When reviewing a plan and it's discovered that required infom1ation has not been provided by the applicant, this will result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor shall be required to provide this information before the plan review can proceed. Other plans that a:re in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project. Any project with more than ten (10) occupants requires the plans to be sealed by a Colorado Registered Design Professional. To provide for a more understandable plan in order to determine compliance with the building, plumbing and mechanical codes, applicants are requested to review the following checklist prior to and during design Applicants are required to indicate appropriately and to submit the completed checklist at time of application for a permit. Plans to be included for a Building Permit, must be on drafting paper at least 18"x24" and drawn to scale. Plans must include a floor plan, a concrete footing and foundation plan, elevations all sides with decks, balcony, steps, hand rails and guard rails, windows and doors, including the finish grade line and original grade. A section showing in detai~ from the bottom of the footing to the top of the roof, including re-bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation, sheeting, house-rap, (which is required), siding or any approved building material. Engineered foundations may be required. A window schedule. A door schedule. A floor framing plan, a roof framing plan, roof must be designed to withstand a 40 pound per square foot up to 7, 000 feet in elevation, a 90 M.P.H. wind speed, wind exposure B or C, and a 36 inch frost depth. All sheets to be identified by number and indexed. All of the above requirements must be met or your plans will be returned. All plans submitted must be incompliance with the 2003 IRC. 1. Is a site plan included that identifies the location of the proposed structure or addition and distances to the property lines from each corner of the proposed structure( s) prepared by a licensed surveyor and has the surveyors signature and professional stamp on the drawing? Properties with slopes of 30% or greater must be shown on the site plan. (NOTE Section: 106.2) Any site plan for the placement of any portion of a structure within 50 ft. of a property line and not within a previously surveyed building envelope on a subdivision final plat shall be prepared by a licensed surveyor and have the surveyor's signature and professional stamp on the drawing. Any structure to be built within a building envelope of a lot shown on a recorded subdivision plat shall include a copy of the building envelope as it is shown on the final plat with the proposed structure located within the envelope. Water proofing at exterior bath wall first floor must be checked. Measuring from the bottom of the window sill to the top of subfloor is approximately seven inches lower than measuring from the bottom of the same window sill to the top of the exterior finish grade. As the finish grade is above the subfloor, is there adequate waterproofing provided in the construction of the exterior wall? 2. With regard to the north wall under the electrical panels, there appears to be approximately 5" of exposed foundation wall. Assuming a poured stem wall of 8" allows for approximately 2.5" of bearing after drywall. Must determine whether bearing is adequate. · 3. There is a crack in the drywall at the window header above bench seating in bedroom 3. Also noted that the exterior stucco had been repaired at this same spot. There is concern about a 4" waste line that is penetrating through the micro- lams in two locations (crawl space access in guest suite closet). Must determine if micro-lam has been compromised. 5. 7" clearance in some locations from. grade to wood (crawl space access in guest suite closet) -please advise if this is acceptable. 6. There did not appear to be any crawl space vents-please advise if this is acceptable. 7. There is a bearing wall in the crawl space that is sheeted with OSB board that is in contact with the dirt. Please advise if this is acceptable. 8. There is moisture seeping into crawl space from what appears to be exterior drainage issues-please confirm and advise. 9. Upon investigation by Shaffer Construction w!d Nicol Associates, Structural Engineers, last week at tl1e Ramge residence, it was determined that the sill plates throughout the Ramge residence do not comply with the requirements of the architectural drawings for the Rarnge residence and do not meet Section2306.5 of the 1997 Uniform Building Code which states in relevant part that: "All foundation plates or sills and sleepers on a concrete or masonry slab, which is in direct contact with earth, and sills that rest on concrete or masonry foundations, shall be treated wood or Foundation redwood, all marked or branded by an approved agency." It has been determined by Shaffer Construction and Nicol Associates that all sill plates used in the Ramge residence are untreated Douglas Fir. While the above issue with regard to LIJ.e Ramge residence is disconcerting at best, there seems to be a larger iss11e wl1ich I brought to Mr. Schwaller's attention and now am bringing to your attention. I questioned Jim Mines about the use of Doug Fir for the sill plates and he seemed to not be aware of the requirement to use treated or foundation redwood. In fact, it appears that all sill plates in Mr. Mines' new residence, being built next door to the Ramge residence, does not have treated or foundation redwood for the sill plates. My clients believe that, if true, Mr. Mines should be required to correct his new residence to comply with the Uniform Building Code so as to negate any future negative impact on my client's property. To that end, my clients are requesting that the building department inspect Mr. Mines' newly constructed residence to determine whether the sill plates meet code and the requirements of the architectural drawings for that