PROJECT NAME: Heavenly View Subdivision, Replat Exemption
OWNER: Arnold Jowell
ENGINEER: Gary Berschauer of Eldorado Engineering
REQUEST: To adjust the boundary of two lots within this previously
approved Minor Subdivision. This adjustment is necessary
to provide a suitable building site to each lot.
PREVIOUS HISTORY:
Heavenly View was approved as a six lot Minor Subdivision
Exemption on December 1, 1980. The terrain is steep sloping
with road grades of over 8%. After road construction within
the subdivision the applicant discovered that there was not a
suitable building site on one of the lots.
LOCATION: Approximately 2 mile east of Silt on County Road 218.
WATER: Individual well
SEPTIC: Individual Septic
ROADS: Private as constructed
COMPREHENSIVE PLAN: This proposal lies within the district A, Silt's Urban Area of
Influence. The comprehensive plan calls for a minimum lot
size of two acres. Consequently this proposal does not conflict
with the Plan.
ZONING: A/R/RD, this district allows for a minimum lot size of two acres.
QUALIFICATIONS:
The conveyance is for the purpose of adjusting property lines and
the conveyed tracts become part of existing tracts, there being
no new parcel created.
FINDINGS: 1. This request meets the requirements for exemption from the
subdivision process as set forth in Resolution No. 80-65.
RECOMMENDATION:
2. Satisfies the requirements of the A/R/RD zone district.
3. Is in compliance with the Comprehensive Plan.
Approval with the condition that the following condition be
completed and submitted to the Planning Department prior
to the signing of the final resolution approving this request:
CONDITION: An amended final plat be submitted with a building
envelope shown on all six lots with a statement
from an engineer that a suitable building site does
exist within that building envelope.
