PETITION FOR E)GMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted April 23, 1984, the
undersigned respectfully petitions the Board of County
Commissioners of Garfield County,to exempt by Resolution the division of
acre tract of land into tracts of
acres each, more or less, from the definitions
of "zubdivision" and "subdMded land" as the terms are used and defined in C.R.S. (1973) Section 30-
28-l0l (10) (a) - (d) and the Garfield County Subdivision Regulations for the reasons stated below:
ST.IBMITTAL REQUIREMENT S :
An application which satisfied the review criteria must be submitted with all the following
information:
A. Sketch map at a minimum scale of 1":200' showing the legal description of the
property, dimension and area of all lots or separate interests to be created, access to
a public right-of-way, and any proposed easements for drainage, irrigation, access or
utilities; and
B. Vicinity map at a minimum scale of l":2000'showing the general topographic and
geographic relation of the proposed exemption to the surrounding area within two (2)
miles, for which a copy of U.S.G.S. quadrangle map may be used; and
C. Copy of the deed showing ownership by the applicant, or a letter from the property
owner(s) if other than the applicant; and
D. Names and addresses of owners of record of land immediately adjoining and within
200 feet of the proposed exemption, mineral owners and lessees of minerals owners
of record of the property to be exempted, and tenants of any structure proposed for
conversion; and
E. Evidence of the soil types and characteristics of each type, and
F. Proof of legal and adequate source of domestic water for each lot created, method of
sewage disposal, and letter of approval of fire protection plan from appropriate fire
district; and
G. If connection to a community or municipal water or sewer system is proposed, a letter
from the governing body stating a willingness to serve, and
H. Narrative explaining why exemption is being requested; and

It shall be demonstrated that the parcel existed as described on January 1,1973 or the
parcel as it exists presantly is one of not more than three parcels created from a larger
parcel as it existed on January l, 1973 .
A $300 00 fee must be submitted with the application.

APPLICABILITY
The Board of County Commissioners has the discretionary power to exempt a division of land from
the definition of zubdMsion and thereby from the procedure in these Regulations, provided the Board
determines that such exemption will not impair or defeat the stated purpose of the Subdivision
Regulations nor be detrimental to the general public welfare. The Board shall make exemption
decisions in accordance with the requirements of these regulations. Following a review of the
individuat facts of each application in light of the requirements of these Regulations, the Board may
approve, conditionally approve or deny an exemption. An application for exemption must satisfy, at
a minimum, all of the review criteria listed below. Compliance with the review criteria, however,
does not ensure exemption. The Board also may consider additional factors listed in Section 8:60
of the Subdivision Regulations.

A,No more than a total of four (4) Iots, parcels, interests or dwelling units will be created
from any parcel, as that parcel was described in the records of the Garfield County Clerk
and Recorder's Office on January l, 1973. In order to qualify for exemption, the parcel as
it existed on January l, 1973, must have been 35 acres or greater in size at that time and
not a part of a recorded subdivision; however, any parcel to be divided by exemption that
is split by a public right-of-way (State or Federal highway, County road or railroad),
preventing joint use of the proposed tracts, and the division occurs along the public right-of:
way, such parcels thereby created may, at the discretion of the Board, not be considered to
have been created by exemption with regard to the four (4) lot, parcel, interest or dwelling
unit limitation otherwise applicable. For the purposes of definition, all tracts of land 35 acres
or greater in size, created after January l, 1973 will count as parcels of land created by
exemption since January l, 1973.

West Divirle obtains its sorage water from&numbe( ofsotuces including Ruedi Reservoir and Green
Mountain Rerrvoir which are Burcau of Reclarnation proj'ects. Fcderal policy relating to endangcred
species, arnoilg othpr environmental concerns, provides that supplies &om these reservoirs may be
interruptible, Moreovcr, the forces of nature ore always such that no source of water can be
guaranteed tomyear to year. West Divide contiruEs to nske good-faith efforts to obtain alternative
long-term.supplies in an effort to make retiable and predictable the water supp$ anticipated by your
contraot with us.
These water allotment contracts may require you to obtain well permits liom the State Engineer's
office. Once u wcll is drillcd you are required to install a measuring device and subrnit a mcter
reading to Wcst Divide. You will be provided with a special tbrm for this purpose upon notilication
that your well has been drilled.
Non-compliancc with measuring and reprting rcquirenrents are gounds for cancellation ofyour
water allotment contract with West Divide. This could result in action by the State Engineer which
could prevent your further use of yorrr well.

