The following items are required by Garfield County for a final Inspection:
1) A final Electrical Inspection from the Colorado State Electrical Inspector.
2) Permanent address assigned by Garfield County Building Department and posted at the
structure and where readily visible from access road.
3) A finished roof; a lockable building; completed exterior siding; exterior doors and windows
installed; a complete kitchen with cabinets, sink with hot & cold running water, non-absorbent
kitchen floor covering, counter tops and finished walls, ready for stove and refrigerator; all
necessary plumbing.
4) All bathrooms must be complete, with washbowl, tub or shower, toilet, hot and cold running
water, non-absorbent floors, walls finished, and privacy door.
5) Steps over three (3) risers, outside or inside must be must have handrails. Balconies and decks
over 30" high must be constructed to all IBC and IRC requirements including guardrails.
6) Outside grading completed so thatwater slopes away from the building;
7) Exceptions to the outside steps, decks, grading may be made upon the demonstration of
extenuating circumstances., i.e. weather. Under such circumstances A Certificate of
Occupancy may be issued conditionally.
8) A final inspection sign off by the Garfield County Road & Bridge Department for driveway
installation, where applicable; as well as any final sign off by the Fire District, and/or State
Agencies where applicable.
A CERTIFICATE OF OCCUPANCY (CO.) WILL NOT BE ISSUED UNTIL ALL THE
ABOVE ITEMS HAVE BEEN COMPLETED.

In order to understand the scope of the work intended under a permit application and expedite the
issuance of a permit it is important that complete information be provided. When reviewing a plan and
s discovered that required information has not been provided by the applicant, this will result in the
delay of the permit issuance and in proceeding with building construction. The owner or contractor shall
be required to provide this information before the plan review can proceed. Other plans that are in line
for review may be given attention before the new information may be reviewed after it has been
provided to the Building Department.
TWO (2) SETS OF CONSTRUCTION DRAWINGS & TWO (2) SITE PLANS MUST BE
SUBMITTEDFOR ALL APPLICATIONS.
Please review this document to determine if you have enough information to design your project
and provide adequate information to facilitate a plan review. Also, please consider using a design
professional for assistance in your design and a construction professional for construction of your
project. Any project with more than ten (10) occupants requires the plans to be sealed by a
Colorado Registered Design Professional.
To provide for a more understandable plan in order to determine compliance with the building, plumbing
and mechanical codes, applicants are requested to review the following checklist prior to and during
design. Applicants are required to indicate appropriately and to submit the completed checklist at
time of application for a permit.
Plans to be included for a Building Permit, must be on drafting paper at least 18"x24" and drawn
to scale.
Plans must include a floor plan, a concrete footing and foundation plan, elevations all sides with decks,
balcony, steps, hand rails and guard rails, windows and doors, including the finish grade line and

original grade. A section showing in detail, from the bottom of the footing to the top of the roof,
including re -bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation,
sheeting, house -rap, (which is required), siding or any approved building material. Engineered
foundations may be required.
A window schedule. A door schedule. A floor framing plan, a roof framing plan, roof must be
designed to withstand a 40 pound per square foot up to 7,00() feet in elevation, a 90 M.P.H. wind speed,
wind exposure B or C, and a 36 inch frost depth.
All sheets to be identified by number and indexed. All of the above requirements must be met or your
plans will be returned.
All plans submitted must be in compliance with the 2009 IRC, and 2009 IECC.
1 is a site plan included that identifies the location of the proposed structure or addition and distances to
the property lines from each comer of the proposed structure(s) prepared by a licensed surveyor
and has the surveyors signature and professional stamp on the drawing? Properties with slopes of
30% or greater must be shown on the site plan. (NOTE Section: 106.2) Any site plan for the
placement of any portion of a structure within 50 ft. of a property line and not within a previously
surveyed building envelope on a subdivision final platshall be prepared by a licensed surveyor
and have the surveyor's signature and professional stamp on the drawing. Any structure to be
built within a building envelope of a lot shown on a recorded subdivision plat shall include a
copy of the building envelope as it is shown on the final plat with the proposed structure located
within the envelope.

