*HEREAS, the petitioners have demonstratecl to the satisfaction of the Board of county
commissioners of Garfielcl county, colorado, that there is a reasonable probability of locating domestic
water on.each of said parcels, that there is existing ingress ancl egress to saicl parcels, that the location
of septic tanks will be perrnitted by the Coloraclo Departrnent of l{ealth, tltat tlle requested division is not
part of an existing or rarger cleveropment and cloes not fail witrrin the general purposes and intent of the
subdivision Regurationr-of ,lr. state of Colorado ancl trre County of Garfield, ancl should, therefore' be
exemptecl from the clefinition of the terms "subclivisio." and "iubclivitled la.cl" as set forth in c'R's'
D73:30-28-101 (10) (a)-(d), as amended; and
NOW THEREFORE, BE IT RESOLVED that the division of the above described 12'83 acre
parcel is hereby exemptecl from such clefinitions ancl may be conveyed in the rorm of the Lot " I and Lot

Dear Eva and Dan;
On February 72, 1996, the Garfield County lloard of County Commissioners approved your
request tilr a subclivision exernption, based on compliance with the fbllowing conditions of
approval:
'l'hat all representations of the applicant, either within the application or stated at
the nteetirtg before the Board of County Cornmissioners, shall be considered
conditions of approval, unless approved otherwise by the Board.
That a signed water court decree ancl Basalt Water Conservancy District contract,
with an approved well perrnit be submitted prior to the signing of a plat.
Aclditionally, a well be drilled for lhe new parcel and the fbllowing information be
submitted to the Planning Departnrent, befbre tlte plat can be signecl:

A well be drilled and a 4 hour pump test shall be perfbrrned;
The applicant supply, to the Planning Department, the well completion
report dernonstrating the clepth of the well, the characteristics of the aquifer
and the static water level;
The results of the 4 hour pump test inclicating tlie purnping rate in gallons
per rninute and information showing clrawdown and recharge shall be
subnrittecl to the Planning Departnient;
A written opinion ol' the person conducting the well test that this well
would be aclequate to supply water to the number of proposecl lots and be
subrnittecl to the Planning Department;
An iusurnption of an average of no less than 3.5 people per dwelling unit,
using 100 gallons of water per person, per day;
'l'he water quality be tested by an approved testing laboratory ancl meet
State guiclelines concerning bacteria and ltitrates.

That the applicant shall have 120 days to present a plat to the Cornnrissioners tor
signature l'roni the date of approval of the exemption, unless an extension is

granted by the Board prior to the expiration of the 120 days.
That the applicant shall subrnit $200.00 in School Lnpact Fees for the creation of
each new exemption parcel, prior to the signing of a plat.
That the applicant shall pay $235.00 to the Carbondale & Rural Fire Protection
District prior to the signing of a plar.
A Final Exernption Plat sliall be subrnitted, indicating the legal description of the
property, dirnension and area of the proposed lots, access to a public right-of-way,
and any proposed easeurents fbr setbacks, drainage, irrigation, access or utilities
and a building envelope fbr the 2.6 acre tract. Additionally, the following plat
notes shall be shown:
"All new construction shall be consistent with Colorado State Forest
Service wildlire prevention guidelines specified in the pamphlet "Wildfire
Protection in Wildland Urban Interface"(C.S.F.S. #143-691)"
" [f or when the County adopts a road impact fee, the lots created by this
exemption will be subject to paying that fee, paid at tirne of building permit
application by the building pernrit applicant. "
"Soils constraints on the property are considered severe for dwellings with
or without basements and for individual sewage disposal systems, which
may result in the need fbr alt engineered design for a house foundation
and/or individual sewage disposal system. "
Control of noxious weeds is the responsibility of the property owner
That the applicarrts join with the neighbors in the road maintenance and repair
agreement fbr the access easement and a copy of a signed agreement be submitted
to the Planning Department, prior to the signing of a plat.

Extension Request
Dear Mark,
We would like to ask for an extension of the date for
submission of a plat to the Commissioners owing to unexpected
delays in meeting aII required contingencies. We ask that the
submission date be postponed to on or before 350 days following
the approval date, namely February 11, L997.