Dear Mr. & Mrs. BagleY:
On November 27,2000 the Board of County Commissioners conditionally approved your request for an
Exemption fromthe Definition of Subdivision., subject to the filing of an exemption plat and completion
of the following conditions:
1. That all representations of the applicant, either within the application or stated at the
meeting before the Board of Cotrnty Commissioners, shall be considered conditions of
apProval.
Z. An Exemption Plat shall be submitted, indicating the legal description of the property,
dimension and area of the proposed lots, 25 ft. wide access to a public right-of-way for
each lot, and any proposed easements for setbacks, drainage, irrigation, access or utilities.
Access to lots 1 and 3 will be via an access easement off of CR 260, as proposed by the
applicant. The access from CR 260 may be changed, if the applicant enters into Road
Maintenance agreement with all of the Antlers Orchard Development property owners
living south of the property, prior to the approval of the exemption plat.
3. That the applicant shall have 120 days to present a plat to the Commissioners for
signature, from the date of approval of the exemption. The Board may grant extensions
of up to one (1) year from the original date of approval, provided the applicant submits
a request for an extension prior to the approval expiration date.
That the applicant shall submit $200.00, per lot, in School Site Acquisition Fees for the
creation of all exemption parcels.
5. That the following plat notes be included:
"Control of noxious weeds is the responsibility of the ploperty owner."

"One (l) dog will be allowed for each residential unit within a subdivision and the dog
shall be required to be confined within the owners property boundaries."
"No open hearth solid-fuel fireplaces will be allowed anywhere within an exemption.
One (1) new solid-fuel burning stove as defied by C.R.S. 25-7-401, et. seq., and the
regulations promulgated theretrnder, will be allowed in any dwelling unit. All dwelling
units will be allowed an unrestricted number of natural gas buming stoves and
appliances".
"All exterior lighting be the minimum amount necessary and that all exterior lighting be
directed inward, towards the interior of the subdivision, except that provisions may be
made to allow for safety lighting that goes beyond the property boundaries".
"Colorado is a "Right-to-Farm" State pursuant to C.R.S. 35-3-101, et seq. Landowners,
residents and visitors must be prepared to accept the activities, sights, sounds and smells
of Garfield County's agricultural operations as a normal and necessary aspect of living in
a Cotrnty with a strong rural character and a healthy ranching sector. Those with an urban
sensitivity may perceive such activities, sights, sounds and smells only as inconvenience,
eyesore, noise and odor. However, State law and County policy provide that ranching,
farming or other agricultural activities and operations within Garfield County shall not
be considered to be nuisances so long as operated in conformance with the law and in a
non-negligent manner. Therefore, all must be prepared to encounter noises, odor, lights,
mud, dust, smoke chemicals, machinery on public roads, livestock on public roads,
storage and disposal of manure, and the application by spraying or otherwise of chemical
fertilizers, soil amendments, herbicides, and pesticides, any one or more of which may
naturally occur as a part ofa legal and non-negligent agricultural operations.
In addition, all owners of land, whether ranch or residence, have obligations under State
law and County regulations with regard to the maintenance of fences and irrigation
ditches, controlling weeds, keeping livestock and pets under control, using property in
accordance with zoning, and other aspects of using and maintaining property. Residents
and landowners are encouraged to leam about these rights and responsibilities and act as
good neighbors and citizens of the County. A good introductory source for such
information is "A Guide to Rural Living & Small Scale Agriculture" put out by the
Colorado State University Extension Office in Garfield County."
"Specific geological hazards may be encotrntered during the placement of structures and
septic systems. Site specific analysis for placement may be required."
The applicant shall receive any necessary driveway permits, for each lot created, from the
County Road and Bridge Department, prior to signing of an exemption plat.

