Water Division No. 5 on the 12 th day of July 1972

2. The name of the structure is The Bair Spring.
3. The legal. description of .tre:Structure. is: The spring is
• located in Tract 40, Section 15, T. 5 S., R. 87 W. of the
6th P.M. at a point whence Angle Point No. 7 of said
Tract 40 bears: N. 21°57' E. 788 feet.
4.. Means of diversion: The water is piped to the place
of use.
5. The date of initiation of appropriation is
June 1930.
6. The amount of water claimed is 0.067 cubic foot per
second of time.
7. The use of the water is domestic, stock water, fire
protection and lawn and garden irrigation.
8. The Priority date is June 30, 1930.
9. The date of the application was June 30, 1972.
It is the ruling of the Referee that the statements in
the application are true and that the above described water
right is approved and granted the indicated priority; subject,
however, to all earlier priorities of others.
It is accordingly ordered that this ruling shall became
effective upon filing with the Water Clerk, subject to Judicial
review as provided by law.

Dear Mr. Van Slyke:
Enclosed is an exemption request. As you can
see, the land owner proposes to use a spring and water
tank as a source of domestic water. However, I would
like to know if individual well permits can be issued
in this area, in the event that an adjudication or
decree of the spring has not been affected.
The exemption has been scheduled with the County
Commissioners on March 30, 1981. This office would
like your comments by that date.

Dear Mr. Bair:
On April 20, 1981, the County Commissioners passed a resolution
requiring a $200 per lot assessment for schools for all new lots
created through the Senate Bill 35 Subdivision Exemption process.
This is applicable to all new parcels created by exemption. The
requirement is applicable to all pending exemptions, as well as
all exemption requests initiated after the April 20, 1981 date.
You will therefore be required to submit $200 for every new lot
that was authorized by your currently pending exemption.

Re: J. Golden Bair Exemption
Dear Ms. Bowman:
We have reviewed the material submitted for the above referenced
exemption application. Although the springs would obtain water which
is tributary to the Colorado River, a new well permit could not be issued
on the 2 acres of land which is less than 35 acres, due to the winter
call at the Shoshone Power Plant. Should the proposed lot be enlarged to
35 acres, a well permit could be issued.

Fughes series

The Fughes series consists of deep, well drained soils on foot slopes and
mountainsides. These soils formed in colluvium. Slope is 6 to 25 percent.
Average annual precipitation is 16 to 17 inches, and average annual air
temperature is 44 to 46 degrees F.
These soils are fine, rnontmorillonitic Pachic Argiborolls.
Typical pedon of a Fughes stony loam is located in an area of
Fughes-Ironco complex, 6 to 12 percent slopes, about 2,300 feet south and
1,600 feet east of the northwest corner of sec. 22, , T. 4 S., R. 83 W.
A1-0 to 10 inches; very dark grayish brown (10YR 3/2) stony loam, very
dark brown (10YR 2/2) weak medium granular structure; slightly hard, very
friable, slightly sticky and slightly plastic; 0.1 percent stones, 3 percent
cobbles, and 5 percent gravel; neutral; clear smooth boundary.
81-10 to 16 inches; very dark grayish brown (10YR 3/2) clay loam, very
dark brown (10YR 2/2) moist; strong medium subangular blocky; hard, very
friable, slightly sticky and slightly plastic; few stones and cobbles... and 5
percent gravel; neutral; clear smooth boundary.
B21t--16 to 36 inches; reddish brown (5YR 5/4) clay loam, reddish brown
(5YR 4/4) moist; strong medium prismatic structure parting to strong medium
angular blocky; very hard, firm, very sticky and very plastic; few fine,
faint1light reddish brown mottles; few stones and cobbles and 5 percent
gravel; neutral; clear smooth boundary.

B22t--36 to 46 inches; reddish brown (5YR 5/3) clay, reddish brown (5Y1
4/4) moist; moderate medium angular blocky structure; very hard, firm, very
sticky and plastic; few, fine faint light reddish brown mottles; few stones
and cobbles; neutral; clear smooth boundary.
B3--46 to 60 inches; reddish brown (5YR 5/3) clay loam, reddish brown
(5YR 4/3) moist; )strong medium subangular blocky structure; very hard, firm,

sticky and pias ic; few fine, faint, light reddish brown mottles; neutral.
The mollis pipedon is 16 to 40 inches thick. 'lhe control section is 5
to 15 percent/
