HomeMy WebLinkAbout1.0 ApplicationREQUEST FOR SKETCH PLAN REVIEW AND EXEMPTION ELK CREEK DEVELOPMENT, INC., a Colorado corporation, and MARY LOUISE JOLLEY, by their attorney, Thomas W. Stuver, hereby requests a sketch plan review and exemption from the Garfield County Subdivision Regulations of an exchange between Elk Creek Development, Inc. and Mary Louise Jolley of two parcels, each being less than 35 acres in area. The undersigned attorney certifies that Elk Creek Development, Inc., a Colorado corporation is the record owner in fee of that parcel described on the plat prepared by Scarrow and Walker, Inc. attached hereto and labeled Exhibit A. The undersigned attorney further certifies that Mary Louise Jolley is the record owner in fee of the parcel described on the Scarrow and Walker Plat attached hereto and labeled Exhibit B. As can be seen from the attached Exhibits the parcels to be exchanged include 0.1 acres and 0.096 acres respectively. No development is to occur on either of the parcels to be ex- changed. The purpose of the exchange is to conform the record boundary lines of the parties to the existing fence line and location of improvements on the properties of the parties. The the existing fence between the properties of the parties is shown on Exhibits A and B attached. If this exemption and the exchange of properties is approved the 0.096 acres, more or less now belonging to Mary Louise Jolley will be conveyed to Elk Creek Development, Inc. and will become appurtenant to approximately 60 acres of land owned by Elk Creek Development, Inc. in the W2NE4 of Section 25, Township 5 South, Range 91 West of the 6th P.M. The .1 acres Development, would become more or less now owned of record by Elk Creek Inc. would be conveyed to Mary Louise Jolley and appurtenant to a parcel which is the site of the applicant's residence and would then contain approximately 1.042 acres more or less. Access to the parcel to be conveyed to Elk Creek Development, Inc. is the County Road No. 245 which is contiguous with the tract. Access to the parcel to be conveyed to Mary Louise Jolley is also via County Road 245 which is contiguous to the homesite owned by Mary Louise Jolley. The zoning of the parcels to be exchanged is Agri- cultural/Rural/Residential. It is expected that the exemption, if granted, would have. no effect upon land use in the area since the exemption requested would only conform the legal titles of the parties to the existing land use pattern.
