When reviewing a plan and it's discovered that required information has not been provided by the applicant, this will result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor shall be required to provide this information before the plan review can proceed. Other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. Also, please consider using a design professional for assistance iu your design and a construction professional for construction of your project. Any project with more than ten (1 0) occupants requires the plans to be sealed by a Colorado Registered Design Professional. To provide for a more understandable plan in order to determine compliance with the building; plumbing and mechanical codes, applicants are requested to review the following checklist prior to and during design. Applicants are required to indicate appropriately and to submit the completed checklist at time of application for a permit. Plans to be included for a Building Permit, must be on drafting paper at least 18"x24" and drawn to scale. Plans must include a floor plan, a concrete footing and foundation plan, elevations all sides with decks, balcony, steps, hand rails and guard rails, windows and doors, including the finish grade line and original grade. A section showing in detail, from the bottom of the footing to the top of the roof, including re-bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation, sheeting, house-rap, (which is required), siding or any approved building material. Engineered foundations may be required. A window schedule. A door schedule. A floor framing plan, a roof framing plan, roof must be designed to withstand a 40 pound per square foot up to 7,000 feet in elevation, a 90 M.P.H. wind speed, wind exposure B or C, and a 36 inch frost depth. All sheets to be identified by number and indexed. All of the above requirements must be met or your plans will be returned. All plans submitted must be incompliance with the 2003 IRC. I. Is a site plan included that identifies the location of the proposed structure or addition and distances to the property lines from each corner of the proposed structure(s) prepared by a licensed surveyor and has the surveyors signature and professional stamp on the drawing? Properties with slopes of 30% or greater must be shown on the site plan. (NOTE Section: 106.2) Any site plan for the placement of any portion of a structure within 50 ft. of a property line and not within a previously surveyed building envelope on a subdivision final plat shall be prepared by a licensed surveyor and have the surveyor's signature and professional stamp on the drawing. Any structure to be built within a building envelope of a lot shown on a recorded subdivision plat shall include a copy of the building envelope as it is shown on the final plat with the proposed structure located within the envelope. You have appealed a decision of the Chief Building Official based upon your assertion that Garfield County cannot enforce an "unwritten interpretation" of the various Garfield County codes to deny the request of Jeremiah Dancy for an amendment to a building permit. The denial was based upon Andy Schwaller's interpretation of regulations that prohibit bedrooms, showers and tubs in detached buildings. Your argument ignores the plain language of the International Residential Code and the Garfield County Zoning Resolution of 1978, as amended and the plain meaning of the word "attached'. Section Rl 04.1 of the International Residential Code adopted and amended by the Garfield County Board of County Commissioners in Resolution No. 2004-86 ("IRC"), states as follows: The Building Official is hereby authorized and directed to enforce all of the provision of this code . . . The Building Official shall have the authority to render interpretations of this code and to adopt policies and procedures in order to clarifY the application of its provisions. Such interpretations, policies and procedures shall be in conformance with the intent and purpose of this code. Such policies and procedures shall. not have the effect of waiving requirements specifically provided for in this code. The definitions in the IRC include the following: ACCESSORY STRUCTURE. In one (1) and two (2) family dwellings not more than three (3) stories high with separate means of egress, a building, the use of which is incidental to that of the main building and which is located on the same lot. B. Joseph Krabacber Page 2 July 2, 2008 BUILDING. Shall mean any one and two family dwelling. Minimum building ·dimension is (20) feet wide and (20) feet long. DWELLING UNIT. A single unit providing complete independent facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation, and having just one (1) kitchen. LIVING SPACE. Space within a dwelling unit utilized for living, sleeping, eating, cooking, bathing, washing and sanitation purposes. The purpose of the IRC, R101.3 is as follows: The purpose of this Code is to provide minimum requirements to safeguard the public safety, health and general welfare, through affordability, structural strength, means of egress