Becker LOCATION: A tract of land located in portions of Sections 7 and 8, T7S, R88W; more practically described as a tract located 1.5 miles southeast of the intersection of the State Highway 82 and County Road 114 intersection. PROPOSAL: It is proposed to split a 240 acre tract into two (2) parcels of approximately 2.75 acres and 237.25 acres. WATER: Inaividual well SEWER: Individual Sewage Disposal System ACCESS: County Road 114 ZONING: A/R/RD I. PROJECT DESCRIPTION It is proposed to split a 240 acre tract into two parcels of 2.75 acres and 237.25 acres each. The 2.75 acre tract has an existing house with an existing well and individual sewage disposal system hooked up presently. The remaining property can be served by an additional well and individual sewage disposal system. II. STAFF COMMENTS 1. In January of 1982, Resolution No. 82-24 created three new parcels of 10.29, 5.75, and 7.99 acres each, with 240 acres remaining. 2. Technically, this application would exceed the limitation of four (4) parcels being created out of a tract of land as it existed in January 1, 1973. Due to a significant difference in elevations on this property, the proposed 2.75 acre parcel is separated from the previously exempted parcels by a difference of nearly 200 feet in elevation. The elevation difference can be classified as a natural feature, preventing joint use of the tracts. III.SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the meeting. • • 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the proposed exemption is separated by a natural feature preventing joint use of the property. IV. RECOMMENDATION APPROVAL of the proposed split of an approximately 240 acre tract into tracts of approximately 2.75 acres and 237.25 acres, subject to the following conditions: 1. That an exemption plat be developed in accordance with the requirements of the Garfield County Subdivision Regulations of 1984. 2. That the following easements be legally described and shown on the exemption plat and in any deeds: a. An easement for access and maintenance to and around the existing well and water line. b. An access easement for the existing private drive. 3. That this exemption is the last exemption allowed by the Garfield County Subdivision regulations. A
