Thank you for the referral for a proposed two lot subdivision exemption. The applicant
proposes to split a 40 acre parcel into t'wo parcels of 20 acres each. N; informatiorr on theproposed water supply for this project was included other than a copy of a well permit issued for
the subject parcel.
The State Engineer's office offers the following opinion for your consideration regarding
material injury to decreed water rights and the adequacy of the proposed water supply:
our information indicates a well was constructed on this parcel as a monitoring hole underfile no. MH-2747I, on September 22, lgg3. A well permit, no. 7TSO27, was issued for this
structure on Decemb er 6, 7993, as the only well on a 40 acre parcel described as the NE 1/4 of the
SE 1,/4 of Sec. 21, Twp. 7 South, Rng. 89 West of the 6th p.u. rhis permit allows the well to serve
up to three single furnily dwellings, irrigate one acre of home lawns and gardens, and water ther:se/s noncommercial dcrnesic aninnals.
If this well is to be shared between the naro parcels, we recommend the following in orderto assure that a permanent water supply will be available on an equitable basis to both lots:
A) The well should be located on an outlot owned in common by all property
owners using the well. Access to the well and the right to establish-and maintain
a pipeline shall be provided by easements where necessary.
B) The well should be jointly owned by the lot owners.
C) Recorded covenants and/or other mechanisms should establish a lot owners
association with powers to make decisions concerning management and operationof the well. A joint maintenance agreement is i required part of iuch an
association.

As an alternative, after the property is splig the domestic permit may be sunendered and
a household use only well permit can be obtained for each of the two parceli. The household use
only well permits can be used to serve one single family dwelling only. No outside use for lawn
and garden irrigation, or animals watering will be permitted. Plat notes should reflect these
limitations on well use. Additional well permits for either lot will not be available without a plan
for augmentation approved by water court.
Under culTent statutes and policies, the proposed water supply appe:rrs adequate, and there
is a presumption of no material inj.rry to decreed water rights. Stiouta you have further questions
or coilrments regarding the water supply for this project, please contact this office at the above
