In a nut shell, the prospective buyers want a property without any issues. Ms. Ciani and the seller's realtor both
contacted us with this desire on March 9 & 10. The original building permit included an unfinished basement. Please
see email string attached. Somewhere along the line, the basement both got finished and an illegal Accessory Dwelling
Unit was built. They submitted a permit to clean up this situation last Friday March 20 with missing information
submitted to us today. We have not had time to review this information. I do not see any issues with the submitted
information but the State Electrical Inspector will need to approve the electrical installation before we can also inspect
and finalize the project.
All this does take time. 13 days to get the information submitted to us cannot be turned around, inspected, and
processed in one afternoon. The county is not requiring them to get this done within any specific time frame. The
buyers can close on the property move into the house and clean up the issues post the closing. We are not putting any
pressure on anyone to get this done on any time frame.
I will review the submitted information. I believe we can issue the permit today and schedule an inspection with the
present owner. The State will still need to do their part before we can finalize the permit. Let me know if you have
questions. I can also call Mike to answer any questions he has.

A design professional is a professional architect or engineer licensed through the State of Colorado to practice in the
state. They will review the existing construction and provide a sealed letter stating the construction appears to meet the
2009 IRC with regards to concealed construction (plumbing, structural, insulation) with the finishing of the basement.
The state electrical inspector will also do an inspection to verify the electrical meets code. The county will do
inspections for any visible aspects of the construction (stairs, egress windows, smoke and CO alarms) and be the last
inspectors to generate a final inspection to close out the building permit.

Can you please explain to me what a design professional is? Is it a glorified contractor?

That is the process. I cannot recommend anyone without others getting upset. Until we have a building permit
submitted, it is hard to determine the time frame to get this completed. It sounds like work will need to be done to
remove the kitchen. A demo permit could be taken out anytime if that is the desired direction. The permit with the
state electrical could also be taken out anytime which might help with that variable.

I was hoping to just meet with an Inspector at the house today but this is the answer I received back from the Listing
agent.
Do I really need a letter from a "design professional". Where does someone find that person? How long will this
process take?
I really just need to know what it is going to take to bring 923 Mesa up to code so we can still close on the 25th
I was hoping it would be as you said. Please help. Is the statement below correct and if so, can you recommend a

FROM SELLERS AGENT: Becky the process begins with a building permit application submitted with a letter from a
design professional. If my sellers pay for the permit the buyers will need to hire the design professional ... From there a
county and state electrical Inspection is done before final approval. 1 am in a meeting now but will be available later this
morning.

Sounds like they either need to move the closing until after these issues are resolved, or they transfer the risk
of failing building inspection to the buyer. It also sounds like the seller had this work done without the authority to do
so. It also sounds like they can get in compliance with the proper inspections, and that we are putting no time pressure
on them to get the inspections done.
Please tell me how you want to proceed. I'm happy to call the realtor directly, or get on the phone with her
and Andy at the same time.

Andrew,
I reviewed the architect's letter. He states that due diligence by his client, a prospective purchaser of the property
found the basement area to be non -permitted. The architect list several things that are not to code that need to be
modified or added to make the basement code compliant. The stairs are not to code, a smoke detector is missing, there
is a full kitchen which implies an illegal ADU, and the electric needs to be inspected. These are all things determined
during the due diligence by the buyer. We can issue the building permit to address these issues today, but it will take
time for either the buyer or seller to fix. The letter is dated Friday March 13. We received it one week later Friday
March 20th four days ago.
A realtor calling a county commissioner does not change the above situation. I would guess the solution is with the
contract to buy the property and is out of the scope of the county to deal with. Let me know if you need any additional
information.
