PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a)-(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
t972 and amended April 74,7975, Section 1.02.17 (d) and 3.02.01 the under-

Re: Baldwin Exemption
Dear Mr. Baldwin:
We have reviewed the above referenced exemption application.
The wells proposed as the water supply would intercept ground water which
is tributary to Elk Creek, an over-appropriated stream. Since new wells
would cause injury to senior vested water rights, well permits cannot be
issued by this office and we cannot recommend approval of the Baldwin
Exernption.
We would suggest that you evaluate the point where the wells would
deplete Elk Creek using local geology if available.. If the point of depletion
is below the headgate of the lowest ditch in Elk Creek, it may be possible
to issue well permits .

Based on the information received by this office and past experience with
sewage disposal facilities in the immediate area of the proposed exemption, it
has been determined by this office on-'lot sewage disposal facilities are bothfeasible and practica'1, commensurate with both County and State regulations,provided proper permits are obtained prior to construction.
It shou'ld be further noted that due to the known conditions, only the fo1low-ing types of on-'lot sewage disposal systems would be acceptable:
