HomeMy WebLinkAbout1.0 Application• • PETITION FOR EXEMPTION J r j1 ) J �* CL,lmo, TO: BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO CHARLES J. BECKER, (Becker) and HAROLD R. LYONS and MARIANNE E. LYONS (Lyons) hereby petition the Board of County Commissioners of Garfield County, Colorado, to adopt a Resolution excepting the sale of a parcel of land from Becker to Lyons from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101(10)(a) and from regulation under the Garfield County Subdivision Regulations, as amended, and as reason therefor state as follows: 1. Becker is the owner of the parcels of land depicted upon the attached plat containing 7.84 acres and 1.623 acres, respectively, which plat was prepared by Eldorado Engineering Company under the hand and seal of Jerome F. Gamba, P. E. & L. S. No. 5933, dated April 29, 1975. 2. Becker proposes to sell to Lyons the parcel of land containing 7.84 acres. 3. The parcel of land containing 7.84 acres has situate thereon a residence, which residence has been in existence and occupied since a time prior to the adoption of the legislation known as "Senate Bill 35" and prior to the adoption of Garfield County Subdivision Regulations. 4. The parcel of land containing 1.623 acres has been and is now used as a gravel pit and is not suitable for use as a building site. 5. That traversing and separating the two parcels of land depicted on the attached plat is a County road which was deeded to the County by Doc. No. 102744. • • 6. That neither Becker nor Lyons own any other property which is contiguous to the two parcels of land depicted on the attached plat. 7. That the water supply furnished to the residence located on the tract containing 7.84 acres is now and has been from the Trout Springs and Pipeline. 8. That the sanitary sewage treatment system connected to the residence located on the tract containing 7.84 acres is now and has been a septic tank and leech field. 9. That access to the property for which exemption is herein sought is over and across the access road to Colorado Highway No. 82. 10. That by granting the requested exemption, the intent and purpose of state and county statutes, resolutions and rules and regulations will be fulfilled in fact.
