BEFORE THE BOARD OF COUNTY COMMISSIONERS
GARFIELD COUNTY, COLORADO
Pursuant to C.R.S. (1973) §30 -28 -101(10)(a) -(d), as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984, as amended
February 19, 1997, §8:00, the undersigned, SAM AZEEZ, respectfully petitions the Board
of County Commissioners of Garfield County, Colorado to exempt by Resolution, the
division of a 42 acre tract of land into four tracts of land, three of which will be
approximately 10.0 acres, and one of which will be approximately 12.0 acres, more or less,
from the definitions of "Subdivision" and "Subdivided Land," as the terms are used and
defined in C.R.S. (1973) §30 -28 -101(10)(a) -(d), and the Garfield County Subdivision
Regulations for the reasons stated below:
1. The 42 acre tract which is the subject of this Petition is owned by the
Petitioner, Sam Azeez (See copies of deeds submitted herewith).
2. The land is currently unoccupied and undeveloped. Petitioner wishes
to develop the land for residential use and sell the four parcels as described above.
3. Any improvements to be erected on the proposed parcels can be served
by individual wells and individual septic systems. Petitioner has applied for well permits
from the State of Colorado Engineer's office for the domestic water supply and to West
Divide Water Conservancy District for a water allotment contract to cover these wells. (See
attached well permits.)
4. Access to the property to be divided is from 210 Road and from a
proposed road as shown on the submitted sketch plan.
5. Copies of the deeds in the Petitioner's chain of title from January 1,
1973 through the present are submitted herewith, demonstrating that the Petitioner's 40 acre
tract, as it exists presently, is one of not more than three (3) parcels created from a larger
parcel as it existed on January 1, 1973.
6. In further support of this Petition, the following are submitted herewith:
a. Proposed sketch plan, including vicinity map.
b. Schedule of names and addresses of owners of record of lands
within 200 feet of the proposed exemption, and mineral owners of record of the
property.

c. Soil types and characteristics from USDA Soil Conservation
d. Copy of letter to Rifle Fire Protection District.
e. Three Hundred Dollar ($300.00) application fee.
WHEREFORE, the undersigned requests that the Garfield County Board of
Commissioners approve the subdivision exemption.

the contracts carefully if you have not already done so, but please
especially note paragraph 2 concerning availability of water.
West Divide obtains its storage water from a number of sources
including Ruedi Reservoir and Green Mountain Reservoir which are
Bureau of Reclamation projects. Federal policy relating to
endangered species, among other environmental concerns, provides
that supplies from these reservoirs may be interruptible.
Moreover, the forces of nature are always such that no source of
water can be guaranteed from year to year. West Divide continues
to make good -faith efforts to obtain alternative long-term supplies
in an effort to make reliable and predictable the water supply
anticipated by your contract with us.
These water allotment contracts may require you to obtain well
permits from the State Engineer's office. Once the well is drilled
you are required to install a measuring device and submit a meter
reading to West Divide. You will be provided with a special form
for this purpose upon notification that your well has been drilled.

Non-compliance with measuring and reporting requirements are
grounds for cancellation of your water allotment contract with West
Divide. This could result in action by the State Engineer which
could prevent your further use of your well.

The Rifle Fire Protection District has reviewed Mr. Azeez's request for
subdivision exemption. It is the District's understanding that the
proposal is to divide one parcel of land approximately 42 acres in size
into four separate parcels for construction of single family dwelling units.
The subject area is within the boundaries of the Rifle Fire Protection
District and fire protection and emergency medical services will be
provided by the District. In order to better assist the District in the
providing of these services, the District would make the following
recommendations:
1. Defensible space: Vegetation should be removed from near any
structures on the property in order to provide a safe zone in the event of a
wild land fire.
2. Road construction: When constructing the access roadway into the
property, consideration should be given to the weights of fire apparatus
and accessibility during adverse weather conditions.
3. Posting of the address: The address of the property is to be posted
where the shared driveway intersects with the County Road for each
parcel. In addition, the address for each individual parcel is to be posted
in a readily identifiable area where the individual driveways intersect
with the shared driveway. Letters are to be a minimum of 4 inches in
height, 1/2 inch in width and contrast with background colors.
4. Water supply: Efforts should be made to provide for fire protection
water for the dwellings being constructed. The District's ability to
suppress a fire in the proposed dwellings would be severly hampered by
the amount of water currently available in the area.

as an alternate point of diversion to the Avalanche Canal and Siphon, on the condition that the well shall be operated only when

a water allotment contract between the well owner and the West Divide Water Conservancy District for the release of replacement

irrigation of not more than 6,000 square feet (0.14 of an acre) of home gardens and lawns, and the watering of domestic animals.

on a 10 acre tract described as lot 4 of the Azeez (Garfield County) Exemption.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The annual of amount of ground water to be appropriated shall not exceed one (1) acre-foot (325,850 gallons).
7) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions
must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
8) The well shall be constructed not more than 200 feet from the location specified on this permit.
9) The owner shall mark the well in a conspicuous place with well permit number(s), and court case number(s) as appropriate. The
owner shall take necessary means and precautions to preserve these markings.

7) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions
must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
8) The well shall be constructed not more than 200 feet from the location specified on this permit.
9) The owner shall mark the well in a conspicuous place with well permit number(s), and court case number(s) as appropriate. The
owner shall take necessary means and precautions to preserve these markings.
