Monday , the 26th day of July A. D. 19 82 , there were present: Flaven Ceris e Commissioner Chairman Eugene Drinkhouse ,� Commissioner Larry Velasquez Commissioner Earl Rhodes Leanne Cleland, Deputy CountyClerk of Attorney of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 82-183 A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FRO AWR SHEEP COMPANY. WHEREAS,-AWR Sheep Company has' petitioned the Board of County Commissioners of .Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S::1973, 30-28-101 (10) (a)) -(d), as amended, and the Subdivision Regulations of Garfield County, Color.adc adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 659 acre tract described as follows: that parcel of land as described in Book 573, Page 445 as filed in the Office of the Clerk and Recorder of Garfield County, Colorado into 2 tracts of 5 and 654 acres each, more or less, which proposed divided tract is more particularly described as follows: TRACT A: A tract- of land situated in the South half of Section 27, Township 5 South, Range 92 West of the 6th Principal Meridian, described as follows, to -wit: Beginning .at a point whence the Southwest corner of Section 27, Township 5 South, Range 95 West of the 6th Principal Meridian in Garfield County, Colorado bears 5.65°52'01"W. 2,140.21 feet; thence N.8°04'30"E. 150.00 feet;thence 5.89°19'14"E. 1,485.31 feet; thence S.22°40'46"W. 160.43 feet; thence N.89°19'14"W. 1,444.52 feet to the point of beginning; said tract containing 5.002 acres, more or less. Together with a thirty foot wide easement for ingress and egress lying fifteen feet either side of the, following described centerline: Begin- ning at a point on the western line of said 5.02 acre tract, whence the Southwest corner of Section 27, Township 5 South, Range 95 West of the 6th Principal Meridian, Garfield County, Colorado bears S.8°04`30 "W. 59.93 feet and S.65°52'01"W..2140.21 feet; thence along said center- line the following eighteen courses: N.86°26'52"W._ 173.66 feet; thence _along a curve to. the lef t:having:a,central angle of 40°54'18",. a radius of 120.00 feet, an arc length of 85.67 feet and of which the chord bears S.73°05'59"W. 83.86 feet; thence S.52°38'50"W: 70.06 feet thence along a curve to the left having a central angle of 30°18'04", a radius of 100.00 feet, an arc length of 52.89 feet and of which the chord bears S.37°29'48"W., 52.27 feet; thence S.22°20'49"W. 464,25feet;.thence along a curve to the right having a central - angle of 43°02'25" a radius of 130.00 feet, an arc length of 97.66 feet and of which the chord bears S.43°52'02"W. 95.38 feet; thence S.65°23'14"W. 394.42 feet; thence along_a curve to the left having a central angle of 14°09'04", a radius of 580.00 feet, an arc length of 143.25 feet and of which the chord bears S.58°18'42"W. 142.89 feet; thence S.51°14'10"W. 186.48 feet; thence along a curve to the right having a central angle of 41°21'55", a radius of 100.00 feet, an arc length of 72.20 feet and of which the chord bears S.71°55'08"W. 70.64 feet; thence N.87°23'55 "W. 137.19 feet; thence along a curve to the left having a central angle Of 7°25'18", a radius of 390.24 feet, an arc length of 50.55 feet and of which the chord bears S.•88° 53'26"W. 50.51 feet; thence S.85°10'47"W. 39.69 feet; thence along a curve to the right having a central angle of 9°33'40", a radius of 600.0 feet, an arc length of 100.12 feet and of which the chord bears S.89°57'37"W. 100.01 feet; thence N.85°15'33"W. 150.72 feet; thence along a curve to the right having a central angle of 7°41'54", a radius of 800.00 feet, an arc length of 107.49 feet and of which the chord bears N.81°24'36 "W. 107.41 feet; thence N.77°33'39"W. 20.94 feet; thence along a curve to the left having a central angle of. 102°35'20", a radius of 66.79 feet, an arc length of 119.59 feet and of which the chord bears S.51°08'41"W. 104.24 feet to the point of termination on existing County Road No. 259 whence the Northeast corner of said Section 33 bears N.01°01'14"W. 69.92 feat. TRACT B: The remaining 654 acres. MlfK 605 PriE672 (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioners have deomnstrated to'the satisfaction of the Board of County Commissioners of Garfiela County, Colorado, that the proposed division does not'fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created does not warrant further subdivision review, and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability.. of locating domestic water on each of said tracts, that there is ade- quate ingress and egress to said tracts, that the iocation of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of"the-above-described tracts "A" and "B" from the above described 659 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A" and "B", all as.is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid_subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioners that no further exemptions be allowed on said tract ttA", and that a copyof the instrument or instruments of conveyance when recorded shall ,be filed with this Resolution.
