BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
RESOLUTION
WHEREAS, I Arthur C. Hyde, have petitioned the Board of
County Commissioners of Garfield County, Colorado, for an
exemption under C.R.S. (1973) Section 30 -28 -101(10)(a) -(d) as
amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17(d) and 3.02.01, for the division of 3.072 acre
tract into two (2) tracts, subject tract being approximately
one-half acre, more or less, and more particularly described
as follows:
A tract of land located in Lot 2, Section 33, T7S, R88W,
of the 6th P.M. containing one-half acre, more or less,
more fully described as follows:
Beginning at a point on the Westerly right-of-way line of
Colorado State Highway No. 133 at a point common to the
property belonging to the Public Service Co. bearing S.
81°31'30" W. 156.10 feet to a point on the Northeasterly
right-of-way line of the Denver and Rio Grande Western
Railroad;
thence N 33°07"25" W. 123.47 feet along said Northeasterly
right-of-way line;
thence N 01°16'00" W 17 feet;
thence N88°44'00" E 220.00 feet to a point along the
Westerly line of the right-of-way line of Colorado State
Highway No. 133;
thence S 01°16' E 100 feet Southerly along the Westerly
line of Highway 133 right-of-way line to the point of
beginning containing one-half acre, more or less.
WHEREAS, The Petitioners have shown to the satisfaction of
the Board of County Commissioners of Garfield County, Colorado,
that they desire said exemption for the purpose of creating an
additional commercial tract for immediate sale, and;
WHEREAS, Petitioner has demonstrated to the satisfaction
of the Board that there is a reasonable probability of locating
of locating domestic water on the saidtract, that there is
adequate ingress and egress to said tracts, that the location
of septic tanks will be permitted by the Colorado Department
of Health, that the requested division is in accordance with the
general purposes and intent of the subdivision regulations of
the State of Colorado and the County of Garfield andshould
therefore be exempted from the definition of the terms
'subdivision" and "subdivided land" as set forth in C.R.S.
(1973) Section 30 -28 -101(10)(a) -(d) as amended;
NOW THEREFORE, upon motion of , seconded
by and unanimously carried said three acre
tract of land is hereby exempted from such definition and transfer
of said tract may be made by division into two tracts, one of
approximately one-half acre, more or less, all as is more
fully described in the Petition pertaining hereto. A copy of
the intrument or instruments of conveyance when recorded shall
be filed with this Resolution.
