PETITION FOR EXEMPTION
Pursusant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as
amended, and the Subdivision Regulations of Garfield County, Colorado,
adopted April 23, 1984 Section 2:20.49, the undersigned
Eva Baharav
respectfully petitions the Board
of County Commissioners of Garfield County, Colorado, to exempt by
Resolution the division of 8.33 acre tract of land into
2 tracts of
approximately 41_15 acres each, more or less, from the definitions of
"subdivision" and subdivided land" as the terms are used and defined in
C.R.S. (1973) Section 30-28-101 (10) (a) - (d) and the Garfield County
Subdivision Regulations for the reasons stated below:

SUBMITTAL REQUIREMENTS:
An application which satisfies the review criteria must be submitted with
all the following information.
A. Sketch map at a minimum scale of 1"=200' showing the legal
description of the property, dimension and area of all lots or
separate interests to be created,access to a
right-of-way, and any public
proposed easements for drainage,
irrigation, access or utilities;
B. Vicinity map at a minimum scale of 1"-2000' showing the general
topographic and geographic relation of the proposed exemption to
the surrounding area within two (2) miles, for which a copy of
U.S.G.S. quadrangle map may be used.
C. Copy of the deed showing ownership by the applicant, or a letter
from the property owner(s) if other than the applicant; and
D. Names and addresses of owners of record of land immediately
adjoining and within 200 feet of the proposed exemption, mineral
owners and lessees of mineral owners of record of the property to
be exempted, and tenants of any structure proposed for
conversion; and
E. Evidence of the soil types and characteristics of each type; and
F. Proof of legal and adequate source of domestic water for each lot
created, method of sewage disposal, and letter of approval of
fire protection plan from appropriate fire district; and
G. If connection to a community or municipal water or sewer system
is proposed, a letter from the governing body stating a
willingness to serve; and
H. Narrative explaining why exemption is being requested; and
I• It shall be demonstrated that the parcel existed as described on
January 1, 1973 or the parcel as it exists presently is one of
not more than three parcels created from a larger parcel as it
existed on January 1, 1973.
J. A $100.00 fee must be submitted with the application.

exemption on the property at 4910 County Road 103, Carbondale,
Colorado 81623. Also to submit an application for an "In -House"

Attached is a sketch map, adapted from the attached survey
dated 1977, showing the legal description of the property,
facilities of interest, and dimensions and areas of lots of
interest.
The yellow mark indicates the proposed division line creating
two separate lots to the north and to the south of the divide
line.
The pink mark outlines access by private road leading to the
property from CR 100. Attached is a copy of a letter to all
owners of that private road asking permission for an easement
to use that road.
In light blue is marked an alternative access road, which is
a continuation of the existing road which at present leads up
to the existing dwelling on the lot.

We are in the process of purchasing and subdividing the
Ferguson property (lot 034 on the rough draft below).
We would like to ask your permission for an easement
to use your present private road leading from Road 100.
As you may notice, the south subdivision of lot 034 would
be most conveniently accessed from your private road.
Naturally, the users of this road will share in road
maintenance to the point of the property
If you have any questions regarding this request, please
call us, collect, at (303) 963-9659. We are enclosing
a self addressed stamped envelope, which we would like
you to use to return your answer to our request. Please
be kind and check one of the two answer choices below,
and send it to us postmarked no later than Monday, April
10th, 1989. If we do not receive a response from you,
we will have to assume that your permission is granted,
but, of course we would much prefer an explicit answer.

Attached is evidence of soil types and characteristics of each
type obtained from the soil conservation service.