That the applicant demonstate that an adequate supply in both quantity and quality exists
for the lots to be created. Criteria for demonstrating the quality, quantity and
dependability of each well :
a) A well be drilled anda4 hour pump test shall be performed;
b) The applicant supply, to the Planning Department, the well completion report
demonstrating the depth ofthe well, the characteristics ofthe aquifer and the static
water level;
c) The results of the 4 hour pump test indicating the pumping rate in gallons per
minute and information showing drawdown and recharge shall be submitted to the
Planning Department;
d) A written opinion of the person conducting the well test that this well would be
adequate to supply water to the number of proposed lots and be submitted to the
Planning Department;
e) An assumption of an average of no less than 3.5 people per dwelling unit, using
100 gallons of water per person, per day;
D The water quallty be tested by an approved testing laboratory and meet State
guidelines concerning suspended solids, bacteria and nitrates.

Dear Mr. & Mrs. Bagley
As a result of further review of your exemption from the definition of subdivision and our conversation this monring,
I feel that a letter regarding the ability to sell the remaining portions of your property is necessary. It appears that
you have a misunderstanding regarding your ability to convey some of the remaining portions of property.
As you are aware, all of the Antlers Orchard Development (AOD) lots may be conveyed as 10.0 ac. tracts without
any frrther subdivision approval. But there appears to be some confusion regarding the subdivision status of AOD
Lot2l, on which you have your home. You verbally indicated to me that yor:r father had split the lot into three lots
of 1.0, 4.0 and 5.0 acres previously. At that time I assumed he had completed an exemption process during the time
that a previous Board of County Commissioners allowed people to split AOD lots by exemption. After checking
our records, I realized that there has never been an exemption approved for the property, nor any other action by a
Board of County Commissioners authorizing a split of the prope4y. By reviewing the Deed of Trust submitted in
support ofyour recent subdivision exemption application, I was able to identiff theseparate legal descriptions as a
part ofthe legal description of your entire ownership. Since these legal descriptions are a part of a single deed, they
do not exist as separate tracts of land. As such, whenyou decide to sell AOD Lot 21, it will have to sold as a 10.0
ac. AOD tact, not as the three smaller parcels you identified on the proposed exemption map.
It has always been the County's position, that property taken in a single deed, that has different legal descriptions
of property that are contiguous to each other, results in merger of the property for the purpose of subdivision. As
a result, we cannot recognize the legal descriptions noted previously as separately conveyable lots. Technically,
the 10.0 ac. tact south of AOD Lot 21 should have been merged with the 40 acres you received approval to split by
exemption. Since it was not identified by me during the review of your application, that property will exist as a
separate tract land that the County will issue a building permit for a structure on this property" I wanted to make
sure that there was no misunderstanding of these issues for future reference, given our recent conversations.

of the County of Garfield, and the State of Coloradbl (Grantor), and PAUL BAGLEY AND CHARLEEN
L. BAGLEY, whose legaladdress is 1073 County Road 260, Sih, CO 81652
of the County of Garfield, and the State of Colorado, (Grantee).
WITNESSETH, that the Grantor, for and in consideration of the sum of ten (10) dollars and other
good and valuable consideration paid to the Grantor by the Grantee, the receipt and sufficiency of which
is hereby acknowledged, does hereby grant, bargain, sell, and convey to the Grantee and does hereby also
reserve for the Grantor an easement for the purposes of access and utilities, as more fully described on
Exhibit "A," entitled "Access and Utility Easement," attached hereto and incorporated herein by reference
as if fully set forth, (Easement) over and across the following described parcel of real property situate in
the County of Garfield and State of Colorado, to wit:
Antlers Orchard Development Company's Plat No. l, Tract 21, recorded at Reception No. 37488 with the
Garfield County Clerk and Recorder.
This Easement is for the benefit of and appurtenant to Grantor's and Grantee's parcels of land, or
any part thereof, situate in the County of Garfield and State of Colorado, and described as:
Lot lA and Lot 3A, Bagley Subdivision Exemption (Grantee's parcels)
and
Antlers Orchard Development Company's Plat No. l, Tract 21, recorded at Reception No. 37488 with the
Garfield County Clerk and Recorder (Grantor's parcel).
This easement shall be permanent and perpetual, and the covenants herein shall run with the land
and shall be binding upon and inure to the benefit ofall heirs, devisees, personal representatives,
successors and assigns ofthe parties.
The parties agree to share equally the costs to repair and maintain the Easement granted herein,
and agree that neither party will in any way hinder or prevent the proper and reasonable use and
enjoyment of the property through which the Easement is granted.
