Gentlemen:
Enclosed is an Application for Waiver of Subdivision Requirements whieh we
ask be approved by the Board of County Conmissioners of Garfield County. The
reasons for this appLication are set forth in the application and pertain to
clarification of boundary l-i-nes between the Metropolitan District, S. W. Anderson

Because the Garf{eld County Zoning Ordinance permlts only one prln-
cipal use per lot, we feel that the best pnocedurr would be to spllt theproperty lnto two lots before approving the Condltlonal Use Permit. Thls
can be handled through an exemption request submltted to our offlce. I
have enclosed an appllcatlon forrn for the exemptlon whlch should be self-
explanatory. The fee for the exemption is $50.00 plus $1.00 per acrefor each nar ltt less than 35 acves or a total of $57.00.

APPLICATION EOR WAIVER OF SUBDIVISION REQUIREMENTS
Application is hereby made to the Board of County Commissioners of Garfield
County, Colorado, to exempt from the definitions of the terms "subdivisiont' and
"subdivided land", 30-28-101, C.R.S. L973, as amended, and the Resolutions of
Garfield County the hereinafter described transaction.
Rifle Village South Metropolitan District, of Garfield County, Colorado,
needs to acquire a trlangular portion of land from Mary Margaret Johnson for
road and utilities easements. One of the conditions of acquir:i.ng such triangular
parcel of land is that S. W. Anderson and Lola Marie Anderson must quit claim
at L8% foot strip of land along the trrlest edge of the SE% NI{% of Section 20,
Township 6 South, Range 93 West of the 6th Principal Meridian, all of Garfield
County, Colorado, the reason being that Mrs. Johnson claims this strip of land
due to adverse possesslon, on the basis that she has had this strip of land
fenced in for many years, well beyond the prescription period. Both the Andersons
and the Metropolitan District need to retain the northerLy 475 feet of said strlp
of 1and, for road and utilities easements. This strlp of land being transferred
has been used, is partly used, and will be used in the future for agricultural
purposes. No consideration is being transferred between the grantors and grantee.
The namesofthe applicants (grantors) are S. W. Anderson and Lola Marie
Anderson, Route 1, Box 140, Rifle, Colorado 81650 and the name of the purchaser
(grantee) is Mary Margaret Johnson, 176LB San Benito Way, Los Gatos, California
95030.
Applications submit that this division of land is not being made for the
purpose of evading the provisions of Part 1 of Artlcle 28 of Title 30 of the
Statutes of the Stat.e of Colorado.
The description of the subject parcel of land being transferred is as follows:
A strip of land being the West 18.5 feet of the SE% NW14
of Section 20, Township 6 South, Range 93 West, of the
6th Princlpal Meridian, except for the Northerly 475 feet
of said strip of land, County of Garfield, State of Colorado.
Applicants understand that any misrepresentation of fact in this application
may subject the applicants to penalties for perjury.