residence and take appropriate action if necessary. This Amended Notice of Claim sets forth further details and damages that have subsequently been uncovered as a result of further investigation by the Claimants herein. Factual Basis of Claim The Claimants herein are the owners of real property and improvements located at 0134 River Glen Road, Carbondale, Garfield County, Colorado. On February 20,2001, Garfield County Building Inspector, Dan Williams, inspected the aforementioned property and issued Certificate of Occupancy #4072 (Attached hereto as Exhibit A). The Certificate of Occupancy issued by Mr. Williams was done so in error. At the time of the final inspection, there existed significant and apparent deficiencies in the progress of the construction which constituted gross deficiencies and violations of Universal Building Code ("UBC") requirements. The condition ofthe structure on the date of the final inspection, February 20,2001, was such that the issuance of the Certificate of Occupancy constituted absolute error in that: (1) The electrical wiring was not properly connected to either the thermostat nor was the wiring properly connected to the HV AC system. As a result, the heating system was inoperable. A final Electrical Inspection by the Colorado State Electrical Inspector had not been performed; (2) The kitchen was devoid of all necessary plumbing. Cabinets and Countertops were not installed. Walls were not finished and the floor lacked a non-absorbent covering and was not complete for the installation of a stove or refrigerator; (3) The bathrooms were incomplete; ( 4) Outside gradiilg to detour water away from the building was non-existent in violation ofUBC Code. In fact, there was a negative slope in relation to the building which resulted in water flooding into the foundation; (5) The interior staircase leading downstairs from the foyer was too narrow in violation ofUBC Code. ( 6) Additional UBC violations have rendered the Residence uninhabitable. Further, subsequent to the revocation of the CO, the Claimants herein, the Claimants herein engaged the professional services of Monroe & Newell Engineers, Inc. ("Monroe") and George Shaeffer Construction Company ("Shaeffer") to further investigate the structural integrity and completion of the Residence. On July 1, 2002, Monroe issued a structural observation report (a copy of which is attached hereto as Exhibit C) wherein substantial defects in the structural integrity of the Residence were discovered over and above those discovered by the Garfield County Building Department. Further, in a subsequent report dated September 18, 2002 (attached hereto as Exhibit D), Monroe stated that the Residence should not be occupied in its current condition. Further, on July 16, 2002, Shaeffer issued an estimate of cost of repairs to complete the Residence (attached hereto as Exhibit Notice of Claim against Garfield County October 17, 2002 Page 3 of4 E) in the amount of $690,966.00, exclusive of concrete foundation repairs and omissions and replacing sill plates throughout the entire residence due to the failure of AGL9 to abide by State and County code requirements (the "Omissions"). Schaeffer is unable to determine a fixed amount to fully repair the Residence and the damage caused may be irreparable. Based upon the foregoing, the Certificate of Occupancy should not have been issued by Inspector Dan Williams. This fact is further supported by the revocation of the Certificate of Occupancy upon follow-up inspection of the premises by Chief Building Inspector, Amo Ehlers, on October 18, 2001. (Letter of Revocation attached hereto as Exhibit B). Upon follow-up inspection, Mr. Ehlers determined that a number of violations of the 1994 Building Code existed due to incomplete work. As a result of the actions of the Garfield County Building and Planning Department and/or the named employees, in issuing the Certificate of Occupancy in error, the Claimants have suffered economic injury. Priorto the issuance of the Certificate of Occupancy, the Claimants and the Builder-Vendor(s) entered into an Escrow Agreement ("Escrow Agreement") with Land Title Guarantee Company ("L TGC") pursuant to which certain sums of money were being held pending, inter alia, issuance of a Certificate of Occupancy from Garfield County Building Department relative to the property herein. Upon issuance of the Certificate of Occupancy the Title Company released the sum of One Hundred Fifty Thousand Dollars and 00/100 ($150,000.00) (the "Funds") to the Builder-Vendor(s). In addition, also pursuant to the Escrow Agreement, $75,000.00 was to be released the Builder- Vendor upon completion of the approved Landscaping Plan, and receipt of the Aspen Glen Design Review Committee stamp of approval and the release of the Aspen Glen Landscaping Bond to · Seller, certifying Design Review Committee acceptance of the landscaping plan completion, and the reasonable satisfaction of Buyer. Following the issuance of the Certificate of Occupancy, the aforementioned steps were completed and LTGC released the $75,000.00 associated with the landscaping to the Builder-Vendor. However, given that as referenced above, outside grading to detour water away from the building was non-existent in violation ofUBC Code, and there exists a negative slope in relation to the building which resulted in water flooding into the foundation, all previously-completed landscaping must now be removed in order to re-grade the area surrounding the building to achieve a positive slope in relation to the building. However, an inspection of the slope in relation to the building should have been conducted upon issuance of the Certificate of Occupancy that would have revealed this negative slope issue prior to the installation of the landscaping and the subsequent release of he $75,000.00 from escrow. Further, as specifically detailed in the reports and estimates of Momoe and Schaffer (Exhibits C, D, and E), the construction of the Residence