The following items are required by Garfield County for a final Inspection:
I) A final Electrical Inspection from the Colorado State Electrical Inspector.
2) Permanent address assigned by Garfield County Building Department and posted at the
structure and where readily visible from access road.
3) A finished roof; a lockable building; completed exterior siding; exterior doors and windows
installed; a complete kitchen with cabinets, sink with hot & cold running water, non-absorbent
kitchen floor covering, counter tops and finished walls, ready for stove and refrigerator; all
necessary plumbing.
4) All bathrooms must be complete, with washbowl, tub or shower, toilet, hot and cold running
water, non-absorbent floors, walls finished, and privacy door.
5) Steps over three (3) risers, outside or inside must be must have handrails. Balconies and decks
over 30" high must be constructed to all IBC and IRC requirements including guardrails.
6) Outside grading completed so that water slopes away from the building;
7) Exceptions to the outside steps, decks, grading may be made upon the demonstration of
extenuating circumstances., i.e. weather. Under such circumstances A Certificate of
Occupancy may be issued conditionally.
8) A final inspection sign off by the Garfield County Road & Bridge Department for driveway
installation, where applicable; as well as any final sign off by the Fire District, and/or State
Agencies where applicable.
A CERTIFICATE OF OCCUPANCY (C.O.) WILL NOT BE ISSUED UNTIL ALL THE
ABOVE ITEMS HAVE BEEN COMPLETED.
A C.O. MAY TAKE UP TO 5 BUSINESS DAYS TO BE PROCESSED AND ISSUED.
OWNER CANNOT OCCUPY OR USE DWELLING UNTIL A C.O. IS ISSUED.
OCCUPANCY OR USE OF DWELLING WITHOUT A C.O. WILL BE CONSIDERED AN

Plans must include a floor plan, a concrete looting and foundation plan, elevations all sides with decks,
balcony, steps, hand rails and guard rails, windows and doors, including the finish grade line and
original grade. A section showing in detail, from the bottom of the footing to the top of the roof,
including re -bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation,
sheeting, house -rap, (which is required), siding or any approved building material. Engineered
foundations €nay be required.
A window schedule. A door schedule. A floor framing plan, a roof framing plan, roof must be
designed to withstand a 40 pound per square foot up to 7,000 feet in elevation, a 90 M.P.H. wind speed,
wind exposure B or C, and a 36 inch frost depth.
All sheets to be identified by number and indexed. All of the above requirements must be met or your
plans will be returned.
All plans submitted must be in compliance with the 2003 IRC, and 2006 IECC.

the property lines from each corner of the proposed structure(s) prepared by a licensed surveyor
and has the surveyors signature and professional stamp on the drawing? Properties with slopes of

If any required information is missing delays in issuing the permit are to be expected. Work may not
proceed without the issuance of a permit. if it is determined by the Building Official that additional
information is necessary to review the application and plans to determine minimum compliance with the
adopted codes, the application may be placed behind more recent applications for building permits in the
review process and not reviewed until required information has been provided and the application rotates

hereby requests permission and authority from the Board of County Commissioners to construct a driveway approach (es)
on the right-of-way off of County Road, 100, 300ft West of Blue Heron Lane, located on the North side of road for the
purpose of obtaining access to property.
Applicant submits herewith for the consideration and approval of the Board of County Commissioners, a sketch of the
proposed installation showing all the necessary specification detail including:
1. Frontage of lot along road.
2. Distance from centerline of road to property line.
3. Number of driveways requested

2) The applicant shall furnish all labor and materials, perforin all work, and pay all costs in connection with the
construction of the driveway(s). All work shall be completed within thirty (30) days of the permit date.
3) The type of construction shall be as designated and/or approved by the Board of County Commissioners or their
representative and all materials used shall be of satisfactory quality and subject to inspection and approval of the

