The site is lor:ated in Medium Density Residential District (6-9 acres/dwelling, as
designated on the Garfield County Comprehensive Plan, Study Area I, Carbondale
Area Proposed Land Use Districts Map.
II. DESCRTPTTION OI.- TI{E PROPOSAL
A Site f)escrintion: 'l-he site is looated approximately three (3) miles south of the
Cattle Creek/Highway 82 intersection, on the hillside south of the creek bottom.
The predominant vegetation is pinon and juniper trees. The applicants have

Project Description: The applicant is proposing split the 12.83 acre parc,el into
two (2) parcels of approximately 2.60 and 10.23 acres in size. A site plan
submitted with the application is enclosed. (see pgsly':-)

III. MAJOR ISS{TF,S AND CONCT]RNS
Srrh<livision Regulzrtions. Section 8.52 of the Garfielcl County Subdivision
Regulations state thal "No more than a total of lour (4) lots, parcels, interests
or dwelling units will be created liom any paroel, as that parcel was described in
the records of the Garfield County olerk and Recorcler's office on January l,
1973, and is not a part of a recorded subdivision; however, any parcel to be
divided by exemption that is split by a public right-of-way (State or Federal
highway, Counly road or railroad) or natural feature, preventing joint use of the
proposed traots, and the division oocurs along the public right-of-way or natural
feature, suoh paroels thereby created may, in the discretion of the Board, not be
considered to have been oreated by exen-rption with regard to the four (4) lot,
parcel, interest or dwelling unit limitation otherwise appricabre;
Documentation submitted with the application shows that the tract in question
was recorded in the records of the Clerk and Recorders Office in February ,1979
in Book 522,Page657, as a38.49 aore tract of lan<I. Since that time, the original
tract has been split into three smaller trac;ts. Sinoe only three parcels have been
exempted lrorn Lhe parcel sinoe that time, there is one a<tclitional exemption
parcel that can be recluested.
Zoning. All of the exemption parcels are consistent with the requirecl two (2)
acres minimum lot size lor the fuR/RD zone district.
Legal Access All of the proposed parcels have access to c.R. Ll2 via a
nonexclusive aocess easemenl Lhrough a lot adjacent to the road.
Water ancl Sewer. The applicant is proposing to use an existing domestic well
for the souroe of water to the existing house. The applicants have purchased
water from the Carbondale Land Development Corporation and Basalt Water
Conservancy District to augment the domestic water supply for the proposed lot.
The applicant's attorney has submitted a letter, with copies of the augmentation
water contraots. lsee pgs.?-BJhe Board is now requiring applicant's to
demonstrate that there is a physical source olwater, as well as a legal, before any
decision is made regarding the proposed exemption request.. prior to making
a decision, the applicants need to meet the following criteria lor demonstrating
the quality, quantity and dependability of the well proposed lor the new lot::

A well be drilled and a 24hour pump test shall be performed;
The applicant supply, to the Planning Department, the welr completion
report demonstrating the depth ol the well, the characteristics of the
aquifer and the static water level;
'fhe results of the 24 hour pump test indi<;ating the pumping rate in
gallons per minute and information showing cirawclown and recharge
shall be submitted to the Planning Deparlment;
A written opinion of the person conducting the well test that this well
would be adequate to supply water to the number of proposed lots and
be submitted to the Planning Department;
An assumption of an average of no less than 3.5 people per dwelling unit,
using 100 gallons of water per person, per day;
The water cluality be [ested by an approvecl testing laboratory and meet
State guidelines concerning bacteria and nitrates.

Sewer will be provided by ISDS. Soils on the site are considered to have severe
constraints for conventional septic tanks and leach fields due to slopes and depth
to bedrock. A plat note identilying the potential constraints is appropriate.
E.Iluil<ling Conslraints: The soils inlormation submitted with the application
indicates that buildings could be limited by soils, indicating severe constraints
based on slopes and depth to bedrock. A plat note, combined with the ISDS
noting soils constrainl.s is appropriate.
G I"-ire Protection. The applicant has had the Carbondale Rural and Fire
Protecl"ion District review the application and the Fire Chief has stated that the
parc;els in question oan be protected by the District, with some limitations.
Additionally, the Distrjot is recluiring a $235.00 impact fee, prior to the signing
or a prar. tsle pE ?tl .
E,asenrents. A.ty required easements (drainage, acoess, utilities, eto..) will be
required to be sh<lwn with legal descriptions on the exemption plat.
School Impact Frees The applioant will be required to pay a $200.00 school
impact fee prior to the approval of the final plat lor the new lot rlot having a
residence on it.
Potential Road Imfract Fees: If or when the County adopts a road impact fee,
the lots created by this exemption will be subject to paying that fee, paid at time
olbuilding permit applioation by the building permit applicant. This provision
shall be included as a plat note.
IV. STIGGES'I-ED ITINDINGS
That proper posting and public notice was provided as required for the meeting
belore the Board of County Commissioners.
That the meeting belore the Board of County Commissioners was extensive and
oomplete, that all pertinent lac[s, matters and issues were submitted and that all
interested parties were heard at that meeting.
That for the above stated and other reasons, the proposed exemption is in the
best interest of the health, sal'ety, morals, convenience, order, prosperity and
welfare of the oitizens of Garfield County.

