PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned
MARK J. IDDINGS and JAMES S. MASON respectfully.
petitioners the Board of County Commissioners of Garfield County, Colordo, to
exempt by resolution the division of 3.03 acre tract of land into two
tracts of approximately 1.1 and 1.2 acres each, more or less, and
which tract to he subdivided is more particularly described as follows:

from the definitions of "subdivision" and "subdivided land" as the terms are used
and defined in C.R.S. (1973) Section 39-28-101 (a) -(d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
The subdivided parcel is split by a public right of way, County Road No. 154
preventing joint use of proposed tracts and the division occurs along that
public right of way
In support of this petition, the petitioner also submits the following:

(c) Vicinity map
(d) State on source of domestic water

Dear Sirs:
The following petition is in regard to our property just south
of the Old Hardwick Bridge, which is divided by County Road 154. We
feel the subdivision of this property is a reasonable request since
the total size of the tract is over 3 acres and the resulting lots
would be similar in size and conform to the surrounding neighborhood.
Presently, we feel that the lower piece is a burden to the
upper tract for several reasons. The first being that crossing this
road to the lower piece or vice versa is somewhat dangerous with the
heavy truck traffic in this area. The second being the fact that
many people currently use the lower tract for recreational purposes
and the result is illegal parking which is a traffic hazard, and an
excessive amount of littering. This problem is practically unavoid-
able unless one were to install a barbed wire and prosecute trespassers
which would be a full time job for the landowner and the County
Sheriff and perhaps not in the best interest of the neighborhood.
Splitting the parcel as the road does would allow us to build a
single family residence on the lower riverside parcel. Thus, being
a homesite this property could be more easily maintained and enjoyed
by the homeowner and the public would realize that this is not a park.

Due•to the large area of the land, we feel it would be best used as
two smaller durlex sites rather than one large fourrlex site. Thus
density would not be increased and the lots would conform with the
others nearby.

Dear Mr. Baldwin:
Our original letter of September 20, 1979 was in error due to
an incorrect location. Since this property is on the Roaring Fork River,
individual domestic wells could be permitted and we recommend approval
of the Iddings Exemption.

Dear Mr. Baldwin:
We have reviewed the above referenced application for exemption.
The wells proposed as the water supply would intercept ground water which
is tributary to Four Mile Creek, an over -appropriated stream. Since new
wells would increase the injury to senior vested water rights, well permits
cannot be issued by this office and we cannot recommend approval of the
Iddings Exemption.
