NARRATIVE REGARDING REQUEST In 2008, Applicant filed an application for a Special Use Permit to allow for a contractor’s yard on his property located at 0918 County Road 352. Resolution 2008-93 granting the approval is included in this application packet. Resolution 2008-93 included several conditions including condition #10 which reads: “This Special Use Permit is a personal permit, shall only be valid and in effect only while the subject property is owned by J. Bruce and Ann Dee Snode. Upon conveyance of the subject property to another party, this Special Use Permit shall be null and void, expiring on its own terms without revocation by the BOCC or relinquishment by the Applicant. This SUP does not ‘run with the land’.” This condition is inconsistent with the standard of the Garfield County Land Use Code at the time of the approval and continues to be inconsistent with the current Land Use and Development Code effective July 15, 2013. Section 2-106 states that the permit runs with the land. Minutes from the July 21, 2008 public hearing before the Board of County Commissioners reflect the following conversation: “Carolyn asked, as you all know the special use permit runs with the land, they are not personal to this owner….Commissioner McCown stated; and I can add a last condition which would be number (10) that this particular special uses permit would only be enforced as long as it is operated the owner that applied for it today.” Condition #10 was not included in the staff report prepared by David Pesnichak and was added at the public hearing by Commissioner McCown although it was inconsistent with the Land Use Code at the time. The minutes do not reflect the reasoning behind the addition of that condition. It is unclear why this unusual condition was set by Commissioner McCown. It is not consistent with Code or general practice of the County. Applicant desires to have the ability to sell his property with the benefit of the Special Use Permit continuing for a subsequent owner. The property is in an industrial area and such use is not inconsistent with the surrounding properties. The BOCC previously found that the Special Use Permit was in conformance wit the Garfield County Land Use Code and was in the best interest of the health, safety and welfare of the citizens of Garfield County. Applicant is not requesting any other amendments to the Special Use Permit. He intends to continue using the property consistent with and in compliance with the conditions of the Special Use Permit. He is not requesting any expansion of the use. BRUCE AND ANN DEE SNODE, DESCRIBED AS 0918 COUNTY ROAD 352, RIFLE, GAFIELD COUNTY AND OPERA TED BY HOGBACK TRUCKING PARCEL NO# 217918400418 WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"), has received an application from Bruce Snode for a Personal Special Use Pennit ("SUP") to allow a - Contractors Yard on the subject property within the Agricultural Residential Rural Density (ARRD) Zone District; and WHEREAS, the Board held a public hearing on the 21" day of July, 2008 upon the question of whether the above described Personal SUP should be granted or denied, at which bearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below; 1.) That the hearing before the Board of County Commissioners was extensive and complete and that all interested parties were heard at that meeting; 3.) The Application is in conformance with Garfield County Zoning Resolution ofl 978, as amended; 4.) That for the above stated and other reason, the proposed Special Use Permit is in the best interest of the health, safety and welfare of the citizens of Garfield County; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that a Personal Special Use Permit to allow a Contractor's Yard on property owned by Bruce Snode and operated by Hogback Trucking is hereby approved subject to compliance with all of the following specific conditions: 1. That all representations made by the Applicant in the application and as testimony in the public hearing before the Board of County Commissioners shall be conditions of approval, unless specifically altered by the Board of County Commissioners; 2. The Applicant shall comply with all standards as set forth in §5.03.08 "Industrial Performance Standards" of the Garfield County Zoning Resolution of 1978 as amended and included here as follows: a Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes. b. Every use shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located. c. Emissions of smoke and particulate matter: every use shall be operated so as to comply with all Federal, State and County air quality laws, regulations and standards. d. Every use shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision. e. No materials or wastes shall be deposited upon a property in such form or manner that they may be transferred off the property by any reasonably foreseeable natural causes or forces. g. Any repair and maintenance activity requiring the use of equipment that will generate noise, odors or glare beyond the property boundaries will be conducted within a building or outdoors during the hours of 8 a.m. to 6 p.m., Mon.-Fri. h. Loading and unloading of vehicles shall be conducted on private property and may not be conducted on any public right-of-way. i. Any storage area for uses not associated v.ith natural resources shall not exceed ten (10) acres in size. j. Any lighting of storage area shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property. 3. At no time shall the total number of vehicle storage associated v.ith this Contractor's Yard exceed five (5) tractor trailer semi trucks and seven (7) "Bobtail" trucks. All vehicle storage shall occur within the identified 21,000 square foot storage area at all times. 4. The total area to be used for vehicle storage shall not exceed 21,000 square feet and shall occur within the area identified by the Applicant in the Special Use Permit. 5. The Applicant shall obtain and abide by all access or driveway permits from the Garfield County Road and Bridge Department. 6. In order to control dust, the Applicant shall periodically treat the driveway and storage area with an approved dust suppressant. 7. All vehicles associated with this Special Use Permit must be licensed and in compliance with State and Federal requirements .. 8. As neither a plan for handling water runoff from vehicle washing nor a demonstration of adequate water rights have been submitted, no vehicle washing shall occur as a permitted use associated with this Special Use Permit. 9. The Applicant shall submit an updated site plan to reflect the representations as made to the Board of County Commissioners on July 21, 2008. This site plan shall be submit1ed for review by the · Planning Department prior to issuance of the Special Use Permit. 10. This Special Use Permit is a personal permit, shall only be valid and in effect only while the subject property is owned by J. Bruce and Ann Dee Snode. Upon conveyance of the subject property to another party, this Special Use Permit shall be null and void, expiring of its own terms without revocation by the BOCC or relinquishment by the Applicant.
