HomeMy WebLinkAboutLetter to the DirectorGarfield County Director, lam seeking a land use approval for an Accessory Dwelling Unit on the property located at 7330 County Rd. 100, Carbondale. I am doing this in a little of a backward fashion as we are seeking to have the existing residence be qualified as the ADU that is already built and completed on the property. This would allow us to build a primary residence on the property as well. Addressing the standards for the ADU, we meet the criteria under Section 7-801 in the land use code. A. The existing unit is less than 1500 sq. ft required. (shown on survey) B. There is no HOA. C. We shall be in compliance with the leasehold interest shall be for residential use only. D. The existing unit has already received a Certificate of Occupancy from Garfield County. The new proposed residence will meet all the standards within the building code requirements. E. The existing lot size is 21.427 acres. F. The existing residence already has a separate entrance. Under 4-5011 have all the items listed for submittal. Under section 4-502 1. Application form 2. Authorized Representative letter attached 3. Sole ownership. (copy of deed attached) 4. Fee (check attached) 5. Site (Recent survey done by licensed surveyor) 6. Erosion control plan. The driveway to the new proposed residence has been in place to the building envelope for several years.( Driveway permit attached). There are no existing or proposed water features of any kind. The building envelope is a postage stamp on the lot and the remainder of the lot will be left in existing natural state. 7. Landscape plan. The lot is only 21 acres. The landscaping will be minimal around new residence and is as is on existing unit. 8. Land Suitable analysis. The driveway already exists therefore no more impact on County rd 100. The lot does not have water rights or irrigation rights off any ditch. Also not in the flood plain. 9. Soils. A soils report and a perk test have been done by HP Geotech.(attached)1 have attached a copy of the existing well permit showing allowable use for two residences. Also a copy of water flow performed at well installation. 10. Natural Habitat. The existing habitat is open sagebrush, oakscrub forage to remain. No wetlands.The surrounding properties all have residences already built the deer and elk herds move through all of the existing areas year round. The majority of the property is to remain as is as not to impact any wildlife. 11. Impact Analysis. The impact is minimal on the surrounding properties as it is just one residence, same as surrounding properties. The ADU is down closer to the roadway as not to create a compound appearance. All adjacent properties range in size, but have remained rural in nature. The impact of this new residence is minimal to the area and can only be seen by a couple nearby homes. it will not impact any ground water flows or any effect on the environment. 12. Traffic. No impact 13. Nuisance. No more impact than any other neighbor. I have included everything necessary under the standards and think that this property meets all necessary requirements for the land use approval. Please let me know how to proceed.