DECLARATION OF EASEMENT, ROAD USE, UTILITY
AND MAINTENANCE AGREEMENT
This Declaration (the "Agreement") is made this 20th day of June, 2008, by Paul R.
Nieslanik and Celia R. Nieslanik (collectively referred to as "Nieslanik"), owners in fee of that
real property described as Parcels 1 and 2 of the Nieslanik Subdivision Exemption, County of
Garfield State of Colorado.
RECITALS
A. Nieslanik owns the real property more particularly described on the attached
Exhibit "A" incorporated herein by this reference, Town of Carbondale, County
of Garfield, State of Colorado (the "Property").
B. Nieslanik subdivided the Property into two tracts of land known as Parcels 1 and
2, Nieslanik Subdivision Exemption, Garfield County, Colorado (collectively the
"Parcels" or individually "Parcel 1" or "Parcel 2") as described on the Nieslanik
Subdivision Exemption Plat recorded as Reception No. 753019 in the records of
the Office of the Clerk and Recorder of Garfield County (the "Map").
C. The Nieslanik Subdivision Exemption was approved on March 17, 2008, by the
Board of County Commissioners of Garfield County, Colorado.
D. By this Declaration, Nieslanik desires to provide for the construction of a
privately dedicated road and installation of utilities located on the Nieslanik
Subdivision Exemption, for the grant and dedication of an easement for ingress
and egress to Parcel 1 as designated on the Map, and impose. on. Parcel 1, as
covenants running with the land, the obligation to maintain the access road.
In consideration of the mutual promises and covenants contained herein and other good and
valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Nieslanik
hereby grants and agrees as follows:
ARTICLE 1
ROAD AND UTILITY EASEMENT
1. Access Road and Utility Easement. Easements are hereby dedicated and ratified
to the Owner(s) of the Parcels described herein, as shown on the Map.
1.1
Access Road and Utility Easement. Subject to the terms, conditions, agreements
and restrictions of this Agreement, Nieslanik hereby grants and dedicates unto the
owner of Parcel 1, Nieslanik Subdivision Exemption, their heirs, successors and
assigns, a perpetual, non-exclusive easement and right-of-way twenty (20) feet in
width upon, over and across, that portion of Parcel 2, as shown on the Map, and as
attached hereto and incorporated herein as Exhibit A, for the use, benefit and

enjoyment of the Owner(s) of Parcel 1, their successors, assigns, agents,
employees, tenants, guests and invitees, for a private access roadway and utility
purposes (the "Access Road") subject to the terms, conditions and provisions
hereinafter set forth. The rights granted herein shall include the right to maintain
the Access Road as provided herein, and to transport on and over the Access Road
vehicles, materials, equipment, and other property as reasonably related to the
exclusive uses conveyed hereby. Such Access Road shall be the primary access
to Parcel 1.
1.2 Construction of Access Road. Upon the sale of Parcel 1, the Owner(s) of Parcel 1
will be responsible for construction of the Access Road. The road standards for
such construction will be the minimum necessary to comply with the Resolution
of Approval received from the Garfield County Board of County Commissioners
and the regulations of Garfield County, Colorado then in effect. The roadway
within the Access Road will be a minimum unobstructed width of twenty (20)
feet, although the road platform or road -bed may be less than twenty (20) feet
wide. All utilities will be installed underground within the Access Road.
Construction (including any permits and design requirements) of any utilities to
the Parcels (including any portion located within the Access Road) will be the
sole cost and expense of the Owner of the Parcel. The Owner(s) of Parcel 1 is
granted a temporary construction easement ("Construction Easement")
comprising an additional twenty (20) feet on the north side of the Access Road
easement granted above, for the purposes of construction of the Access Road and
utilities. Areas within the Construction Easement disturbed by the construction
will be revegetated within one growing season.
1.3 Maintenance of Access Road. The Owner(s) of Parcel 1 shall be responsible for
the repair and maintenance of the Access Road extending from the County Road
100 to the Parcel 1 improvements. The owner of Parcel 2 shall not bear any cost
or expense for the Access Road repair and maintenance except for the repair of
any damage caused by an Owner or lessee of Parcel 2 or their employees,
contractors, customers or invitees, which damage shall be repaired at the sole cost
and expense of the Owner(s) of Parcel 2.
1.4 Snow Removal. All such snow removal sufficient to allow access via four wheel
drive vehicles to have access over and across the Access Road by police, 4heriff,
fire protection, ambulance and other similar emergency agencies or persons, now
or hereafter providing emergency services to Parcel 1 shall be conducted
Owner(s) or the Owners' designated representative(s) at the expense of the

1.5 Restrictions. Use of the Access Road shall be restricted to access to and from
Parcel 1. The Access Road may not be used for the parking or storage of vehicles
or equipment. The Access Road is subject to the dedication of utility easements
set forth on the recorded plat of the Nieslanik Subdivision Exemption.
1.6 Utilities. Nieslanik hereby grant a perpetual, non-exclusive easement to use the
Access Road easement for the purpose of providing utility services to Parcel 1 or
for the repair, maintenance, removal or replacement of said utilities. All