34--Empedrado loam, 2 to 6 percent slopes. This deep, well drained
soil is on terraces, fans, and upland hills. Included in this unit are small
areas of alluvium and eolian material. Elevation is 6,500 to 9,000 feet.
The average annual precipitation is 15 to 18 inches, the average annual air
temperature is 40 to 44 degrees F, and the average frost -free period is 75 to
95 days.
Typically, the surface layer is brown loam 5 inches thick. The subsoil
is clay loam 35 inches thick. The substratum to a depth of 60 inches or more
is clay loam. The soil is noncalcareous to a depth of 38 inches and
calcareous below that depth.
Included in this unit are small areas of similar soils with darker,
thicker surface layers. Also included are small areas of similar soils with
silt loam and silty clay loam textures. Included areas make up about 20
percent of the total acreage.
Permeability of the Empedrado soil is moderate. Available water capacity
is high. Effective rooting depth is 60 inches or more. Runoff is medium,
and the hazard of water erosion is slight.
This unit is used for hayland and cropland.
This unit is well suited to hay and pasture. Grasses and legumes grow
well if adequate fertilizer is used. If properly managed, this unit can
produce 5 tons of irrigated grass hay per acre.

The potential plant community on this unit is mainly western wheatgrass,
needleandthread, prairie junegrass, mountain big sagebrush, and Douglas
rabbitbrush. Other less numerous plants that characterize this site are
muttongrass, Letterman needlegrass, common snowberry, Utah serviceberry, and
antelope bitterbrush. The average annual production of air-dry vegetation is
about 1,500 pounds per acre. If the range condition deteriorates, mountain
big sagebrush, Kentucky bluegrass, Douglas rabbitbrush, and annual weeds
increase.
This unit is well suited to alfalfa and small grains crops. It has few
limitations. Maintaining crop residue on or near the surface reduces runoff,
reduces soil blowing, and helps to maintain soil tilth and organic matter
content. If properly managed, this unit can produce 90 bushels of barely per
acre.
This map unit is suited to homesite development. Shrink -swell potential
can be minimized by thoroughly prewetting foundation areas. The limitations
of moderate permability can be overcome by increasing the size of the
absoption field.
This map unit is in capability subclasses IVe, irrigated, and IVe,
nonirrigated. It is in the Deep Loam range site.

NOTE: The existing well yield of 10 gallons per minute (0.022
cubic feet of water per second of time) is awarded for domestic
household purposes in not more than three single family residences,
fire protection, livestock watering, and lawn and garden irrigation
of not more than one acre. (see supporting evidence highlight -
marked in copy of attached letter by a water referee).

WHEREAS, the parties hereto jointly own said well and
have agreed to share in the water produced therefrom and the
maintenance thereof.
NOW, THEREFORE, for and in consideration 'of the promises
and agreements herein contained, the parties hereto hereby
agree as follows, to -wit:
1. That both parties hereto acknowledge that the domestic
water well situate on Parcel No. 3 above described, together
with all pumps, pump houses, casing, and related facilities used
in connection therewith, is owned equally by the parties hereto.
2. That both parties hereto shall be entitled to an equal
amount of water from said water well and the water produced
therefrom shall be shared equally by the parties hereto; and
that the water right is owned equally by the parties hereto.
3. That the costs of operating said well and all maintenance
costs shall be shared equally by the parties hereto.
4. That the second parties shall have an easement for
the purposes of this agreement, for the location of said well
and for the water pipeline extending from said well to their
property as described in Exhibit A attached hereto and .incornorated
herein by reference, together with the right to maintain said
water line and well and repair and replace the same as may be
necessary. Said easement shall be an easement running with the
land appurtenant to their property above described.

Attached is a permit application form for an in-house well.
I am presenting this application form on behalf of John Ferguson
owner of the property on which the well is requested.
I am a prospective purchaser of the above-mentioned property,
for which an exemption petition for subdivision has been
submitted with Garfield County Commissioners.
There is an existing domestic well on this property, serving
one domestic unit on it, and another domestic unit on a neighboring
property (by easement).
Because of the ground water aquifer yield, use of water by a third
domestic unit planned on the divided tract, should the county approve,
would create a tremendous strain on the water yield.
Therefore, we are herewith applying for a permit to construct an
in-house only well for the projected third domestic unit on the
divided property, subdivided by exemption.

Reason why exemption is being requested:
My family is interested in buying the property in question
along with close friends, who would want to live on a
subdivision thereof and develop it into a well -kept domestic
unit.
This particular lot, being an elongated rectangle, lends itself
easily to a division into two almost equal lots, with the irrigation
ditch forming an almost natural boundary.
