pETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984 Section 2:20.49,
the undersigned a r, r '` A ill respectfully petitions
the Board of County Commissioners of Garfield County, Colorado, to exempt by Resolution

"subdivided land" as the terms are used and defined in C.R.S. (1973) Section 30-28-101(10) (a)
- (d) and the Garfield County Subdivision Regulations for the reasons stated below:

SUBMITTAL REQUIREMENTS:
An application which satisfies the review criteria must be submitted with all the following
information:
A. Sketch map at a minimum scale of 1"=200' showing the legal description of the
property, dimension and area of all lots or separate interests to be created, access
to a public right-of-way, and any proposed easements for drainage, irrigation,
access or utilities;
B. Vicinity map at a minimum scale of 1"=2000' showing the general topographic
and geographic relation of the proposed exemption to the surrounding area
within two (2) miles, for which a copy of U.S.G.S. quadrangle map may be used.
C. Copy of the deed showing ownership by the applicant, or a letter from the
property owner(s) if other than the applicant; and
D. Names and addresses of owners of record of land immediately adjoining and
within 200 feet of the proposed exemption, mineral owners and lessees ofmineral
owners of record of the property to be exempted, and tenants of any structure
proposed for conversion; and
Evidence of the soil types and characteristics of each type; and
F. Proof of legal and adequate source of domestic water for each lot created,
method of sewage disposal, and letter of approval of fire protection plan from
appropriate fire district; and
G. If connection to a community of municipal water or sewer system is proposed,
a letter from the governing body stating a willingness to serve; and
H. Narrative explaining' why exemption is being requested; and
I. It shall be demonstrated that the parcel existed as described on January 1, 1973
or the parcel as it exists presently is one of not more than three parcels created
from a larger parcel as it existed on January 1, 1973. '
J. A $300.00 fee must be submitted with the application.

CONDITIONS OF APPROVAL
This well shall be used in such a way as to cause
no material injury to existing water rights. The
issuance of the permit does not assure the applicant
that no injury will occur to another vested water

ILDEFONSO STONY LOAM, 25 TO 45 PERCENT SLOPES This
deep, well -drained soil is on mesas, benches, and sides
of valleys- This soil formed in mixed alluvium derived
primarily from basalt. The surface layer is stony loam
about 8 inches thick. The underlying material Is very
strongly calcareous very atony loam to a depth of 68
inches. Permeability is moderately rapid, and
available water capacity is low. Effective rooting
depth is more than 60 inches. Runoff Is rapid, and the
erosion hazard is high-
POTT3-ILDEFONSO COMPLEX. 3 TO 12 PERCENT SLOPES These
soils are on mesas and sides of valleys. The Potts
soil formed in alluvium derived from sandstone, shale,
or basalt' The [ldefmnso soil formed in very strongly
calcareous, basaltic alluvium and small amounts of
eoJ,ao material. Potts soil makes up about 60 percent
of the map unit, and the Ildefonso soil makes up about
30 percent'
Potts consists of deep, well -drained soils. The
surface layer is sandy loam about 4 inches thick' The
subsoil is loam or clay loam and about 20 Inches thick.
The substratum is loam that extends to a depth of 60
inches or morePotts soils have moderate permeability
and a high available water capacity- Roots can
penetrate to a depth of more than 60 inches- Runoff is
.stow to medium. Hazard of erosion is moderate to high'
Ildefonso consists of deep` well -drained soils. The
surface layer is cobbly sandy loam about 5 inches
thick. The un`|eriyinq lavers are oobbly sandy loam and
very cobbly sandy loam that extend to a depth of 60
inches or more. Ildefunoo soils have rapid
permeability and u low available water capacity. Roots
can penetrate to a depth of more than 60 Inches.
Runoff is medium, Hazard of water erosion is moderate'

CONDf1lONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) for the construction of a well, appropriating ground water tributary to the
Colorado River, as an alternate point of diversion to the Avalanche Canal and Siphon, on the condition that the
well be operated only when the West Divide Water Conservancy District's substitute water supply plan, approved
by the State Engineer, is in effect and when a water allotment contract between the well owner and the West Divide
Water Conservancy District for the release of replacement water from Ruedi Reservoir is in effect, or under an
_approved plan for augmentation. WDWCD contract # 950911GB2(a).
4) The use of ground water from this well is limited to ordinary household purposes inside one (1) single family
dwelling, the irrigation of not more than 12,000 square feet (0.28 of an acre) of home gardens and lawns, and the
watering of domestic animals. All use of this well will be curtailed unless the water allotment contract or a plan
for augmentation is in effect.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The average annual of amount of ground water to be appropriated shall not exceed one (1) acre-foot (325,850
gallons),
7) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records
of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division
Engineer upon request.
8) The well shall be constructed not more than 200 feet from the location specified on this permit.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court
case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these
