SITE DATA: 10.23 acres WATER: Well SEWER: I.S.D.S. ACCESS: County Road 261 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD L RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in District B - Minor Environmental Constraints - as shown on the Garfield County Comprehensive Plan Management Districts Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The subject parcel is north of the Town of Silt, on the west side of County Road 261, east of Panorama Mesa Minor Subdivision. The property includes a single-family house located on the northeast corner of the property. The bal• nce of the property is in native vegetation. A vicinit map is shown on page at . An improvement survey is shown on page 6 4. . B. Request: The applicant is requesting to split the 10.23 acre parcel into three parcels of approximately 5.24, 2.78 and 2.21 acres in size. Individual wells and septic tanks would be used to serve each parcel. Access to the lots would be directly from CR 261. A sketch plan of the exemption lots is shown on page 6 . III. MAJOR ISSUES AND CONCERNS 1. Section 8:10 (Applicability -Exemptions) states that the Board has discretionary authority to except a division of land from the definition of subdivision. Following a review of the facts of each application, the Board may approve conditionally or deny an exemption request. The Board may not grant an exemption unless the applicant can demonstrate compliance with zoning, legal access, adequate water and sewer, state environmental health standards, necessary road and drainage improvements, fire protection, adequate easements and school impact fees. 2. Exemption Criteria. Section 8:10, states that the Board may approve a total of four (4) lots parcels, interests or dwelling units, as that parcel was described in the records of the Garfield County Clerk and Recorder's office on January 1, 1973. The applicant has submitted a deed that describes the property on October 17th, 1972 (Book 427 Page 284). Therefore, the applicant does qualify for the exemption process. 3. Water and Sewer. The applicant has made application to the State Engineer's Office for additional well permits. The well applications indicate that the wells will not allow any outside irrigation. Staff referred the application, but has not rcieved a formal response. Staff suggests that a favorable response be recieved from the Engineer's Office prior to the signing of an exemption plat. Sewage disposal will be handled by ISDS. Predominate soils on the site according to SCS/Natural Resources Conservation Service include Potts (#57) and Ildefonso (#34). The majority of the site proposed for new dwelling units includes the Potts complex, which has only slight constraints for ISDS, and dwellings with basements. No plat notes are necessary. 4. Natural Hazards. The site is not identified as have soil, slope or ISDS constraints by the Lincoln-Devore Hazards Mapping. Therefore, no plat notes or conditions of approval are necessary. IV. SUGGESTED FINDINGS 1. The proposal is in general compliance with the Garfield County Comprehensive Plan and the Garfield County Zoning Regulations. 2. The proposed land use would be consistent and compatible with the existing surrounding land uses. 3. The proposal is in best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, subject to the following conditions: 1. All representations of the applicant shall be considered conditions of approval unless otherwise stated by the applicant. 2. The applicant shall have 120 days to complete the required conditions of approval. Extensions of 120 days may be granted by the Board for a period of up to one (1) year. 3. The applicant shall submit $200 in School Impact Fees, prior to the signing of an exemption plat. 4. A final exemption plat will be submitted, indicating the legal description of the property, dimension and area of all proposed lots or separate interests to be created, access to a public right-of-way, and any proposed easements for drainage, irrigation, access and utilities. 5. A driveway permit, if necessary, shall be obtained from the Road and Bridge Department prior to signing of a final plat. 6. Control of noxious weeds is the responsibility of the property owner. 7. USFS Wildfire Protection Guidelines shall be followed for all structures. 8. Easements for the use and maintenance of the existing ditches, if necessary, shall be shown on the final plat. 9. The following plat note shall be shown on the final exemption plat: "Well permits for Lots #_ and #_ are household use only.
