The Hunts have now assembled all of the requirements for submission of their Exemption Plat
to the Commissioners for signing, per the following comments re your letter dated June (should be
August) 6, 2001:
Representations: no action required.
2. Final Exemption Plat: Mylar and two copies attached: Your earlier comments re road
rights of way and applicability of plat notes to the parent parcel have been addressed. The
County Surveyor has verbally approved the Plat, but the mylar will have to be submitted
to him for signature (fee paid by Hunt, see receipt attached)
Final Plat to be submitted by 12/4/01: On 11/28/2001 (date left off of letter) an extension
to 1/14/2002 was requested.
School site acquisition fees: Paid by Hunt earlier.
Comply with County Zoning Regs and CDH standards: done
Mineral Rights Disclosure: See Plat Note
Well tests: Wells for Permit Nos. 231230 (South Well) and 231229 (north well) attached
have been drilled and tested. Well Permit No. 156816 is the long existing well on the
parent parcel and has been in use since applicants' acquired the property in 1977 (See
Registration of Existing Well in 1990 included in application)
1. 4hr pump test: Samuelson letters of 10/24/2001 and Well Test Reports for both
wells.

3. 4 hr pump test reports: see above. Samuelson recommended storage capacity of
1000 gallons per household in letter dated December 12, 2001. That requirement
has been added to the Well Sharing Declaration.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(II)(A) as the only well on a tract of land of 38.06 acres described as that portion
of the West 12, SW 1/4, Sec. 35, Twp. 5 South, Rng. 92 West, 6th P.M., Garfield County, more particularly described on the
attached exhibit A.
4) The use of ground water from this well is limited to fire protection, ordinary household purposes inside not more than
three (3) single family dwellings, the watering of poultry, domestic animals and livestock on a farm or ranch and the
irrigation of not more than one (1) acre of home gardens and lawns.
5) The maximum pumping rate of this well shall not exceed 15 GPM.
6) The return flow from the use of this well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
7) This well shall be constructed not more than 200 feet from the location specified on this permit.
8) This permit has been approved for the location as noted above. Footage distance from the South section line place the
well in the NW 1/4, SW 1/4 NOT SW 1/4, SW 1/4 as submitted on the application. You are hereby notified that you have the
right to appeal the issuance of this permit, by filing a written request with this office within sixty (60) days of the date of
issuance, pursuant to the State Administrative Procedures Act. (See Section 24-4-104 through 106, C.R.S.)

WELL SHARING DECLARATION: HUNT #2 EXEMPTION PLAT
This declaration made and entered into on 41/ aity , 2001, by NORMAN H.
HUNT and VIRGINIA E. HUNT, 5597 CR 233, Silt, CO 81652 (DECLARANT).
WHEREAS, Declarant is the owner of an exempt domestic water well, Permit No.
231229, located in T. 5 S., R. 92 W., 6th P.M., Sec. 35: NW1/4SW1/4 and Permit No. 231230
located in the SW1/4SW1/4 of said section; and
WHEREAS, Permit No. 231229 is intended to be the source of supply of domestic water
for Lots 1 and 4 of the Hunt #2 Exemption Plat, and Permit No. 231230 is intended to be the
source of supply for domestic water for Lots 2 & 3, all as more particularly described on the Plat
thereof recorded at Reception No.
THEREFORE, the Declarant states the following:
1. Permit No. 231229 is hereby allocated to Lots 1 and 4 in equal shares and Permit No.
231230 is hereby allocated to Lots 2 & 3 in equal shares..
2. Each party's use of said water shall be at their sole risk, cost, and expense. Declarant
shall have no liability for any defects in water quality or quantity.
3. Each user of said well shall be liable for a proportional share of all costs of operating,
maintaining and repairing said well and collection tank.
4. Each user shall be solely responsible for maintenance and repair of the service line
and pump from the well to their respective residences.
5. Each well user shall indemnify and hold the other users harmless against any damages
to themselves or others arising out of their use of said water and well.
6. Under no circumstances may any party use said water for any other uses other than as
allowed pursuant to the well permit and water right decree, if any.
7. Declarant shall have no liability for any variation or interruption in the water supply if
the production from the well is restricted or shut down for any reason.

8. Should the production from the well be insufficient to supply all of the needs of each
user shall be entitled to a proportionate share of the water produced from the well.

WHEREAS, Larry Spaulding petitioned the Board of County Commissioners of Garfield
County, Colorado, for an exemption from the definition of the terms "subdivision" and
"subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted April 23, 1984, Section 8:00 through 8:60
and for the division of a 40 acre tract as described in Book 354, Page 105, as filed in the Offices
of the Clerk and Recorder of Garfield County, Colorado, into four (4) exemption parcels of ten

WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating
domestic water on each of said parcels, that there is existing ingress and egress to said parcels,
that the location of septic tanks will be permitted by the Colorado Department of Health, that the
requested division is not part of an existing or larger development and does not fall within the
general purposes and intent of the Subdivision Regulations of the State of Colorado and the
County of Garfield, and should, therefore, be exempted from the definition of the terms
"subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as
amended; and

The Hunt Exemption #2 Plat is due to be signed by the BOCC on or before 12/4/01.
Finalization of the Plat, and water well drilling and testing have taken longer than expected.
The Hunts would like to request an extension to January 14, 2002 for signing of the Final Plat.
They do not expect to need this much time, but due to the holiday season, things may take
longer than expected.
Note: per your discussions with Mr. Hunt and Commissioner McCown, the following
changes are being made:
1. The extraneous lines along the west and north borders of the parcels, in CR 260 are
being deleted. Thank you for bringing this error to our attention. Attached is excerpt showing
changes being made. This is also being faxed to Don DeFord for his comments as well.
2. Samuelson Pump is being requested to specify the storage tank size they
recommend, per their storage recommendation. The Well Sharing Declaration has been
amended (copy enclosed) to require that the well pumps and storage tanks be installed by
Declarant, before sale of a lot.
3. The Plat Note excluding the Parent Parcel from being encumbered by the plat notes
will be removed and the drainage easement added to the Parent parcel.
