DANIELSON State Engineer We have reviewed the above referenced exemption request. This proposal is to create two lots from 7.33 acres. Our review of this proposal was con- ducted on the assumption that this parcel has not been associated with any previous exemptions since 1972. If this assumption is not correct, we must ask that the proposal be resubmitted for our review. The proposed water supply plan involves sharing the existing well (no. 124630) between the two parcels. This well is a late registered domestic well, constructed in 1959. Although we have no specific power to authorize expanded use of a late registered well, we would not think serving one more dwelling would result in material injury to vested water rights provided the area of lawn and garden irrigated is not significantly expanded. We would have no objection to approval of this exemption on this basis, provided the well was to be jointly owned and provision was made for easements and opera- tion and maintenance responsibilities. Optionally, we could make a new household use only well permit avail- able for the lot to be created provided the above assumption is correct.
