We have reviewed the above referenced application for exemption.
The wells proposed as the water supply would intercept ground water which
is tributary to East Elk Creek, an over -appropriated stream. Since new
wells could cause injury to senior vested water rights, a well permit cannot
be issued by this office for the 24 -acre tract and we cannot recommend
approval of Barry Exemption. However, if each of the two lots were 35
acres in size, exempt household use only well permits could be issued.