facilities, stability, sanitation, light and ventilation, energy conservation and safety to life and property from fire and other hazards attributed to the built environment. The following definitions and regulations are found in the Garfield County Zoning Resolution of 1978, as amended (Zoning Resolution): Section 2.02.011 Accessory Uses: Incident only to a lawful use, any use, which complies, with all of the following conditions may be operated as an accessory use: (1) Is clearly incidental and customary to, and commonly associated with a lawful use; (2) Is operated and maintained under the same ownership and on the same lot as the lawful use: (3) Does not include structures or structural features inconsistent with a lawful use; and (4) Does not include residential occupancy except by domestic employees employed on the premises and the immediate families of such employees. Section 2.02.18 Dwelling: A building or portion thereof used for residential occupancy. Section 2.02.20 Dwelling, Single Family: A building, not classified as a mobile home, containing only one (1) unit. Section 9.01.02 Action by the Building Official: The Building Official shall utilize services of the Environmental Health Officer, County Planning Director and other county and state officials or agencies to arrive at a determination that MyFi!es\ZONfNG\GenCorr\Ltr to Krabaher B. Joseph Krabacher Page 3 July 2, 2008 the proposed building, facility, structure or use is in compliance with all applicable zoning, subdivision, building, health and sanitation regulations; and if the proposed building, facility, structure or use is in compliance, shall issue a permit for the improvements shown on the application; review of permit application shall normally be limited to ten (1 0) working days. When these provisions are considered together, the building official clearly has the ability to provide interpretations of these codes that further the purposes of the codes. A review of your client's plans for this "addition" shows clearly that there are (2) separate buildings, connected only by a covered walkway. The Building Official's interpretation of "attached" is consistent with the intent and purpose of both the IRC and the Zoning Resolution .. Mr. Dancy's property is in the PUD zone district a)?P~oved initially by Garfield County BOCC Resolution No. 85-207; as amended in Resolutiol'\frto.p-086; and the only allowed uses for his lot is single family residence. No accessory dwelling unit is permitted for that lot under the PUD \-. .. -/ zoning. There is no dispute that the primary use of the property is for a single family dwelling. "Residential occupancy," as used in the Zoning Resolutions definition of "Dwelling" is not defined, but is normally understood to include space for sleeping. Your letter makes clear that Mr.· Dancy has always intended that the detached garage include "sleeping quarters" for his family due to the family having outgrown the house. This additional bedroom is not an incidental use, it is part of the primary use, i.e. a single family dwelling. Under the Zoning Resolution, residential occupancy cannot occur in an accessory structure. Last fall the Building Department received a letter from the Stirling Ranch Design Review Board that included the following conditions, among others: 1) No ADU is allowed on Lot 9 .... 3) No bedrooms or overnight sleeping is allowed in the proposed new building. No showers or bathtubs are allowed in the proposed new building now, or in the future. Only a toilet and sink are permitted. (Per Garfield County Regulations). A copy of that letter is en~ed, and includes the signature of your client. Under all the definitions ~~d above, the primary use of a single family dwelling must be in "a building." Connecting w};;(t had been intended as and are obviously still (2) separate buildings, with separate heating, ventilating, plumbing, egress, foundation, etc., by what you describe as "an open-air covered connection" does not magically convert these two separate buildings into one building. While there is no definition of "attached" in these regulations, it is simple common sense that it means more than what your client chose to design. Joseph Krabacher Page4 July 2, 2008 advertise homes in Colorado with an "attached garage," would probably be misrepresenting the common understanding of "attached" if the home's occupants would have to leave their garage and walk through the open air to get to the house. Your recitation of cases with rules of statutory construction failed to include those cases which require giving words and phrases their commonly accepted and understood meaning, and avoiding absurd results, see, e.g., Town of Erie v. Eason, 18 P.3d 1271 (Colo. 2001). The meaning of "attached" in the Encarta Dictionary includes "touching another structure, sharing a wall with another building, and thus not standing alone." When you consider the intent of the Zoning Resolution, it clearly contemplates that residential uses occur in one building, not two separate buildings that require going out into the elements to get from one to the other.
