the lots will be
individual on lot wells.
Our records show that we have already approved well permits for these lots, (nos. 45001-
F through 4SOO4-F and 186705). The permits were approved on May 31, 1995. The first four
permits were approved pursuant to the contract with West Divide Conservancy District, and the
iast one was late registered as an existing well. We have no objection to the utilization of these
wells, provided they divert water per the conditions of their permits.

Dear David:
At your request, we have prepared the following letter report to support ADD investment's
development of the Anthony Property near Silt, Colorado. The property is located in
Section 5, Township 6 South, Range 91 West of the 6th P.M. On May 8, 1995 during
Exemption hearing the Board of County Commissioners required that you demonstrate an
adequate physical water supply prior to plat approval of the proposed exemption. The
Commissioners went on to say that on site cistern storage system that provides a
minimum of 7 days of in house water use for a typical single family lot is an adequate
method for meeting the water supply requirement. The Board also required a letter of
commitment for service from an existing municipality be obtained.
We have calculated the volume of 7 days of in house storage based on the information you
supplied; it is our understanding that the proposed development will be composed of the
following:
5 Single Family Dwellings Lots
1. Each Single Family Dwelling will have 3.5 persons per residence
2. Using approximately 1O0 gallons per day per person
3. lrrigation of lawn and garden will be derived from the Tomkin/Rosman Ditch
To comply with the County requirementtor 7 days of storage for a "typical residence", rt
is our opinion that it will be necessary to provide 2500 gallons of cistern storage with each
lot.
3.5 people x 100 gallons per person per day x 7 days = 2500gallons of storage
It is our opinion that the propose cistern system will satisfy the county requirement to
supply a reliable water supply for each lot. We have attached a letter from the Town of Silt
proposing to supply water to the ADD investments exemption on a contract basis.

It is our understanding that you will also be providing a well permit and a West Divide
water service contract with each lot. Each new lot owner will have the option to drilt their
own well or haul water from one of the Town of Silt.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
lnstallation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) for the construction of a well, appropriating ground water tributary to the
Colorado Biver, as an alternate point of diversion to the Avalanche Canal and Siphon, on the condition that the
well be operated onlv when the West Divide Water Conservancy District's substitute water supply plan, approved
by the State Engineer, is in effect and when a water allotment contract between the well owner and the West Divide
Water Conservancy District for the release of replacement water from Ruedi Reservoir is in effect, or under an
approved plan for augmentation. WDWCD contract # 950323ADD#5(a).
4) The use of ground water from this well is limited to ordinary household purposes inside one (1) single family
dwelling and a caretaker unit, the watering of domestic animals, and the irrigation of not more than 3,OOO square
feet (0.07 of an acre) of home gardens and lawns. AII uses are to be located on lot 5, ADD Subdivision Exemption,
Garfield County.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The average annual of amount of ground water to be appropriated shall not exceed two (2) acre-feet (651,700
gallons).
7) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records
of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division
Engineer upon request.
B) The well shall be constructed not more than 200 feet from the location specified on this permit.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court
case number(s) as appropriate. The owner shall take

approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
lnstallation Contractors in accordance with Rule 18.

Coiorado River, as an alternate point of diversion to the Avalanche Canal and Siphon, on the condition that the
well be operated onlv when the West Divide Water Conservancy District's substitute water supply plan, approved
by the State Engineer, is in effect and when a water allotment contract between the well owner and the West Divide
Water Conservancy District for the release of replacement water from Ruedi Reservoir is in effect, or under an

4) The use of ground water ,rom this well is limited to ordinary household purposes inside one (1) single family
dwelling and a caretaker unit, the watering of domestic animals, and the irrigation of not more than 3,000 square
feet (0.07 of an acre) of home gardens and lawns. All uses are to be located on lot 4, ADD Subdivision Exemption,
Garfield Counry.
5) The maximum pumping rate shall not exceed '15 GPM.
6) The average annual of amount of ground water to be appropriated shall not exceed two (2) acre-feet (651,700
gallons).
T) A totalizing ftow meter must be installed on this well and maintained in good working order. Permanent records
of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division
Engineer upon request.
8) The well shall be constructed not more than 200 feet from the location specified on this permit.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court