NOTICE OF VIOLATION - ZONING /BUILDING CODE
Dear Property Owner:
The Garfield County Building and Zoning Code Enforcement Officer has reason to believe a
possible violation may exist on your property located at 4618 CR 113 (Cattle Creek Road).
The Code Compliance Officer observed new construction without a permit on the property. This
new construction also appears to be within the thirty-five (35) foot buffer for water bodies. The
Garfield County Unified Land Use Resolution of 2008 as amended does not allow this activity
without a building permit or a variance from the buffer setbacks. Based on my observations the
construction activity on your property appears to be in violation of the Unified Land Use
Resolution of 2008 as amended.
You are hereby given notice, pursuant to Article XII of the Garfield County Unified Land Use
Resolution of 2008 as amended, that you must completely correct the violations or cease and
desist from continuing the violations within ten. (10) days of the date you receive this notice.
Under Article XII of the Garfield County Land Use Resolution of 2008 as amended, your failure
to correct or cease the violations on your property may result in one or more of the following
enforcement actions being taken against you:
1. Revocation of any building permits issued for improvements of the subject property;
2. Denial of additional land use approvals or building or other development applications
pertaining to the subject property;
3. Suspension of any land use approvals for the subject property;
4. Withdrawal of any development permits that are being violated;
5. Forfeiture of any vested property rights;
6. Criminal enforcement;
7. County court civil penalties; and
8. Civil lawsuit.
You have the right to appeal this Notice of Violation, pursuant to the provisions of the Garfield
County Land Use Resolution of 2008 as amended. Pursuant to Garfield County's Land Use
Resolution of 2008 as amended, Article XII, the county may pursue any of the available
enforcement procedures and penalties in connection with this violation.

Hi John,
In response to your setback questions; your property is located in the RURAL zone district, FRONT yard setbacks are 50'
from arterial streets and 25' from local streets. SIDE yard setback is 10' or 1/2 of building height, whichever is greater.

Well, well, well. A legal non -conforming structure may be replaced only in the event that damage occurs by causes
outside the control of the owner. As you can see from the section quoted by Fred below, the intentional removal ofthe
a legal non -conforming structure terminates any rights.
The guy will have to apply for a variance and make his case. Hopefully he can demonstrate that a legal non -conforming
structure existed and where on the site. Have him contact a planner to set up a pre -application conference.

Huh...your sentence does not make sense to me.
It was found that the replacement structure is larger, however the increased size of the structure does not increase the
pre-existing non -conformities.
Section 10-105(B): Structure Intentionally Damaged or Destroyed. The right to continue a nonconforming
land use terminates immediately when the structure containing that land use is damaged or destroyed by an
intentional act of the property or structure owner or their agent.

David and Gale are dealing with a gentlemen up Cattle Creek who removed a pre-existing non -conforming structure
(stream setback and front setback issues) and was issued a stop work order on construction of the replacement
structure. It was found that the replacement structure is larger, however the increased size of the structure does not
increase the pre-existing non -conformities. The potential problem is that the owner built a retaining wall to stabilize the
replacement structure and the retaining wall(s) is within the 35' stream setback.
§7-203 A.2. and 3. Lists the structures permitted and prohibited within that setback. Would a variance be required?

This letter presents the results of my engineering analysis performed for Steve Keohane for his
property located at 4618 Cattle Creek Rd. Mr. Keohane was issued a stop work order on July 15, 2010
for an accessory building being built without a permit. On July 27th, 2010 Mr. Keohane met with you and
Ms. Eastley for a Pre -Application Conference. The Pre -Application Conference Summary indicates that
Mr. Keohane must obtain a building permit for the accessory building and engineering approval of the
constructed slab -on -grade foundation.
Mr. Keohane provided SGM with sketches of the slab -on -grade foundation based on input from his
contractor - these are shown in Figures 1 and 2 on the following page. The calculated bearing pressure
under the thickened edge of the slab is approximately 850 psf using the following loads:
Roof Dead Load = 15 psf x 13.5' = 203 lb/ft
Roof Live Load (snow) = 40 psf x 13.5' = 540 lb/ft
Wall Dead Load = 10 psf x 8.0' = 80 Ib/ft
Tributary width for roof loads = 1/2 x 24' + 1.5' overhang = 13.5'
Assumed wall height = 8.0'
Based on these loads, the calculated bearing pressure of 850 psf is Tess than a typical, conservative
design value of 1000-1500 psf. Therefore, the slab -on -grade foundation should be considered
adequate to support the anticipated structural Toads.
To our knowledge, a geotechnical investigation was not performed prior to construction and we did not
observe the bearing soils before the slab concrete was poured. Additionally, we understand that frost
protection measures such as rigid insulation below the slab were not provided. Therefore, the potential
exists for future movement due to frost heave, swelling soils and settlement of unconsolidated fill
material. These movements could affect the performance of the building, but would likely not
compromise the structural integrity of the building unless the movements result in failure of the
foundation. Please do not hesitate to contact me if you have any questions or concerns regarding this
