The land between the Rising Sun Ditch and the South boundary line of Parcel 1 is above the High Water Table shown on the topo map marked "e)" and should be suitable for a conventional septic tank & disposal field. e) The Army Corp of Engineers has not made a 100 year Flood Plain Survey in this area:however, it appears from visual inspection that the land South of the Rising Sun Ditch to the South boundary of Parcel 1 (which could be a future building site) is both farther above the river and the adjacent valley is wider than at the River Bend development which petitioner understands is out of the flood plain. Augsburger and Nathalie Augsburger conveyed tract A referred to in resolution no. 79- 22 to Donald R. Throm and Susan Steiger Throm, and by separate deed of conveyance conveyed tract B to Donald R. Throm and Susan Steiger Throm. On March 30, 1979, Donald R. Throm and Susan Steiger Throm conveyed tract A described in resolution no. 79-22 to Larry Joe Keller. The original of these deeds have been recorded March 30, 1979. A copy of each of these three deeds is enclosed herewith. The present owners of the tracts referred to in resolution no. 79-22 are now parcel A -Larry Joe Keller, and parcel B -Donald R. Throm and Susan Steiger Throm, -joint tenants. Mr. Ray Baldwin, the County Planner, advises me that he has talked by telephone with the Department of Natural Resources in Denver and that he has been advised that they see no rea- son why a water well permit would not be issued.