is substantially incomplete and defective so as to render the Residence unable to be occupied. Given that the Garfield County Building and Planning Department and Daniel K. Williams performed an inspection of the residence and given the gross Notice of Claim against Garfield County October 17, 2002 Page4 of4 deficiencies with the Res.idence as evidenced by the reports of Monroe and Schaffer, it is abundantly clear that.the CO was issued by Mr. Williams and the Garfield County Building and Planning Department in breach of the Garfield County Building and Planning Department's implied contractual duty to the Claimants herein. Legal Theory of Liability On February 20, 2001, the Garfield County Building and Planning Department by and through its employees and/or Inspectors named herein performed a building inspection on the premises herein and issued Certificate of Occupancy #4072. The Certificate of Occupancy was issued in breach of · the Garfield County Building and Planning Department's implied contractual duty to the Claimants herein. In issuing this Certificate of Occupancy, the Garfield County Building and Planning Department effectively made assurances and promises that the premises inspected met all UBC . Code requirements for occupancy. LTGC and the Claimants herein relied, to their detriment, upon the representations inherent in the issuance of the Certificate of Occupancy as to the acceptable condition of the premises. The Garfield County Building and Planning Department by and through its employees named herein, should reasonably have expected that the Claimants, as third parties and L TGC, would rely on the promises inherent in the issuance of the Certificate of Occupancy. As a result of its reliance, L TGC released the Funds which were being held in Escrow to the Builder- Vendors. As a result of the release of funds, the Claimants have suffered injury in that the Funds have previous! y been released and the construction project is incomplete. Based upon the foregoing and pursuant to C.R.S. This correspondence will set out Mr. Mines response to the settlement proposal contained in your letter. At the outset, Mr. Mines has confirmed his willingness to go forward as he had offered in February to complete or correct any work in the Ramge residence that may be necessary to regain a Certificate of Occupancy for that residence from the Garfield County Building Department. This would be done immediately upon the execution of an acceptable settlement agreement and pursued diligently until the C.O. issued, which Mr. Mines has estimated to require something less than eight weeks. As a part of that agreement, Mr. Mines continues to be willing to waive and release any claim which he might have to the $75,000.00 currently held in escrow by Land Title, with the exception of the amount (approximately $10,000.00) which will need to be paid to Argento Tile for the marble countertop to be installed in the kitchen. He would further be willing at that time to waive and release any claim that he has to payment by Mr. Ramge of the approximate $22,000.00 additional charges for change orders, for which a statement issued almost twelve months ago and which is still unpaid. The result of this settlement will leave your client with a fund of approximately $65,000.00 from the escrow with which to complete construction on his home (in addition to the $22,000.00 worth of improvements already installed and for which he will not be required to pay). He can do so by contracting with George Schaffer or with any other contractor he choses. Mr. Mines had prepared an estimate of costs to complete the contract back in October, just before he was instructed to leave the project. He had estimated that the cost to complete at that time was in the range of$35,000.00 to $40,000.00. For that reason, I believe that it is important that I set forth Mr. Mine's proposal again, point by point. I. Mr. Mines agrees to do whatever work may be required by the Garfield County Building Department in order to secure the reissue of the C.O. for the Ramge residence. Mr. Mines has already been in contact with that department in order to detennine exactly what work is required. Their position differed significantly from the list attached to your May 7 Jetter. They have indicated that the following four matters are required (1) a complete kitchen; (2) a complete bathroom; (3) installation of handrails on all stairways as required by UBC; and (4) the outside must be re-graded to slope away from the structure. Mr. Mines is in the process of confirming this list with the Building Department. Mr. Mines is amenable to completing this work subject to the supervision and approvai of Schaffer Construction, as well as to the inspection approval of the Building Department. 2. Mr. Mines will agree to release any interest in the $75,000.00 sum now held in escrow (subject to Number 3, below). 3. The Ramges would agree to release approximately $10,000.00 out ofthat sum directly to Argento Tile to pay the cost of the kitchen countertop, after approval of installation by Schaffer Construction. 4. Mines will agree to verify to the Ramges that all of his subcontractors, laborers and materialmen on the Ramge residence have been paid in full. 5. Mines will agree to provide the names, addresses and telephone numbers of all his subcontractors who worked on the Ramge residence. He will not agree, however, to assign any contract rights on these subcontracts. 6. All of the above is specifically contingent upon a dismissal of the Ramge's claims against Land Title, which has in turn filed a 3ro party complaint against Mines. This quite simply is the quid pro quo for Mr. Mines commitments outlined above. If he will be required to continue in his defense in that lawsuit, there is no reason for him to continue as proposed above. 7. Mines further will not agree to any of the above except in return for a full mutual release and waiver between himself, his companies and the Ramges. Again, there is simply no reason to enter into the above commitments or to give up his right to collect approximately $97,000.00 from the Ramges otherwise. 