Box 980 Glenwood Springs, CO 81602 RE: Subdivision Exemption Conditions of Approval Dear Mr. Balcomb: On Jrrne L2,1995, the Board of County Commissioners conditionally approved Rue Balcomb and Bruce Arbaney's request for a subdivision exemption. The approval was subject to the frling of an exemption plat and completion of the following conditions: All representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions olapproval. A Final Exemption Plat shall be submitted, indicating the legal description of the property, dimension and area of the proposed lot, a corlmon arcess point and easement to lots I and 3 to a public right-of-way, and any proposed easements for setbacks, drainage, irrigation ditches, acc€ss or utilities and the following plat notes: A. All construction shall be consistent with Colorado State Forest Service wildhre prevention guidelines specihed in the pamphlet 'Wildfire Protection in Wildland Urban Interface" (C.S.F.S. #143-691). B. Any ISD system built on a slope in excess of l2o/,may have to be engineered due to soils constraints. C The area is subject to debris flow and rolling rocks, particularly in areas within and adjacent to ravines. D. Extensions of 120 days may be granted by the Board for a period of up to one (l) year. 5 4 The applicant shall submit $200 in School Impact Fees lor the creation of each new lot. A favorable response lrom the State Engineers's Oflice must be received prior to the signing of anexemption plat, that indicates that the proposed and existing wells and ditch can e used legally and will provide an adequate amount olwater. Also, prior to signing of a plat, any new wells approved shall be drilled and have a pump test done on the wells showing a 5 gpm flow rate for a24 hr. period. If a 5 gpm flow rate cannot be achieved, aplat rate will be required noting lhata2450 gallon storage tank will be required to in place prior to any certificate of oocupancy is issued for a new residential structure. 6. Control of noxious weeds is the responsibility of the property owner. That a favorable response from the appropriate Fire Protection District must be received prior to the signing of an exemption plat or a petition lor annexation to the district be presented prior to the signing a plat. Driveway permits from Road and Bridge must be received prior to signing of an exerrption plat. Driveway access shall be shared between I and 3. The applicant's suryeyor must certify that lots 1, 3, and 4 each have at least one (l) contiguous acre of land with slopes less than 40 %. 7 8 9 Easements for access and maintenance o[ any shared well 20 ft. square around the well, wit 10 ft. wide easements for access and maintenance lor the lines to the well, shall be shown on the plat. Additionally, a well ownership, maintenance and repair agreement will be filed in the Clerk and Recorders Offrce at the same time a plat is recorded.
