GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10) (a) - (d) as
amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17 (d) and 3.02.01, the undersigned Arthur C. Hyde
respectfully petitions the Board of County Commissioners of
Garfield County, Colorado, to exempt by resolution a commercial
zoned lot on Rte. 133, North of Carbondale, Garfield County
more fully hereinafter described, from the definitions of
"subdivision" and. "subdivision land" as the terms are used and
defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the
Garfield County Subdivision Regulations, for the reasons stated
below:
To create for immediate sale the herein described lot.
Submitted at Glenwood Springs, Colorado, this 17th day

Please regard this letter as official response from the
Carbondale Planning & Zoning Commission recommending that you
deny the request for exemption from subdivision regulations
which was submitted by Mr. Arthur Hyde.
The Planning Commission voted unanimously to request
rejection primarily due i:o lack of justification and absence
of information relating to future plans for utilization of
the site.
'Carbondale : usL-ifiably feels a great concern for the future
use of land parcels Adjacent to Hiclhkqay 133 between the existing
city limits and Highway 82. We hope that in cooperating with
Garfield County, no further degradation of the north entrance
to the town will take place and, in fact, that good planning
and land use practices will prevail and the area will be upgraded.
Thus our recommendation for denial of the exemption request is
based upon a genuine determinatigtn to achieve the;: -•-goal mentioned
above in a practical fashion.

LEGAL DESCRIPTION:
A tract of land located in Lot 2, Section 33, T7S, R88W
of the 6th P.M. containing one half an acre, more or less,
more fully described as follows:
Beginning at a point on the Westerly right-of-way line of
Colorado State Highway No. 133 at a point common to the
property belonging to the Public Service Co. bearing S.
81°31'30" W. 156.10 feet to a point on the Northeasterly
right-of-way line of the Denver and Rio Grande Western
Railroad;
thence N 33°07'25" W. 123.47 feet along said Northeasterly
right-of-way line;
thence N 01u16'00" W 17 feet;
thence N 88°44'00" E 220.00 feet to a point along the
Westerly line of the right-of-way line of Colorado State
Highway No. 133;
thence S 01016' E 100 feet Southerly along the Westerly line
of Highway 133 right-of-way line to the point of beginning
containing one half an acre, more or less.
