Raymond Baran Baran and Darlene A tract of land situated in the NWL/4 Nw L/4 and sw L/4 Nw 1/4 of Section L7, T7S, R87W; locatedapproximately 8 miles northeast of Carbondale at 0746 County Rd. L70. RELATIONSHIP TO THE COII{PREHENSIVE PLAN The proposed lot is located in District B, Subdivisions RuralServiceable Areas L/2 to 1 mile radius, I{inor EnvironmentalConstraints as designated on the Comprehensive PIan lilanagementDistrict Map. rI. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with adjacent land uses primarily single familyresidential, agricultural, and open space. Slopes on the siteare moderate with improvements including one single familydwelling. B. Project Description: The applicant proposes to divide the 5.89acre parcel into two tracts of 2 acres and 4.89 acres in sizewith the larger tract containing the existing improvements. (Seeattached map; page 6 1 C. History: The existing parcel is one of three lots created bySubdivision Exemption approved by Resolution 77-8L, in 1977. Deeds submitted by the applicant have established that no othersplits have occurred since January Lt L973, and that oneremaining split by subdivision exemption is possible, inaccordance with Section 8252 of the Subdivision Regulations. III.II{AJOR ISSUES AND CONCERNS L. The applicant has represented that an additional weII permitr orauthorization to share the existing well, will be obtained fromthe State Division of Water Resources. Documentation of theirapprovals, or authorization, should be required. 2. Soil Conservation Service information on the site indicated thatthe soils are poorly suited to homesite development due to largestones and steep slopes. t- a The applicant shouLd clarify whether the County Road and Bridge Department's existing access permit includes the proposed accessfor the new lot. Several exemptions have been granted in the vicinity of the site and one major subdivision, Panorama Ranches, approved to the east. These subdivision approvals have created many single family residential lots generally 4 to 10 acres in size. Comments from adjacent property page 7* f, 1 owners are attached. (See o 3 4 5. IV. SUGGESTED FINDINGS 1 That proper posting and public notice was provided as required by Iaw for the meeting before the Board of County Commissioners. 2 That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at that meeti-ng. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens ofGarfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the Exemption PIat: That engineered foundations and individual sewage disposal systems may be required. 3 A B definition of 2 That the applicant submit evidence of a domestic water source forthe proposed 2 acre tract, consisting of an additional wellpermitr or other verification acceptable to the Board of CountyCommissioners. Should a shared domestic well be approved by theState Division of Water Resources, easements for access to and maintenance of the well shall be included on the exemption p1at. That the applicant submit $200 per lot in School Impact Fees for the creation of one new lot. That the applicant shall verify that the existing permit from theGarfield County Road and Bridge Department approves access toboth lots. That an access easement to the 4.89 acre tract be included on theexemption plat. That all representations of the applicant, either within theapplication or stated at the meeting before the Board of CountyCommissioners, shall be considered conditions of approval.
