• • BOCC 11/12/96 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: An exemption from the definition of subdivision. APPLICANT: Norman & Virginia Hunt LOCATION: A tract of land located in a portion of Section 34, T5S, R92W of the 6th P.M.; approximately three (3) miles northwest of Silt, along County Road 259. SITE DATA: 43.28 Acres WATER: Individual wells SEWER: Individual Sewage Disposal Systems (ISDS) ACCESS: Direct access to County Road 259 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in District D - Rural Areas/Moderate Environmental Constraints, as designated by the Garfield County Comprehensive Plan's Management Districts Map (1981; 1984). II. DESCRIPTION OF THE PROPOSAL A. Site Description: The subject tract is 43.28 acres in size, located approximately three (3) miles northwest of Silt, adjacent to the east side of County Road 259 (Jewell Lane). The tract is relatively level, irrigated agricultural land that has been actively engaged in hay production. Except for irrigation ditches, the tract is largely devoid of other improvements. 1 • B. Adjacent Land Uses: Adjacent land uses are generally agricultural and residential; however, the vicinity is slowly transitioning to a more residentially -oriented area. See vicinity map, page • 6 - C. Proposal: The applicants propose to subdivide, by exemption, the 43.28 acre tract into three (3) parcels, each approximately 14.4 acres in size. Although no specific development plans exist at this time, staff contemplates the parcels would eventually be developed as single family residential sites. See sketch map, page • low . III. MAJOR ISSUES AND CONCERNS A. Subdivision Regulations: Section 8:52 (A) of the Garfield County Subdivision Regulations states that "No more than a total of four (4) lots, parcels, interests or dwelling units will be created from any parcel, as that parcel was described in the records of the Garfield County Clerk and Recorder's Office on January 1, 1973, and is not a part of a recorded subdivision; however, any parcel to be divided by exemption that is split by a public right-of-way (State or Federal highway, County road or railroad), preventing joint use of the proposed tracts, and the division occurs along the public right-of-way, such parcels thereby created may, in the discretion of the Board, not be considered to have been created by exemption with regard to the four (4) lot, parcel, interest or dwelling unit limitation otherwise applicable;" The applicants obtained the tract in January, 1990, and it appears that in December, 1976, the parent tract was divided into two (2) tracts, each in excess of 35 acres. Therefore, based on this interpretation, it appears that this request complies with Section 8:52 (A) of the Subdivision Regulations and up to three (3), add' 'onal parcels may be created under the exemption regulations. See deeds, pages Ir•/ _. If approved, under current regulations, the parcels created may not be further divided by exemption. B. Zoning: The tract is within the A/R/RD zone district and all proposed parcels are in excess of the two (2) acre minimum lot size requirement. C. Water: The applicants propose individual wells as the water supply for the three (3) parcels. West Divide Water Conservancy District water allotment contracts have been issued and well permit applications have been made. See Contracts and Applications, pages /./' . The application also contains well yield information for wells that have been drilled in the area, indicating that well yield max be within a range of 7 gpm to 15 gpm. See well yield information, pages It 0 •t Based on this information, it appears that a physical water supply is likely to be found and adequate yields may exist. Staff recommends that prior to authorization of an exemption plat, the wells must be permitted, drilled and pump -tested with all information provided to the Planning Department for review. Additionally, staff recommends the water quality be tested by an independent laboratory for nitrate/nitrite and fecal coliform bacteria content. • • D. Soils/Sewer: The method of waste water trea`ment is proposed to be the use of individual sewage disposal systems (ISDS) and, according to the Soil Conservation Service, soils on-site are of the Arvada loam classification. This soil is typically deep and well -drained, and when used for building site development, it is considered to have moderate to severe constraints due to high clay content and a high shrink/swell potential. Likewise, when used for ISD systems the soil is considered to have severe constraints due to slow percolation. Staff recomn tends the inclusion of a plat note to address the soil limitations. E. Access: Access to the proposed parcels would )e directly from County Road 259, which borders the western side of the property. Staff contemplates no significant issues with the access; however, staff does suggest the applicant consult with Road and Bridge and receive any required driveway permits