Westerly right of way line of a County Road as constructed and in
place, said tract of land being described as follows:
Beginning at a point on the Westerly right of way line of said road,
whence the Northeast Corner of said Section 10 bears: N. 07°54'43"
E. 3962.37 feet; thence S. 00°27'23" W. 303.00 feet along the Wester
right of way line of said road; thence S. 05°50'49" W. 69.17 feet
along the Westerly right of way line of said road; thence S. 02°29'5
W. 73.92 feet along the Westerly right of way line of said road;
thence S. 82°44'43" W. 510.83 feet; thence N. 09°57'32" W. 517.96
feet; thence East 609.00 feet along the Southerly line of that certa
tract of land described in Doc. No. 239833 of the Garfield County
Records, to the point of beginning.

A tract of land situated in Lot 9 of Section 10, Township 6 South,
Range 92 West of the 6th P.M., lying Southeasterly of the South Chan
nel of the Colorado River and Westerly of the Westerly right of way
line of a county road as constructed and in use, more fully describe
as follows: Beginning at a point whence the Westerly right of way
line of said road intersects the Southerly line of the South Channel
of said river, whence the Northeast Corner of said Section 10 bears
N. 08°44'44" E. 3612.35 feet; thence S. 00°37'06" E. 354.32 feet alo
the Westerly right of way line of said road; thence West 609.00 feet
to a point on the Southerly line of the South Channel of said river;
thence N. 57°23'43" E. 369.90 feet along the Southerly line of the
South Channel of said river; thence N. 61°04'03" E. 101.00 feet alon
the Southerly line of the South Channel of said river; thence N. 61°
35'16" E. 114.47 feet along the Southerly line of the South Channel
of said river; thence N. 61°08'28" E. 116.57 feet along the Southerl
line of the South Channel of said river to a point on the Westerly
right of way line of said road, the point of beginning.
There is also hereby conveyed all of grantors' right, title and in-
terest in and to the Wigger Well and the 0.0198 c.f.s. adjudicated
thereto on May 29, 1974 by the District Court in and for Water Divi-
sion No. 5 in Case No. W-1161 and in and to the Wigger Pump Site and
the 0.36 c.f.s adjudicated thereto by said Court on May 29, 1974 in
Case No. W-1160.

PECITION FOR EXEMPTION-- Herbert M. & Nathalie Augsburger
SUPPORIIPJG SUBMISSIONS:
a) See attached map marked "a)" showing Parcels 1 & 2 and access from
County Road 311.
b) See vicinity map marked "b)" showing Parcels 1 & 2 drawn in red
on copy of Silt to Rifle I-70 EIS.
c) Domestic" water for existing dwelling on Parcel 2 is from a well
--see copy of Water Bight Case No, W-1161 marked "c)"; previous
owner, Mr. Wigger, claimed he could irrigate 24 hrs per day
continuously from this well; this well appears adequate for
also serving a dwelling on Parcel 1 or a well could be drilled
on Parcel 1 to avoid transporting domestic water several hundred
feet.
d) Sewage disposal for existing dwelling on Farcel2 is by septic tank
and disposal field which has performed satisfactorily during
petitioner's 2+ year ownership.
The land between the Rising Sun Ditch and the South boundary line
of Parcel 1 is above the High Water Table shown on the topo map
marked "e)" and should be suitable for a conventional septic tank
& disposal field.
e) The Army Corp of Engineers has not made a 100 year Flood Plain
Survey in this area:however, it appears from visual inspection
that the land South of the Rising Sun Ditch to the South boundary
of Parcel 1 (which could be a future building site) is both
farther above the river and the adjacent valley is wider than at
the River Bend development which petitioner understands is out
of the flood plain.

Re: Augsburger Exemption
We have reviewed the material submitted for the above referenced
application for exemption• The developer proposes to use wells for the
water supply which would intercept ground water tributary to the Colorado
River at a point where there is still water available for appropriation•
This office can issue individual domestic well permits to individual lot
purchasers and we recommend approval of the Augsburger Exemption•

Re: Resolution No. 79-22
On Friday, March 30, 1979, Herbert M. Augsburger and Nathalie
Augsburger conveyed tract A referred to in resolution no. 79-
22 to Donald R. Throm and Susan Steiger Throm, and by separate
deed of conveyance conveyed tract B to Donald R. Throm and
Susan Steiger Throm.
On March 30, 1979, Donald R. Throm and Susan Steiger Throm
conveyed tract A described in resolution no. 79-22 to Larry
Joe Keller.
The original of these deeds have been recorded March 30, 1979.
A copy of each of these three deeds is enclosed herewith.
The present owners of the tracts referred to in resolution no.
79-22 are now parcel A -Larry Joe Keller, and parcel B -Donald
R. Throm and Susan Steiger Throm, -joint tenants.
Mr. Ray Baldwin, the County Planner, advises me that he has
talked by telephone with the Department of Natural Resources
in Denver and that he has been advised that they see no rea-
son why a water well permit would not be issued. Accordingly,
it would appear that the present owner, Larry Joe Keller, can
obtain a water well permit upon proper application.
