Your request involves adjustment to the lot lines for Lot 1 associated with a boundary Zine adjustment with your neighboring property owner. The original plat was recorded at Reception No. 518004 with the Garfield County Clerk and Recorders Office. Your property is located at 9755 County Road 113 and is known by Assessor's Parcel No. 2189-333-01-001. Your Application has been reviewed in accordance with the Administrative Review - procedures contained in the Land Use and Development Code as amended. Said provisions require a Decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. A decision is hereby issued regarding your Application for an Amended Plat for Lot 1 of the Petts Holmes Subdivision. The Director's Decision is to approve the Application including a finding that the application meets the requirements of the Garfield County Land Use and Development Code as amended and subject to the following conditions: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. All requirements from the County Surveyor shall be met prior to submittal of the plat for final execution. 3. The Plat shall be subject to final review and approval by the County prior to submittal of the plat for final execution. All standard plat certificates and signature blocks shall be included on the final plat. Minor edits and corrections as required by the County Attorney's Office and Community Development Department shall be made to the plat. 1 4. The following plat notes shall be added to the Plat: 4. The plat notes from the Final Plat of the Potts Holmes Subdivision recorded at Reception No. 518004 with the Garfield County Clerk and Recorder shall remain in full force and effect to the Lots contained in this Amended Plat. 5. The purpose of the Plat is the adjustment of the westerly property line of Lot 1, in accordance with a Boundary Line Adjustment Affidavit recorded at Reception No. with the Garfield County Clerk and Recorders Office. 5. All easements affecting Lot 1 shall be shown on the plat and the plat shall include reference to the Applicant's title insurance policy and all recorded encumbrances. 6. The Boundary Line Adjustment Affidavit shall be subject to review by the County Attorney's Office and required edits and corrections completed prior to recording. Said edits shall include any corrections to the associated Quit Claim Deed. The letter of explanation shall be recorded with the affidavit. Recording order for the affidavit and the plat shall be established by the County Attorney's Office. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on September 4th. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once all conditions of approval have been satisfied including editing of the plat and acquisition of all necessary signatures. Please note that you will have 90 days from the date of approval to submit a plat suitable for recording. Extensions of this time period may be requested prior to the expiration of the original time limit.
