Pacific Standard Time From: jahavea@aol.com To: :sultan@vsss.com Hi Curt: We have been going back and forth on the unfinished work that Maya Construction was responsible for at my Colorado Property. (Please refer to the detailed email I sent on April 24, 2611). You were going to direct me on what to do. The headlines: • Garfield County is still asking for the completed engineers report (Ed Fronapfel is the engineer of record) for the pier installation -Maya construction is responsible for getting the sign off • Maya Construction (Saul Torres & Mike Woelke) are responsible for getting me documented guarantee an the pier installations, which they have never done & continue to rebuff any attempts on my part or the counties • I understand that Fronapfel's is now representing the builder and this presents a conflict of interest - and puts the situation at "logger -heads." • Maya Construction left the property in a complete state of disarray - creating additional damage - which in- turn,(if not taken care of) would have created a financial disaster for me. My Questions: 1. Will all of this be folded in & resolved as part of the umbrella litigation settlement? 2. What do E need to do to make sure that l am not left without the guarantees & sign offs that will be pivotal when I sell the house. am concerned that my unique issues may fall through the cracks. I want to make sure we are being proactive & do everything possible to protect my interests. What do you suggest? f=inally - as you know the petition I spearheaded on the overall infra -structure issues at Ironbridge fell to deaf ears -from all members of the board -- we have talked about filing suit against the•Board on my behalf as a disenfranchised stakeholder - is this still an option and-if•so,;when do we start the process? 1 look forward to your response to my specific concerns and if necessary setting up a time for us to talk about these matters and the status of the overall litigation. Thanks - Jim 70 irit-do. 1 Page 1 of 4 Subj: Re: Jim Vidakovich -- Property Repairs - Inspection Request Date: 4/24/2011 8:24:39 P. Maya construction never had the engineer sign off on the helical piering work that was done on my house last February.(2010) This was part of the settlement agreement (you have a copy in files [ sent) that Sunrise Development (Gosda - Hansen - Woelke) agreed to perform & then walked away before completing. The only thing they did complete was the pier installation. I have secured a copy of the plans & permit application they filed with the county - for the pier work - the engineer of record never signed off. 1 found out that engineer (per the stamp on the plans) is Ed Fronapfel from PIE_ The reason I called EA was that 1 was told (and remembered) Eileen Dornfest was also listed as a consulting engineer. I am attaching the email from Woelke & the Permit Application. RERSOLUTION: No one ever signed off on the pier installation. I need to have the engineer (Ed Fronapfel from PIE )sign off on the helical pier installation_ Other work that was done to rectify the damage they left behind, required another permit which cannot be closed until the engineer signs off on the installation of the helical piers. I was also going to send an email to Maya Construction (Which 1 believe has been named in the litigation) to take care of this issue since they are the contractor of record. Jim Wilson with the county called Saul Torres of Maya construction and told him this needed to be resolved. Can 1 send him an email? Here is Maya Construction Information: SAUL TORRES MAYA CONSTRUCTION INC. 586HWY133#150 - CARBONDALE, CO 81623 Email: Maya2005Ccn©yahoo.com Phone: 970-948-4024 Cell: 970-384-1400 FAX: 970-384-1405 Finally, as documented in the email from Woelke - GRIP-TITE Manufacturing CO is named as consulting engineer/training representative. I am not sure if this has any significance - here is there contact information: GRIP-TITE MANUFACTURING CO PO BOX 111 WINTERSET, IA 50273-0111 PHONE: 515-462-1313 In a message dated 4/22/2011 10:42:47 A.M. People Centered Management In response to your letter dated 4-23-12 (copy attached), here is an update: • Both myself & my attorney have made repeated attempts to get Saul Torres & Mike Woelke— Maya Construction (Contractors on Record) & Ed Fronapfel, (Engineer of Record), to resolve the situation regarding Permit Number 1406. • Contractors & the Engineer have been negligent by refusing to take action to mitigate this situation, which is clearly their responsibility. • Here is the contact information I have for Maya Construction: Saul Torrres/Mike Woelke Maya Construction 586 Highway 133 #50 Carbondale, CO 81623 Email: Maya2005con@yahoo.com Phone: 970-948-4024 • I am also enclosing copies of all correspondence relating to my efforts to get this resolved. Please note: Ed Fronapfel (Engineer of Record), PIE (Denver, CO) is also refusing to cooperate. (Noted and documented in emails). • It is clear, that all parties named (Maya Construction — Saul Torres — Mike Woelke — and Ed Fronapfel (PIE) have been negligent in their professional responsibilities & obligations to resolve this in a timely manner. • My counsel in California has requested that you release me from any retribution and or harm that has been caused by the negligence & inaction of above mentioned Contractors, Engineer and PIE. 3575 Cahuenga Boulevard West, Suite 200, Los Angeles, California USA 90068 t: (323) 876-5067 f: (323) 876-5068 Jim@TrainersInMotion.com www.TrainersInMotion.com • Understand that Mike Woelke/Maya Construction has been named in pending litigation filed by and on behalf of a group of Ironbridge Homeowners (including myself) for negligence on a variety of construction & building issues. Ed Fronapfel (PIE) has been retained by the same as an expert witness. • Furthermore, I am requesting that Garfield County Building & Permits Division file an official complaint against the listed parties, in accordance with Colorado Law, and that all parties — Contractors & Engineers - be reported to proper authorities in Colorado. • Please let me know what options Garfield County Division of Building & Permits can take to resolve this situation. • I am willing to cooperate with the County to get this resolved. As represented by this letter and attached documentation, I been diligent in trying to facilitate a resolution. It is clear that (aforementioned) contractors and engineer are acting in an irresponsible, unprofessional & negligent manner, which is the sole reason this issue has not be resolved.
