PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: For exemption from the Definition
of Subdivision
OWNER/APPLICANT: John R. and Ardeen L. Arbaney
LOCATION: A tract of land situated in Lot 12,
Section 35, T7S, R88W, located
approximately 1 1/2 miles east of
Carbondale, off of County Road 472
also known as 0112 Willow Lane.
SITE DATA: The site consists of a 6.75 acre
parcel.
WATER: Existing well
SEWER: Existing and Proposed Individual
Sewage Disposal System
ACCESS: Existing access drive
EXISTING ZONING: A/R/RD
ADJACENT ZONING: A/R/RD in all directions
I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in the Carbondale Urban Area of Influence as indicated
on the Garfield County Comprehensive Plan Management Districts Map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site is very level, with a single family
residence and related lawns and pasture. Adjacent land uses
include single family residence, pasture land, and the Carbondale
Rodeo Grounds.
B. Project Description: The applicants propose to divide the 6.75
acre parcel into two tracts of approximately 2.44 acres and 4.31
acres.
C. History: A smaller one acre parcel was split off the existing
tract in 1970 prior to Subdivision Regulations. An exemption
request in 1976 by D.L. and M.L. Kirkland proposing the same
division as the current request was denied by the Board of County
Commissioners. Problems with the water table, access, and land
use patterns were discussed.
III.MAJOR ISSUES AND CONCERNS
1. The applicants well permit was approved by the State Engineers
Office in 1967 for domestic use, and therefore can serve up to
three dewlling units. Each parcel should receive a deeded
interest in the existing well with easements for access and
maintenance of the well and waterlines shown on the exemption
plat.

2. Based on soils information submitted by the applicant, the site
is partially located in an area of high water table and severe
limitations on septic systems. As a result, plat notes should be
included on the Exemption Plat indicating that engineered
foundations and septic systems may be required.
3. Comments have been received from an adjacent property owner
objecting to the proposed split based on the increase in
population density and traffic. (See letter page ).
4. The site is located within an area referred to as Jack Sharp
Tracts. This area has been subdivided into numerous relatively
small parcels over many years. Garfield County has approved 15
exemptions and denied 2 exemptions within approximately a one
mile radius of the site.
5. Based on the density of the area, size of the proposed lots, and
concern regarding the high water table and the proliferation of
the septic systems, it is suggested that the proposed split be
the last allowed by exemption off the parcel. A plat note should
be added stating this fact.
IV. FINDINGS
1. That proper posting and public notice was provided as required
for the meeting before the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of
Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1. That the following plat notes be included on the exemption plat.
a) No further divisions by exemption from definition will be
allowed.
b) Engineered foundations and septic systems may be required.
c) That all irrigation ditch easements be recognized and
maintained as existing and in place.
2. That each parcel receive a deeded interest in the existing well
and that easements for all waterlines, and for access and
maintenance of the well be included on the exemption plat and in
any legal descriptions.
3. That all shares of irrigation water associated with the property
be divided proportionately between the two lots.
4. That $200.00 in School Impact fees for the creation of one new
lots be paid prior to final approval.
5. All representations of the applicant, either with the application
or stated at the hearing before the Board of County
Commissioners, shall be considered conditions of approval.

Gentlemen:
In regard to the John R. & Ardeen L. Arbaney property
situated in Lot 12, Section 15 T7S, R88W of the 6th P.M.
and the subdivision.
We are not in favor of any more subdividing in this
area. If we had wanted to live in a populated area
we would have chosen to live in town. Also we are not
in favor of the road easement going across our property
to become twice or three times as busy as it is now.

Dear Mark,
I have verbally reviewed, with Mike Dennis, the proposed
sub -division located at 0112 Willow Lane Carbondale,
Colorado, and owned by Jack Arbaney. I would like to
offer the following comments to you regarding fire protection
for this property.
Access to the existing property and structures is adequete
for fire trucks and ambulances.
Response time to the property is approximately 15 minutes.
Fire trucks and ambulance service will respond from the
Carbondale Fire Station.
Water for fire protection for single family houses on the
project will be provided by tanker trucks. The tanker
trucks will refill in Carbondale or at an available ditch.
