I recall your telling us that we must submit to the Commissioners the conditions outlined in your letter to us within 100 days. I would herewith like to ask you for an extension of this period for the following reason: The family who will buy the divided lot will arrive here mid-August 1989. When they arrive we would all like to discuss together how to best divide this lot in consideration with its particular topography (a big ravine runs through, a little off the centerline). According to that decision, we would call the surveyor. We would much appreciate obtaining an extension on the above. Unfortunately, the process involved is taking much longer than anticipated, as it as it involves the Basalt Water Conservancy District, whose board members meet only once a month. I would therefore appreciate if the Garfield Commissioners would approve an extension for the time period originally given to satisfy the above— mentioned contingency requirements. May I ask for a thrre—month period to February 15th. 1990? (extension was granted to Feb. 15th, 1990). Attached is a letter copy from Scott Balcomb concerning water issues from which you can understand that we need more time before we can get approval for a well. I sincerely hope another extension be granted by the Garfield County Board of County Commissioners, as the development of the water issues are not only beyond my control, but also beyond public authorities. I deeply appreciate your cooperation and understanding in the matter. Ron Liston was also present. At that meeting, representing you and others similarly situated, I requested the Board of Directors to extend the District's service plan for providing "legal" water supply service into that portion of area B occupied by your property. There was extensive discussion about the merits of the District's decision to extend service into area B. The District's general counsel, Dan Kerst, recommended that the time was appropriate for such action. The District's engineer, Scott Fifer, had made a parallel recommendation although he was not present at the meeting. At the conclusion of the discussion, a motion was unanimously passed requesting the District's engineer to prepare a proposal to the Board to conduct such services as would be necessary to identify a temporary water supply plan within those areas in area B that are experiencing growth related developmental pressures. I believe the area in which your property is located will be either the first or second area to be studied in this study (assuming the Board commissions the study). While the Board's action of the 27th does not bind it to pursue the study once the proposal is received, I strongly believe that the proposal will be pursued. Several other "citizens" had made parallel requests. The Board is well aware that it is essentially situated so that it is logical to provide this service to its taxpaying inhabitants and no other entity exists that can accomplish the overall purpose. • • Eva Baharav November 30, 1989 Page 2 The Board is further aware that each landowner's alternatives are limited to the preparation and filing of an individual augmentation plan involving considerable legal and engineering expense and the opportunity for litigation with one's neighbors and other area water users. I believe with these thoughts in mind that the Board will proceed to commission the study and within a reasonable time (six to twelve months) a temporary water supply plan approval from the State Engineer's Office should be forthcoming. This is not to say that you do not have the opportunity in the meantime to prepare and file your own augmentation plan in the interest of providing "insurance" if the Board of Directors determines not to follow or vigorously pursue the acquisition of the temporary water supply plan indicated. However, unless you believe that the insurance" represented by taking the step of filing your own plan (although not vigorously pursuing it pending Board action) is warranted, I suggest that you would be wise to "wait and see" what the Board of Directors of the District does. In the meantime, I will "lobby" with the Board's engineer concerning the prioritization of the temporary water supply plan study areas. I was recently informed by S. Caloia, esq. from Leavenworth-Lochhead that according to the water statutes relevant to the area where our property is located, there may be approval for a well permit soon forthcoming. alternatively, I could purchase water shares from CLDC which is a process that may take up to three months. In view of this information, I would appreciate an extension of an additional 150 days for final approval of the subdivision.
