Response time for fire apparatus from the Carbondale Fire Stat ion
would be approximately 15 to 20 minutes on good roads.

apparatus. (approximately 5000 gallons)

Dear Mr. Hunt:
I am writing to you concerning a recent inspection of your
property on Cattle Creek near the Town of Carbondale, in Garfield
County, Colorado.
During this inspection, we identified portions of this
parcel which are "waters of the United States." These "waters"
include Cattle Creek, a narrow band of riparian wetland
immediately adjacent to Cattle Creek, and a beaver pond/wetland
complex located at the most eastern portion of the parcel.
You stated that your plans for the parcel were to subdivide
it into smaller 20-30 acre lots for later sale. We indicated
that our primary concern involves the potential of a future
property owner wanting to drain, fill, cross, or otherwise modify
the beaver pond/wetland complex on the easternmost lot. In light
of this concern, we recommend that you identify and delineate
this wetland area on the plat for this lot and label it as
"Wetland - Regulated by the Corps of Engineers."

Dear Mr. Hunt:
We have learned that you are preparing to subdivide and
develop a parcel located adjacent to Cattle Creek near the Town
of Carbondale in Garfield County, Colorado. We understand that
portions of this parcel contain wetlands and other "waters of the
United States" which are subject to our regulatory jurisdiction.
You should be aware that the Corps of Engineers regulates
certain activities in "waters of the United States" under Section
404 of the Clean Water Act. "Waters of the United States"
include the territorial seas, perennial and ephemeral streams,
their lakes and impoundments, and wetlands. Federal law requires
that any individual or entity proposing to discharge dredged or
fill material into "waters of the United States" obtain a
Department of the Army permit prior to commencing such a
discharge. Our records indicate that you do not have a
Department of the Army permit authorizing a discharge of fill
material into "waters of the United States."
I strongly recommend that you contact this office to arrange
an on-site inspection to ascertain the extent of "waters of the
United States" on this parcel. At that time, we will be in a
position to inform you whether a Department of the Army permit
will be required.

convenience to arrange an inspection. Should you have questions,

On October 2, 1989 I attended a County Commissioners
meeting. During this time 1 became aware of some property on
Cattle Creek, approximatly tour miles off Highway 82. This
area contains many ponds and wetland areas. Et is my understanding,
t•.hat if the Corp Of Engineers does not notify the owner/seller
and Garfield County Commissioners of this "riparion" area,its
rules and permits concerning its protection and/or change,
(ie: 404 permit) there is little that can be done without going
through some serious litigation.
At this time I request that you make an on site visit and
send a letter to the property owners concerning this problem.
I would also like a copy of this so I can formally submit this
to the next Commissioners meeting, so all "buyaers beware" that
they must help protect the environment they are purchasing.
I appreciate your action on this and I trust that i will
hear from you soon.

REF: Environmental Impact Assesment for Proposed Carbondale Cattle
Creek( County Rd 113) Development
Dear Mr. McNure:
The Agenda of the Garfield County Commissioners meeting of October 2
included a proposal for an approval of a seven lot sub-divison sale and
development of an approximately 100 acre parcel on County Rd 113, in
Carbondale. Discussion on this agenda item was postponed until November 6
pending notification of adjacent property owners.
The owner and potential seller of this property is J.R. Hunt of 14913
Highway 82, Carbondale, Co 81623.
The area in question includes numerous ponds and wetlands and is
potentially subject to injurious environmental impact should this
development proceed without appropriate guidelines, rules and permits
guaranteed by the seller of the parcel and future buyers of the property lots.
I would like to request that you make a site visit and preliminary assesment
of the potential environmental impact of this proposed development and
notify the Seller and County Commissioners of your findings prior to the
scheduled November 6 meeting. I would also appreciate receiving a copy of
your letter.

Re: Water Supply for Proposed Subdivision Exemption;
Cattle Creek
Dear Dick:
At your request, I have reviewed the water rights engi-
neering report prepared by Enartech, Inc. dated August 30, 1989,
as well as your Water Right Agreement and License entered into
on July 26, 1989, with the Carbondale Land Development Company.
At your request, I will be filing the appropriate Water Court
applications necessary to implement a legal water supply for
your proposed subdivision exemption of seven lots to be located
on Cattle Creek, more particularly shown in Enartech's report.
In my opinion, we will be able to obtain the necessary Water
Court approvals to ensure that the proposed subdivision exemp-
tion has a legal water supply for seven lots, with the water
requirements shown in Enartech's report. I do not anticipate
any problems in obtaining the necessary approvals, although the
Water Court procedures do take a certain amount of time.
If you have any questions, feel free to contact me. Unless
I hear from you to the contrary, I will prepare the necessary
Water Court applications for filing in the month of September,
1989.
