BEFORE THE BOARD OF COUNTY COMIMISSIONERS OF
G'RFIELD COUNTY, COLORADO
RESOLUTION NO. 79-98
WHEREAS, Leland H. Hunter and Clarice F. Hunter have petitioned
the Board of County Commissioners of Garfield County, Colorado, for an
exemption from the definition of the terms ''subdiv i_.ion" and "subdivided
land" under C.R.S. 1973, 30-28-1D1(1D)(a)-(d), as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted January 2,
1979, Sections 2.02.21(d) and 3.02.01 for the division of a 4.02
acre tract described as follows: that parcel of land as described in Document
No. 296326 as filed in the Office of the Clerk and Recorder of Garfield
County, Colorado into 4 tracts of approximately 0.2112, 0.9475, 1.7255,
and 1.1297 acres each, more or less, whict proposed divided tracts are more
particularly described as follows:
Tract A: A portion of Lot 18, Section 10, Township 7 South,
Range 88 West of the Sixth Principal 1eridian, Garfield County,
Colorado, more particularly described as follows:
Commencing at an iron post end brass cep properly marked and
found in place for the Center South 1/16 Corner of said Section
10 (being the same as the S.E. Corner of said Lot 18), thence
N. 83°16'44"W. along the South Line of said Lot 18 907.70
feet to the True Point of Beginning; thence along said South
Line of Lot 18 N. 83°16'44" W. 208.49 feet to the S.W. Corner
of said Lot 18 (whence a brass cap Reference Monument to said
S.W. Corner, found in place, bears N. 34°47'55" E. 60.13 feet);
thence along the Northwest Line of said Lot 18 N. 70°02'42" E.
-196.55 feet; thence leaving said Northwest Line S. 13°42'20" E.
94.16 feet.to the True Point of Beginning; containing 0.2112
acres more or less.
Excepting from above the right-of-way of Cattle Creek County Road.
Tract 8: A portion of Lot 18, Section 10, Township 7 South,
Range 88 West of the Sixth Principal Meridian, Garfield County,
Colorado, more particularly described as follows:
Commencing at an iron post and brass cap properly marked and
found in place for the Center South 1/16 Corner of said Section
10 (being the same as the S.E. Corner of said Lot 18), thence
N. 83°16'44" W. along the South Line of said Lot 18 588.45 feet
to the True Pointof Beginning; thence along said south Line of
Lot 18 319.25 feet; thence leaving said South Line N. 13°42'20" W.
94.16 feet to the North Line of said Lot 18; thence along said
North Line N. 70°02'42" E. 10.57 feet; thence along said North
Line along a curve to the right, having a radius of 382.55 feet
and a central angle of 17°57'04", a distance of 119.85 feet;
thence along said North Line N. 87°59'46" E. 173.04 feet; thence
leaving said North Line S. 13°42'20" E. 165.96 feet to the True
Point of Beginning; containing 0.9475 acres more or less.
Excepting from above the right-of-way of Cattle Creek Road.
Tract C: A portion of Lot 18, Section 10, Township 7 South,
Range 88 West of the Sixth Principal Meridian, Garfield County,
Colorado, more particularly described as follows:
Commencing at an iron post and brass cap properly marked and found
in place for the Center South 1/16 Corner of said Section 10
(being the same as the S.E. Corner of said Lot 18), thence
N. 83°16'44" W. along the South Line of said Lot 18 206.65 feet
to the True Point of Beginning; thence along said South Line of
Lot 18 N. 83°16'44" W. 381.80 feet; thence leaving said South Line
N. 13°42'20" W. 165.96 feet to the North Line of said Lot 18; thence
along said North Line N. 87°59'46" E. 412.59 feet; thence leaving
said North Line S. 01°36'00" E. 220.43 feet to the True Point of

Tract D: A portion of Lot 18, Section 10, Township 7 South,
Range 88 West of the Sixth Principal Meridian, Garfield County,
Colorado, more particularly described as follows:
Commencing at an iron post and brass cap properly marked and found
in place for the Center South 1/16 Corner of said Section 10 (being
the same as the S.E. Corner of said Lot 18), the True Point of
Beginning; thence N. 83°16'44" W. along the South Line of said
Lot 18 206.65 feet; thence leaving said South Line N. 01°36'00"
W. 220.43 feet to the North Line of said Lot 18; thence along said
North Line N. 87°59'46" E. 211.90 feet to the N.E. Corner of said
Lot 18; thence S. 00°05'12" W. along the East Line of said Lot 18
251.94 feet to the True Point of Beginning; containing 1.1297
acres more or less.

WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that the proposed
division does not fall within the purposes of Part 1, Article 28, Title 30,
Colorado Revised Statutes 1973, as amended, for the reason that these parcels
of land will be joined with the present property owner's legal descriptions
and no new lots will be created; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado that the requested
division is not part of an existing or larger development and does not fall
within the general purposes and intent of the subdivision regulations of the
State of Colorado and the County of Garfield, and should, therefore, be
exempted from the definition of the terms "subdivision" and "subdivided land"
as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended;
NOW, THEREFORE, upon the motion of Larry Velasquez , seconded by
Dick Jolley , and carried, the division of the above described
tracts "A", "B", "C", and "D" from the above described 4.02 acre tract is
hereby exempted from such definitions and said tract may be divided into
tracts "A","B","C", 7 and "D" all as is more fully described above, and said
divided tract may be conveyed in the form of such smaller tracts without
further compliance with the aforesaid subdivision statutes and regulations;
provided, however, that this exemption is granted on the condition and with
the express understanding and agreement of the Petitioner that no further
exemptions be allowed on said tract "A", "B", "C", and "D", and that a copy of
the instrument or instruments of conveyance when recorded shall be filed with
this Resolution.
