(1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September. 1, 1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under- signed Edward A. Armstrong respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution the division of 55 acre tract of land into 4 tracts of approximately 3-2 acre & 1-49 acr % cres each, more or less, and which tract to be subdivided is more particularly described as follows: (legal description - attach separate sheet if additional space is required) See attached legal. from the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County Subdivision Regulations, for the reasons stated below: This is a one time split to generate some income to assist in the economic operation of the ranch which isn't presently possible, while at the same time, providing a few needed home sites for the area. In support of this petition the petitioner also submits the following: (a) Map drawn to scale showing proposed lot subdivision and access. (b) Vicinity Map. (c) Statement on source of domestic water. (d) Statement on method of sewage disposal. (e) 100 year floodplain information where live stream crosses or adjoins said tract. KA EER Dear Mr. Witkowski: Please find enclosed herewith a completed petition for exemption for the formation of 3, 2 acre lots and 1, 49 acre lot on a 55 acre parcel located within the above referenced ranch that you recently spoke with Bob Saxe about. The map for the proposed subdivision and vicinity location is also enclosed. We propose to drill one well to furnish domestic water to the three, two acre parcels and potentially to the larger parcel also. We propose to handle the sewage with on-site disposal systems which will be constructed in compliance with the county regulations and be the responsibility of the purchaser of the lots. The proposed area does not fall within the 100 year floodplain. Should you have any questions concerning the above, please contact me or Bob Saxe at your convenience. KUIPER'' State En inee- Re: Armstrong, Richards and Rosgren, and Hackett Exemptions We have reviewed the material submitted concerning the above referenced applications for exemption. All three proposals are located on or near streams that are considered critical (over -appropriated) . As proposed, all the parcels will obtain water from individual wells drilled into tributary aquifers . Because these streams are critical, this office cannot issue permits for individual wells without a court approved plan for augmentation or change in point of diversion.