8. As a result of 6 and 7 above, the Ramges will be required to accept all of Mr. Mines' work on their home "as is." I had provided original structural framing and foundation design information for this project in September of 1999 through Ward Associates Architecture and Planning for Mines Construction. In January of 2000, revisions to the lower level interior layout were made, including creating a single room below the great room. At that time. I provided a revised steel beam size to span across the space, eliminating a center· column. Revised column arid footing sizes were provided as well. The revised beam size specified is a W!Ox45, with a 3" diameter schedule 40 adjustable pipe column at the west end, and a choice of either a similar pipe column or a built-up 7-2x6 post in the exterior wall at the east end. The beam spans approximately 21 • -8 W' from column centerline to column centerline: The beam is approximately centered in the room, and wood '!'-joists spanning approximately 15'-6" to each side hang from the beam in a flush-framed condHion. At the site, I cut through the gypboard and plaster ceiling as instructed to verif'y that the correct framing members were installed. The correct beam and joists were in place, and the correct joist hangers were used and correctly installed. I verified that the beam spans the appropriate distance, and while I was unable to sec the columns hidden in the walls at either end, I saw no evidence to believe that they are not· in place as specified. The floor framing is designed to meet or exceed all code requirements for residences. As is our practice for residences of this caliber. more stringent deflection criteria than that allowed by code was used. The member sizes have been rechecked. I understand that this crack developed within the past two months, although structure has been complete and in its current state since last fall. Hardwood flooring had been previously installed over the concrete topping slab at the great room. and a gypboard ceiling covered with textured plaster had been placed directly on the bottom of the joists. Through the two openings I made in the ceiling, one ncar mid span and one near the west end of the beam, I observed that the crack follows a seam in the gypboard approximately 15" from and parallel to the south edge of the beam flange. The crack follows the length of the beam, tapering to a hairline at the ends, and exhibiting approximately 1/16" vertical displacement near mid span, indicating that the gypboard ceiling may not have been properly attached to the floor joists above. The gypboard is, as intended, not attached to the bottom of the steel beam. A gap of approximately !!.\'; exists between the bottom of the steel beam and the gypboard ceiling. Since no other apparent cause for the crack was observed, the crack appears to be directly related to the seam in the gypboard. In repairing the gypboard ceiling, care should be taken to fasten both edges of the gypboard, at the seam, to the bottom of the joists. and to tape the seam well. Adequate nailing of the gypboard ceiling along the joists on either side of the crack should also be verified. Added blocking between the joists along the seam may be desirable for continuous attachment of the drywall panel edges. The added blocking, however, will be quite cumbersome because it would involve removing and replacing a full gypboard panel width along one side of the searri. Adequate and complete information will prevent delays in the plan review process. Revi~wing a plan and the discovery that required information has not been provided by the applicant may result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor may be required to provide this information before the plan review may proceed. This causes delays because other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. H you do not. it may be helpful to obtain a book titled "DweUing Construction under the Uniform Building Code". This book is available to you through this department at our cost. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project. To provide for a more understandable plan in order to determine compliance with the building, plumbing and mechani£al codes, applicants are requested to review the following check list prior to and during design. BUIWING & PLANNING DEPARTMENT HAND DELIVERED As a result of a follow up inspection of the house at 0134 River Glen Road, Certificate of Occupancy No. 4072, it has been determined that the certificate of occupancy was issued in error, based on incorrect information being provided to the County Building Inspector during the final inspection of this structure on February 20,2001. Section 109.6 of the 1994 Uniform Building Code allows the building official to revoke a certificate of occupancy due to incorrect information being supplied at the time of the final inspection. At the time of the final inspection, Dan Williams, Garfield County Building Inspector, was told that certain items on the final inspection checklist would be completed.after he left and that the County Building Department could issue the certificate of occupancy based on those representations. On October 18,2001, Arno Ehlers, ChiefBuilding Inspector, inspected the residence at 0134 River Glen Drive and determined that a number violations of the 1994 Building Code exist due to incomplete work. Mr. Ehlers has recommended that the certificate of occupancy be revoked for this structure, until a final inspection is done and all items required for the issuance of certificate of occupancy have been completed. By this letter you are being advised that the Garfield County Building Department is revoking the issuance of Certificate of Occupancy No. 4072 due to incorrect information being provided to the County Building Inspector at the time of final inspection.
