BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01•the under-
signed Clifford T. Barksdale and Hazel M. Barksdale
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 24 acre tract of
land into 2 tracts of approximately 5 and 19 acres each,
more or less, and which tract to be subdivided is more particularly described as
follows:

from the definitions of "subdivision" and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
Present owners are unable to maintain the entire parcel and to irrigate
& maintain the hayfield and the county road would provide excellent access
for the two parcels without affecting travel on the road.
In support of this petition the petitioner also submits the following:
(a) Map drawn to scale showing proposed
lot subdivision and access.
(b) Vicinity Map.
(c) Statement on source of domestic water.
(d) Statement on method of sewage disposal.
(e) 100 year floodplain information where
live stream crosses or ad'o'ris said tract.
(f) Fee in the amount of $ V//.:--

Township 7 South, Range 38 West of the Sixth Principal
Meridian, said parcel of land is described as follows:
Beginning at a point whence an iron post with.a brass
cap, found in place and properly marked for the North
Quarter Corner of said Section 17 bears: N. 89°36'08" E.
652.88 feet and N. 00°17'12" W. 1369.28 feet; thence S.
04°53'53" E. 1366.29 feet to a point on the Southerly line
of said Lot 7, being also the East-West centerline of said
Section 17; thence N. 89°38'31" W. 759.49 feet along said
centerline to the Southwest Corner of said Lot 7; thence
N. 00°25'30" W. 676.05 feet; thence S. 89°58'48" W. 529.16
feet; thence N. 21°53'23" E. 1457.68 feet more or less to a
pont on the Northerly line of said Lot 5; thence N. 89°13'32" E.
629.38 feet more or less along the Northerly line of said Lot 5,
to the Northeast Corner of said Lot 5; thence S. 00°21'09" E
680.33 feet along the Easterly line of said Lot 5 to the point
of beginning.
The above described parcel of land contains 40.00 acres, more
or less.
The above described parcel of land is subject to a parcel of
land containing approximately 5 acres, more or less as described
in Document No. 194018 and recorded in the records of the County
Clerk and Recorder, Garfield County, Colorado. The above described
parcel of land is also subject to a 60 foot road easement running
through the entire parcel in a Southeasterly, Northwesterly
direction.
And subject to the following described parcel of land:
A parcel of land situated in Lots 5 and 7 of Section 17, Township
7 South, Range 88 West of the Sixth Principal Meridian, lying southerly
of the northerly line of said Lot 5, westerly of the easterly line
of said Lot 5, and northerly of the northerly right of way line of
County Road No. 113, said parcel of land is described as follows:
Beginning at a point on the northerly line of said Lot 7 being also,
the southeast corner of said Lot 5 whence an iron post with a brass
cap found in place and properly marked for the North Quarter corner
of said Section 17 bears N. .89°36'08" E. 652.88 feet and N. 00°17'21"
W. 1369.28 feet:
thence from said point of beginning S. 04°53'53" E. 229.19 feet to
a point on the northerly right of way line of said County Road;
thence N. 80°03'21" W. 95.92 feet along the northerly right of way
line of said County Road;
thence N. 58°29'13" W. 200.00 feet along the northerly right of way
line of said County Road;
thence 199.68 feet along the northerly right of way line of said
County Road, on the arc:of a curve to the right, having a radius
of 1169.10 feet and a chord of which bears N. 53°35'38" W. 199.43
feet;
thence N. 48°42'04" W. 485.00 feet along the northerly right of way
line of said County Road;
thence leaving said County Road N. 21°53'23" E. 367.00 feet to a point
on the northerly line of said Lot 5;
thence N. 89°13'32" E. 629.38 feet along the northerly line of said
Lot 5 to the Northeast corner of said Lot 5;
thence S. 00°21'09" E. 680.33 feet along the easterly line of said
Lot 5 to the Southeast corner of said Lot 5 the point of beginning.
