Dear Mr. Schmueser:
GARFIELD CO. PLANNER
A request has been directed to this office concerning an
additional water tap and sewer service to property owned
by Mr. Fred Rnglehart on South Grand Avenue for purposes
of meeting requirements for subdivision of that property.
Execution of the attached development agreement by Mr.
Englehart will constitute qualification for an additional
water service tap and access to the sewer system of the
City. Final plans for any improvement will require
approval by the City Council prior to commencement of any
construction. The executed development agreement must be
recorded as a part of any documentation allowing for lot -
split or platting of an additional development site.
We trust that this procedure will allow for the platting
of an additional building site subject to the installa-
tion of water and sewer service prior to development. If
we can be of further service, please do not hesitate to
contact us.

AGREEMENT FOR FURNISHING WATER AND/OR SEWER
THIS AGREEMENT dated this

WITNESSETH:
WHEREAS, Owner is the owner of real property described
on Exhibit A attached hereto, and
WHEREAS, Owner desires to have the City provide
water and sewer service to said property.
NOW, THEREFORE, it is agreed as follows:
1. Owner shall submit to the City evidence satisfactory
to the City as to the ownership of the property described on
Exhibit A hereof. 100% of the owners of such property shall
be signatories hereto.
2. Owner shall furnish to the City engineered plans
.for the installation of such water and sewer service. Such
plans shall conform in all respects to the Municipal Code
and rules, regulations and specifications of the City.
3. The Owner shall construct and install all lines
and appurtenances necessary to provide such water and sewer
service and as necessary to connect the same to existing
City facilities.

5. All facilities shall be inspected by the City
for conformity with the Municipal Code, rules and regulations
and approved plans and specifications and the Owner shall
correct any deficiencies in any installation specified by
City.
6. As -built engineering drawings shall be submitted
for all installations upon completion and prior to the furnishing
of services hereunder.
7. All water and sewer service shall be furnished
in conformity with the Municipal Code and ordinances from time
to time ordained by the City and Owner agrees to be bound thereby.
8. By execution hereof, Owner covenants and
agrees to apply for or consent to the annexation of the
territory described on Exhibit A attached hereto at such
future time as such territory, or any part thereof, shall
become eligible for annexation pursuant to the statutes of
the State of Colorado. It is specifically understood and
agreed, however, that the City shall not be obligated to
accept such territory, or any part thereof, for annexation
and that any annexation shall be at the sole discretion of
the City and upon such terms and conditions as shall be
determined by the City.
9. The terms and conditions hereof shall extend
to the parties hereto and be binding upon the successors and
assigns of City and the heirs, devisees, personal representatives
and assigns of owner.

MEMORANDUM OF AGREEMENT
WHEREAS, on date hereof the parties hereto executed
a document entitled "Agreement for Furnishing Water and
Sewer" wherein the City agreed to provide to owner water and
sewer services to the territory more particularly described
on Exhibit "A" attached hereto and by this reference made
a part hereof, and
WHEREAS, the said Agreement further provides that
Owner agrees to apply for or consent to the annexation of
the territory described on Exhibit A hereof, or any portion
thereof, at such future time as such territory, or any portion
thereof, shall become eligible for annexation pursuant to the
statutes of the State of Colorado.
It is agreed that this Memorandum of Agreement is made
in conformity with the provisions of C.R.S. 1973, 31-8-121.

Re: Senate Bill .35 Exemption

Gentlemen:
We have reviewed the proposed exemption and find it in compliance
with the Garfield County exemption procedures.
The City of Glenwood Springs has provided certain conditions
concerning water and sewer services to this lot. These conditions
must be agreed to and adhered to by Mr. Ingelhart. (See: City of
Glenwood Springs' letter dated May 6th under the signature of
Roy Rainey.)
With these conditions being added to the resolution, we would
recommend approval.

RE: Letter of Feasibility for Sewage Disposal
Gentlemen:
Based on the information received by this office and past
experience with sewage disposal facilities in the immediate
area of the proposed exemption, it has been determined by this
Office that on -lot sewage disposal facilities are both feasible
and practical, commensurate with both county and state regula-
tions, provided that proper permits are obtained prior to con-
struction.
It should be further noted that due to the following con-
ditions

be acceptable:
standard septic tank and absorption field
septic tank -dry well
