A RESOLUTION OF THE BOARD OF ADJUSTMENT OF GARFIELD COUNTY
APPROVING A VARIANCE FOR MINIMUM SETBACK, PROTECTION OF
WETLANDS AND WATERBODIES, FOR A PROPERTY LOCATED AT 1962 COUNTY
ROAD 132, A.K.A. MITCHELL CREEK ROAD IN SECTION 27, T5S, R89W OF THE
6111 P.M., GARFIELD COUNTY
PARCEL NO# 2119-273-00-013
Recitals
A. Ralph E. & Renae D. Besler Revocable Trust made an application to the Board of
Adjustment of Garfield County, Colorado, (the "Board") requesting the Board grant a variance from
Unified Land Use Resolution of 2008, §7-203 A.1. Minimum Setback, Protection of Wetlands and
Waterbodies.
B. The Ralph E. & Renae D. Besler Revocable Trust is the owner of real property as
identified in a Quitclaim Deed recorded at Reception No. 596423 in the Office of the Garfield
County Clerk & Recorder, more practically described as 1962 CR 132 (Mitchell Creek Road) and
encompassing an area of 1.184 acres and as identified in .
C. The subject property is contained within the Rural Zone District and issuance of the
requested variance will not effect the requirement for the parcel to comply with the zone district
standards contained within the Unified Land Use Resolution of 2008 (ULUR).
D. The Ralph E. & Renae D. Besler Revocable Trust specifically requests the Board grant a
variance from §7-203 A.1. of the ULUR which requires a minimum setback of thirty-five feet (35')
from the typical and ordinary highwater mark on each side of a waterbody, to fifteen (15') as
indicated by the building envelope identified in attached Exhibit A.
E. Garfield County is a legal and political subdivision of the State of Colorado, for which the
Board of County Commissioners is authorized to act.
F. The Board of County Commissioners of Garfield County has appointed the Garfield
County Board of Adjustment.
H. The Board of Adjustment conducted a public hearing on August 3, 2009, upon the
question of whether the requested variance should be approved, denied, or whether any action should
be taken on this matter.

1. Proper posting and public notice were provided as required for the meeting before the
Board of Adjustment.
2. The meeting before the Board of Adjustment was extensive and complete, that all
pertinent facts, matters and issues were submitted and that all interested parties were
heard at that meeting.
3. The above stated and other reasons, the proposed Variance has been determined to be in
the best interest of the health, safety, morals, convenience, order, prosperity and welfare
of the citizens of Garfield County.
4. The application has met the standards and requirements for Variance pursuant to Article
4; Division 3 of the Garfield County Unified Land Use Resolution of 2008.
RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment, Garfield County,
Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Variance from §7-203 A.1. Minimum Setback, Protection of Wetlands and Waterbodies
is hereby approved subject to compliance with the following conditions:
1. Construction of a single family home on the parcel shall comply with the building
envelope restriction attached as Exhibit A and that all activities related to construction of
the single family home occur inside of the designated envelope.
