when the following prpceedings, among others were had and done, to -wit:
RESOLUTION NO. 83-19
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION
REGULATIONS FOR EDGAR AND SOCCORO HUNT.
WHEREAS, Edgar and Soccoro Hunt have petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption from the definition of the terms
"subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as
amended, and the Subdivision Regulations of Garfield County, Colorado, adopted
January 2, 1979, Sections 2.02.01 (d), and 3.02.01 for the division of a 7.33 acre
tract described as follows: That parcel of land as described in Document Number
294631 as filed in the Office of the Clerk and Recorder of Garfield County, Colorado
into 2 tracts of approximately 2.20 and 5.13 acres each, more or less, which proposed
divided tracts are more particularly described as follows:
TRACT A: A parcel of land situate in the SE14 NIA and SW4 NE1 of Section 6,
Township 6 South, Range 91 West of the 6th Principal Meridian, more
particularly described as follows:
Beginning at an iron post with a brass cap set in place by the Garfield County
Surveyor and properiy marked for the N1 corner of said Section 6; thence
S.07°16'11"W. 2015.86 feet to the TRUE POINT OF BEGINNING, being a
point in a fence as constructed and in place; thence N.79°42'54"E.
405.27 feet to a point on the westerly line of a ditch as constructed
and in place; thence along said ditch S.27°00'08"W. 82.48 feet; thence
S.35°46'45"W. 44.98 feet; thence S.21°51'42"W. 68.89 feet; thence S.65°
27'34"W. 67.24 feet; thence S.38°13'28"W. 65.22 feet; thence S.01°28'11"W.
24.53 feet; thence S.54°50'15"E. 77.03 feet; thence leaving said ditch
S.14°50'31"W. 220.69 feet to a point on the northerly right-of-way line
of a County Road as constructed and in place; thence along said right-
of-way line N.31°17'16"W. 96.71 feet; thence N.35°36'31"W. 60.64 feet;
thence N.38°22'11"W. 56.16 feet; thence N.44°33'45"W. 48.11 feet;
thence leaving said right-of-way line N.13°16'05" W. 259.27 feet along
a fence as constructed and in place to the TRUE POINT OF BEGINNING, con-
taining 2.20 acres, more or less.
Subject to an easement from said County Road for access and utility pur-
poses, being 20 feet in width at all points easterly of and parallel
to the following described line:
Beginning at an iron post with a brass cap set in place by the Garfield
County Surveyor and properly marked for the N14 corner of said Section 6;
thence S.07°16'11"W. 2105.86 feet to the TRUE POINT OF BEGINNING; thence
S.13°16'05"E. 259.27 feet to a point on the northerly line of said County
Road.
TRACT B: A parcel of land situate in Lots 2 and 3, the SE' N4% and Sill NE1 of Section
6, Township 6 South, Range 91 West of the 6th Principal Meridian, more
particularly described as follows:
Beginning at an iron post with a brass cap set in place by the Garfield
County Surveyor and properly marked for. the N1/4 corner of said Section 6;
thence S.00°33'33"E. 1496.69 feet to the corner common to said Lots 2
and 3, the SES NW14 and SW4 NE14; thence N.00°33'33"W. 207.91 feet along
the line between said Lots 2 and 3 to the TRUE POINT OF BEGINNING, being
a point in. a fence as constructed and in place; thence along said fence
N.63°04'26"E. 159.47 feet to a point on the southwesterly line of a ditch
as constructed in place; thence along said ditch N.78°01'30"E. 27.44 feet
thence 3.75°25'20"E. 51.84 fejt; thence S.25°44'26"E. 83.98 feet; thence
S.1.9°38`59"E. 141.08 feet; Lhnce S.26°42'56"W. 74.51 feet; thence S.02°
20'22"E. 93.98 feet; thence S.26°38'41"W. 63.31 feet; thence S.12°16'09"W.

thence leaving said ditch, 5.79°42'54"W. 405.27 feet to a fence as con-
structed and in place; thence along said fence N.03°16'34"W. 168.55 feet;
thence N.26°52'55"E. 118.80 feet; thence N.14°31'11"E. 123.77 feet; thence
N.31°36'05"E. 83.49 feet; thence N.27°18'49"E. 39.24 feet; thence N.
29°36'34"E. 12.87 feet; thence N.71°13'41"E. 43.25 feet; thence N.55°06'03"
E. 68.74 feet'; thence N.04°17'39"W. 128.73 feet; thence N.63°52'02"E.
40.94 feet to the TRUE POINT OF BEGINNING, containing 5.13 acres, more
or less.
Together with an easement from the County Road for access and utility
purposes, being 20 feet in width at all points easterly of and parallel
to the following described line:
Beginning at an iron post with a brass cap set in place by the Garfield
County Surveyor and properly marked for the N4 corner of said Section 6;
thence S.07°16'11"W. 2015.86 feet to the TRUE POINT OF BEGINNING: thence
S.13°16'05"E. 259.27 feet to a point on the northerly line of said County
Road.
Also, together with all ditch and water rights appurtenant to, used upon and
in connection with the above described property and an undivided one-half
interest in and to that certain water well issued Permit Number 124630 by
the Colorado Division of Water Resources, with one-half the water produced
therefrom.
Also, together with an easement, 15 feet in width, situate in the SE1 NW1
of Section 6, Township 6 South, Range 91 West of the 6th Principal Meridian
for the purposes of installing, repairing and maintaining a water line and well,
being 7.5 feet on each side of the following described center line:
Beginning at a point whence the N1 Corner of said Section 6 bears N.13°16'05"
W. 175.00 feet and N.07°16'11"W. 2015.86 feet; thence along said center
line S.38°22'11"W. 130.00 feet to the southerly end of said easement.
(in the State of Colorado and County of Garfield); and,
WuPREAS, the Petitioners have acinonctrated to t:: satisfacti... „t Lhe Board of
County Commissioners of Garfield County, Colorado, that there is a reasonable probability
of locating domestic water on each of said tracts, that there is adequate ingress and
egress to said tracts, that the location of septic tanks will be permitted by the
Colorado Department of Health, that the requested division is not part of an existing
or larger development and does not fall within the general purposes and intent of
the subdivision regulations of the State of Colorado and the County of Garfield, and
should, therefore, be exempted from the definition of the terms "subdivision" and
"subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended;
NOW, THEREFORE, BE IR RESOLVED that the division of the above described tracts "A"
and "B" from the above described 7.33 acre tract is hereby exempted from such definitions
and said tract may be divided into tracts "A" and "B", all as is more fully described
above, and said divided tract may be conveyed in the form of such smaller tracts
without further compliance with the aforesaid subdivision statutes and regulations;
provided, however, that this exemption is granted on the condition and with the express
understanding and agreement of the Petitioners that no further exemptions be allowed
on said tracts "A" and "B", and that a copy of the instrument or instruments of conveyance
when recorded shall be filed with this Resolution.
