BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFfELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) S30-28-101 (I0) (a) (d) as
amended, and SS 2.02.01(d) and 3.01.01 of the Subdivision
Regulations of Garfield County, Colorado, adopted January 2,
Lg7g, the undersigned peitioner respectfully reguests the
Board of County Commissioners of Garfield County, Colorado,
to exempt by resolution the division of a 520 acre tract of
land into three tracts of approximately 481, 29 and 10 acres
each, more or less, from the definitions of "subdivision"
and "subdivided land".
The basis upon which the exemption is requested is that
the subdivision falls within situation 6 of Garfield County
Resolution 80-65. The parcel has been under the same ownership
for nearly nine years, only two new tracts will be created
less than 35 acres in size, and no other subdivisions creating
parcels of less than 35 acres in size have been permitted
earlier.
Petitioner also requests that the Board of County
Commissi-oners find that Parcel A does not create a "new
residential site" within the meaning of Garfield County
Resolutions B1-111. Petitioner admits that Parcel B will
create a "new residential- site", and is therefore subject to
the $200 fee imposed by Resolution 81-111. However, Parcel
A is to be conveyed to the adjoining landowner. The subdivision
will only result in a relocation of boundary lines between

the two owners. The property is used for agricultural
purposes. Since there will be no impact on the community
within the legislative meaning and purpose of Resolution 81-
111, petitioner requests that Parce1 A be exempted from its
provisions.

peition.
