front wall and the rear wall of the building as per definition. This elevation appears to be closer to 976 to
977 depending on the lateral location. The figure you represent (975) appears to be at the rear wall. In
comparing the existing elevations between your survey and the Mc Shane survey submitted to us today,
it appears both surveys reflect the same pre-existing elevations. A copy of this survey is available for
you to review.
Dick Hampleton, the architect for the Mc Shane project, did show us several options he will be
presenting to the owner for approval. One option radically alters the framing on the second floor
lowering the plate height for this floor and altering the roof framing to come within the building height
requirements. Other options could require a variance to be submitted to the county prior to any
approvals. Presently there are not any formal submittals to the county for us to review in closer detail;
but, it appears there could be an option that reduces the overall height of the structure substantially.
Once a amendment is submitted, it will be available for review. Prior to a C.O., we will require a
surveyor to verify the as built conditions meet the approved plans
Finally, the county's only requirement for all building permit applicants is that they meet the county's
zoning and building requirements, PUD zoning and/or plat notes . Typically, covenants and DRC review
are not the responsibility of the county to enforce.
We will contact you once an amendment is submitted by Mc Shane. Please call if you have any

Andy and Dave,
I understand that the Architect for Lot #13 at Stirling Ranch is coming in to meet with you.
He has been asked to contact the DRB regarding this issue and has not responded.
As I'm sure you are aware, this is not just a county matter. It is a Stirling Ranch Design Review
Committee matter as well.
There have been numerous mis-representations made to the Design Review Committee by the
architect and until they are resolved to the satisfaction of the DRB and the Stirling Ranch
Executive Board, there
exists no valid sign off by the board, which as you know, is required before the county can issue
(or re -issue) a building permit.
It is our contention that the house is out of compliance with the Stirling Ranch Design Guidelines
as well as the Garfield County height limit by roughly 7 FEET. (see South elevation below)
If you overlay the original "Lines in Space" topographic survey on the submitted site plan
(attachment #2) it is easy to see that the existing ground elevation in the middle of the South
elevation, beneath the 2 story section, is at elevation 975.00. (as marked)
If you project up 25 ft. you end up with a mark on the wall of the second floor at roughly 4'. 9"
above the finished floor. (1st attachment) •
The 3rd attachment shows the outline of the building on the un -manipulated topography.
This matter can not be fully resolved until the conditions of the DRB have been met.

In reviewing the plans, the stop work order is lifted for the areas of work to include the kitchen, dining, living room and
garage areas only. The stop work order is still in place for the main level master bedroom and 2nd level bedrooms
currently under review.

am the general contractor on the new residence for Mac McShane and Cynthia Calvin.
It is my understanding that a re -design of the second story of the house is underway to bring it into county compliance
as to the 25 ft height restriction.
I would like permission to continue work on the portion of the house that is in compliance, the living room, kitchen and
dining areas. Hayes Construction will perform no work whatsoever on the master wing of the house, main or second
floor, until the county has approved a plan to bring it into compliance, and re -issued a full permit.
