APPLTCANT:James Irwin LOCATION:A tract ofland located in Section 21, T7S, R89W of the 6th PM, located adjacent to the Oak Meadows Subdivision, south of Glenwood Springs. SITE DATA:40 Acres WATER:Well SE[/ER:ISDS ACCESS:Access agreement from Sun King Drive (CR 168) EXISTING ZONING:A/R/RD ADJACENT ZONING:A/R/RD T. RELATIONSHIP TO THE COMPREHENSIYE PLAN The site is located in District D - Rural Areas Moderate Environmental Constraints as designated on the Garfield County Comprehensive Plan Management Districts'Map. II. DESCRIPTION OF THE PROPOSAL A.Site Dercrintion: The parcel is located adjacent to the Oak Meadows Subdivision, and improvements include a guesthouse approved^in September of 1993 (Resolution 93-089). A vicinity map is shown on page -->-, and a sketch plan of the proposed exemption is shown on page -6 - . fne+eeHean*+- Project Descrifrtion: The applicant is proposing split the fourth (40) acre tract into two (2) tracts of approximately 20.3 and 20 .5 acres in size (see sketch plan B. on page T-fu ) oo III. MAJOR ISSUES AND CONCFRNS A.Suhdivision Regulations. Section 8.52 of the Garfield County Subdivision Regulations state that "No more than a total of four (4) lots, parcels, interests or dwelling units will be created from any parcel, as that parcel was described in the records of the Garlreld county clerk and Recorder's office on January 1, 1973, and is not a part of a recorded subdivision; however, any parcel to be divided by exemption that is split by a public right-of-way (State or Federal highway, County roadorrailroad) ornatural feature, preventingjoint useofthe proposd tracts, and the division occurs along the public right-of-way ornatural feature, such parcels thereby created may, in the discretion of the Board, not be considered to have been created by exemption with regard to the four (4) lot, parcel, interest or dwelling unit limitation otherwise applicable; The property existed as an 82.3 acrelract on January lst of 1973 (evidenced by deed dated october 4,1972, Book 436, Page 263, Reception #255555). In !980, the 82 acre parcel was split into two (2) forty-acre tracts by an exerrption. Therefore, up to three additional lots may be requested by owrers of either 40 acre tract. Assuming the Board approves the exemption, only one ( I ) additional lot can be created through the exemption process . Zorttng. The parcels exceed the required two (2) acres millimrrm lot size for the A/R/RD zone district. Legal Access. The property currently includes an easement agreement from Edith Hornick which provides access to the proposed exemption parcels, as well as an additional 40-acre tract south ofthe Irwin parcel. The agreement, attached on page 1-tf allows for a 30-foot access easement, and recognizes the right for Irwin and the adjacent 40 acre tract to further subdivide through the exemption process. Staff does have concerns regarding the "gate" within the agreement and its potential impact on emergency access. Staff would suggest that emergency services be provided a key, or lockbox arrangement be formalized with Glenwood Springs Emergency Services. D Water and Sewer. The applicant has submitted a well permit that allows for three (3) single-family dwelling (see permit on page The applicant-tL - received approval for a guesthouse on Lot l, and intends on constructing a primary dwelling unit on the property. Based on the existing permit and Mr. Irwin's plans, Lot2 would not have adequate water rights for a single-family dwelling unit and a guesthouse. staff suggests that a plat note be added indicating that the well permit only allows one dwelling unit. The State Engineer's Office has not responded to the application. Sewer will be provided by ISDS. The approved guesthouse on the property has been issued an ISDS permit, and percolation rates were adequate for a conventional leach f,reld (1" in 27 minutes). Based on the relative distance and consistent soil types on the property, ISDS appears to be feasible on both exemption parcels. B. C. 2 o o E.State and Local Health Standards. No State or Local health standards are applicable to the application, with the exception of Colorado Department of Health ISDS setback standards, which should be verified at the time of building permit submittal. Drainage. No drainage easements appear to benecessary, but should be verihed on the field by the applicant's surveyor. Fire Protection. The applicant did not submit approval from the Glenwood Springs Fire Protection District. Staff suggests that this become a condition of approval. H Easements. Any required easements (drainage, access, utilities, etc..) will be required to be shown on the exemption plat. Staff notes that if the applicant intends on sharing the existing well, appropriate easements must be shown on the plat, and adequate rights to the well will have to be filed with the deeds for each parcel. School Imnact Fees The applicant will be required to pay the $200.00 impact fee prior to the approval of the frnal plat. Natural Hazards. Staffreferenced the Lincoln - Devore Laboratories Natural Hazards Mapping for the site. The proposed exemption is located within an area identified as having severe constraints for ISDS, due to potentially slow percolation rates. However, perc rates associated with the guesthouse were acceptable. fv K. Floodnlain. The parcel is not located within any regulated floodplain. SUC'GESTEI-I FINDINGS I That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION StaffrecommendsAPPROVALoftheapplication, subject tothefollowingconditions: That all representations of the applicant, either within the apptcation or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. J 2. 3 I 3 oo 3 4 2.A Final Exemption Plat shall be submitted, indicating the legal description of the property, dimension and area of the proposed lot, access to a public right-of- way, and any proposed easements for setbacks, drainage, irrigation, access or utilities. That the applicant shall have 120 days to present a plat to the Commissioners for signature from the date of approval of the exemption. That the applicant shall submit $200.00 in School Impact Fees for the creation of the exemption parcel. 5. That the following plat note shall appear on the Final Exemption Plat: "The existing well pennit precludes a guest house on Lot 2.
