HomeMy WebLinkAbout2.0 Resolution 78-60BEA, THE BOARD OF COUNTY COMMISSI RS OF GARFIELD COUNTY, COLORADO RESOLUTION 44-78-47c, WHEREAS, Paul and Golda Baum, have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division of a 10.77 acre tract of land into two (2) tracts of 2 and 8.77 acres, more or less, and said 10.77 acre tract is more particularly described as follows: A parcel of land situated in Section 2, Township 7 South, Range 95 West of the Sixth Principal Meridian, being in Lot 14 of the Morrisana Ranch Subdivision, said parcel of land being the Easterly two (2) acres of said Lot 14. WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale of two (2) existing residential dwellings; and, WHEREAS, the Petitioners have deomonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that both existing residential dwellings are served by existing individual water and sewage systems, that there is adequate ingress and egress to said tracts, that the division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S (1973) Section 30-28-101 (10) (a) -(d) as amended; NOW THEREFORE, upon motion of -q(„UP .. �elr'iSe. , seconded by 11.A. Jo I i e ./ and carried, said 10.77 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two (2) tracts of 2 and 8.77 acres, more or less, all as is more fully described in the petition pertaining hereto, and further that said exemption is conditioned upon the Petitioners obtaining a proper legal description of said tracts prior to their conveyance. A copy of the instruments of conveyance when recored shall be filed with this Resolution. , A.D., 1978.