TFIIS OPTION TO EXECU'I'Ir WATER LEASE AND AGITEEMENT (hereinafter

CARBONDALE LAND DEVIILOPMEN'l' CORPOIIATION, a Colorado corporation
(hereinafter "Cl-l)c"), and DAN BATIARAV (hereinafter "llaharav");

WflEItllAS, CLDC is the owner of a quantity of excess historic consurnptive use water,
as more partictrlarly described and decreed in Case No. 79CW097, District Court in and for
Water Division No. 5, State of Colorado; ancl
WllEltllAS, IJaltarav clesires to obtain an option to lease from CI-DC a perpetual right
to ilelivery ol0.l acre-lcet of cortsurnptive use water llursuant to the terrns set tbrth herein; and
WHEIIEAS, the parties desire by this Option to set forth the tenns and conditions of the
Option to Ilxecul"e a Water I-ease and Agreernent.
NOW, 1'lIlllEl'-OItE, for and in consideration of the mrrtual pronrises and covenants
contained herein, the adequacy and sufllciency of which are hereby acknowledged, the parties

1. Opfqn to I]xecute Water I-ease and Agreement and Option Term Thereof. CLDC
hereby grants to llaharav, pursuant to the terms of this Agreenrent, an option to execute the form
Water Lease and Agreement, attached hereto and incorporatetl by ref-erence as Exhibit A.
2. Olltion l'erp. 'l'lte terrn of this Option shall comrnence upon execution of this
Agreement and shall continue fbr theperiod of one (1) year, so long as all ternis ancl conditions
of this Agreenrent are satislrcd.
3. Qptloql[aa. Ilaharav shall pay to CLDC a $300.00 option fee, which option fee
shall be applied to the Water l-ease execution fee when ancl if Baharav chooses to exercise his
option to execution tlre Water l-ease and Agreelnent attached as Exhibit A. Iteceipt of saicl fee
is hereby acknowledgecl.
4. Teluinalion of Oplion Agreernent. IlBaharav refrains frorn exercising his option
to execute the attached Water Lease and Agreemenl on or before Deceniber 10, 1996, this
Agreernent shall terminate ancl be void and of no eft'ect, and each party hereto shall be released
from all obligations hereunder; providecl, however, Baharav's optiol fee payment of $300.00
shall be retainetl by CLDC. In the event oI terrnination of this Agreernent, CI-DC shall have
no furtlter obligation to agree to cleliver leased water for the benefit of Baharav.

I-essor nrakes no reprcsentatiorr or warranty whatsoever corrcerning the viability of said water
rights, the suitability ol said water rights lbr Lessor's use, or any other representation
concenring the water riglrts which are the subject of this Agreenrent. Said wiiter rights are
accepted by Lessee "as is." Lcssee shall be solcly responsible for securing, at l.essee's sole
cost, any and all approvals necessary to utilize the leased water, including without liniitation

10. Ilreachi Ilemedies. In the everrt the l-essee fails to make annual paynients in the
amounts ancl at the tirnes required uncler Paragraph 2, above, or if the Lessee breaches any of
the terms an4 conriitions of this Agreernent, the I-essor has the option to terminate tlte agreement
or exercise its legal remedies, including but not IirniterJ to an action to collect all anrounts due
to Lessor if said anrounts due are not paid within thirty (30) days of the due date. Further,
I-essor is entitled to any otlter remedy available in equity or at law.
I l. Attorney Fees. [n the event of Iitigation to entorce any of the terms or conditions

agreement of the parties on the subject matter herein. No prornise or unclertaking has been made
by any PaflY, and no understanding exists with respect to the transaction contentplated, except
as expressly set forth herein. All prior and conternporaneous negotiations and understandings
between the parties are integrated and merged into tltis Agreement.
17. Governing Law. This Agreernent shall be governed by the laws of Colorado,
which state shall also be deerned the place where this Agreerncnt was entered into and the place
of perfbrmance and trzrnsaction of business ol' the parties. In the evenl of litigation pertaining
to this Agreemertt, the exclusive fonrm, venuc, and place of jurisdiction shall also be Colorado,