instrumentalities, lines or facilities placed in the Access Road easement shall be
maintained in a safe condition by the respective utility company or governmental
agency. No grantee of a utility easement shall in the use, construction,
reconstruction, operation, maintenance, or repair of any utility in any way
unreasonably obstruct or delay of the use of the Access Road easement granted
herein.
ARTICLE II
ADDITIONAL PROVISIONS
1. Enforcement. The Owner(s) of either Parcel shall have the right to enforce, by
any proceeding at law or in equity, the agreements and covenants herein contained. Failure to
enforce any agreement or covenant shall not be deemed a waiver of the right to do so thereafter.
The party prevailing in any action for enforcement shall be entitled to recover all court costs,
including reasonable attorney's fees incurred.
2. Covenants Run With Land. The agreements, covenants, restrictions, conditions,
ease eats, and obligations herein contained shall be covenants that run with the land and shall
be bi ding on all persons having or acquiring any right, title, or interest in the above-described
Parc ls.
3. Amendment and Termination. The covenants and agreements herein contained
shall Continue in full force and effect until amended or terminated by written instrument executed
by th* owners of both Parcels.
4. Notices. Notice as hereinabove required shall be deemed delivered upon being
placed in the United States Mail, postage prepaid, and bearing the address of .the owner or
ownars as shown in the records of the office of the Assessor of Garfield County, Colorado.
5. Multiple Owners/Successors. Any reference in these Covenants to a Parcel
Own�r shall be deemed to include all Owners of such Parcel, collectively, and shall also refer to
all s cessors of such Owner or Owners.

6. Indemnities. The Owner(s) of Parcels 1 and 2, and their respective heirs,
succelssors and assigns (the "Indemnifying Owner") agrees to protect, indemnify and hold
harm ess the other party or Parcel Owner, and their respective successors and assigns (the
"Ind rnnified Owner"), from and against any loss, damage, claim or defense, against any and all
suits, claims, demands, expenses, losses, liabilities or damage of any kind or nature, including,
with ut limitation, reasonable attorneys' fees and costs, arising directly or indirectly out of any
claim of third parties asserted against the Indemnified Owner(s): (i) attributable to any conduct
of the Indemnifying Owner; (ii) relating to the use of the Access Road by the Indemnifying
Owner and its invitees and guests, whether authorized or not authorized; (iii) for claims due to
personal injuries or property damage caused by the Indemnifying Owner and its invitees and
guests; or (iv) due to mechanic's liens created by conduct or acts of the Indemnifying Owner.
• 7. Governing Law. The validity and effect of this Agreement shall be determined in
accoijdance with the laws of the State of Colorado.

8. Not a Public Dedication. Nothing contained in this Agreement shad be deemed to
be a gift or dedication of any portion of the property subject to or benefiting from it to or for the
general public or for any public purpose whatsoever, including, but not limited to, dedication as a
public street.
9. Severability. If any provision of this Agreement shall be invalid, illegal or
unenforceable, it shall not affect or impair the validity, legality or enforceability of any other
provision of this Agreement, and there shall be substituted for the affected provision a valid and
enforceable provision as similar as possible to the affected provision.
10. Exhibit Incorporated. The exhibit to this Agreement is incorporated herein and
made a part hereof as if fully set forth herein.
11. Compliance with Map and Resolution of Approval. Notwithstanding anything
herein to the contrary, all parties will strictly comply with the Map and the Resolution of
Approval as described herein.

Dear Mr. and Mrs. Crownhart:.
As requested by Mike Patch, a representative of Hepworth-Pawlak Geotechnical, Inc.
observed the excavation at the subject site on November 23, 2009 to evaluate the soils
exposed for foundation support. The findings of our observations and recommendations
for the foundation design are presented in this report. We previously conducted a subsoil
study for design of foundations at the site and presented our findings in a report dated
November 13, 2006, Job No. 105 194.
The proposed residence will he one story wood frame construction above a shallow
crawlspace. The foundation was designed for an allowable soil bearing pressure of 800
psf based on out previous report.
At the time of our visit to the site, the foundation excavation had been cut in one level
from 1 to 2 feet below the adjacent ground surface. The soils exposed in the bottom of
the excavation consisted of soft sandy silty clay. No free water was encountered in the
excavation and the soils were moist to very moist. The excavation base was free of frost
and snow at the time of our site visit.
The soil conditions exposed in the excavation are consistent with those previously
encountered on the site and suitable for support of spread footings designed for the
recommended allowable bearing pressure of 800 psf with some risk of settlement. Loose
and disturbed soils should be removed in the footing areas to expose the undisturbed
natural soils. The bearing soils should be protected from frost and concrete should not be
placed on frozen so . Other recommendations presented in our previous report which
are applicable shou also he observed.