from the Department, prior to the authorization of an exemption plat. F. Fire Protection: The Rifle Fire Protection District has provided a letter stating the property is within its district and emergency response will be provided. The District notes that local water supplies may not be adequate to suppress a fire in its early stages. The District requests that all addresses be posted and consideration given to fire apparatus in the construction of driveways. See letter, page • �! Additionally, staff suggests the inclusion of the standard plat note addressing wildfire mitigation. G. Easements: All required easements for access, utilities, water supply, etc.,will be required to be shown on an exemption plat. H. School Impact Fees: The applicant will be requirec. to pay the $200 school impact fee ($400 total) for the creation of the exemption parcels. Potential Road Impact Fees: Upon adoption of a road impact fee, the lots created by this exemption will be subject to paying that fee; paid at time of building permit application, paid by the building permit applicant. This provision shall be included as a plat note. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was providecas required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. • • 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION Staff recommends APPROVAL of the application, pursuant to the following conditions: 1. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 2. A Final Exemption Plat shall be submitted, indicating the legal description of the property, dimension and area of the proposed lots, access to a public right-of-way, and any proposed easements for setbacks, drainage, irrigation, access or utilities. 3. That the applicant shall have 120 days to present a plat to the Commissioners for signature, from the date of approval of the exemption. The Board may grant extensions of up to one (1) year from the original date of approval. 4. That the applicant shall submit $200.00 in School Impact Fees, ($400.00 total) for the creation of the exemption parcels, prior to authorization of an exemption plat. 5. That the following plat notes be included: "The minimum defensible space distance shall be 30 feet on level terrain, plus appropriate modification to recognize the increased rate of fire spread at sloped sites. The methodology described in "Determining Safety Zone Dimensions, Wildfire Safety Guidelines for Rural Homeowners," (Colorado State Forest Service) shall be used to determine defensible space requirements for the required defensible space within building envelopes in areas exceeding five (5) percent grade." "Upon adoption of road impact fees by the Board of County Commissioners, the lots created by this exemption shall be subject to paying the fees, paid at time of building permit application, paid by the building permit applicant." "Soil conditions on the site may require engineered septic systems and building foundations. Site specific percolation tests at the time of building permit submittal shall determine specific ISDS needs on the site." "The individual lot owners shall be responsible for the control of noxious weeds." "No further divisions by exemption from definition of subdivision will be allowed." • • 6. That the recording fees for the exemption plat and all associated documents be paid to the County Clerk and Recorder prior to the signing of an Exemption Plat by the Board of County Commissioners and a copy of the receipt be provided to the Planning Department. 7 That the exemption plat submittal include a copy of a computer disk of the plat data, formatted for use on the County Assessor's CAD system. 8. That all proposed lots shall comply with the Garfield County Zoning Resolution of 1978, as amended, and any building shall comply with the 1994 Uniform Building Code, as adopted. The applicant shall consult with Road and Bridge and receive any required driveway permits, prior to final approval. 10. Prior to final approval Water-Reseetees; thiol as ' a blWKif1k1 and pump -tested for four (4) hours, with an opinion of the well driller stating the flow should be sufficient for the intended use(s). Additionally, the water shall be tested, by an independent laboratory, for nitrate/nitrite and fecal coliform bacteria content. All information shall be submitted to the Planning Department for review. 11. That the following provisions be included in the protective covenants governing the jexemption parcels: j�/7G3 4 dogwwill be allowed for each residential unit within an exemption and the dog ' " `S 1 shall be required to be confined within the owner's property boundaries, with enforcement provisions allowing for the removal of a dog from the area as a final remedy in worst cases. No open hearth solid -fuel fireplaces will be allowed anywhere within an exemption. One (1) new solid -fuel burning stove as defined by C.R.S. 25-7-401, et. seq., and the regulations promulgated thereunder, will be allowed in any dwelling unit.
